Yeah, I thought I saw second-degree somewhere. This case has taken over the media so much it is hard to find anything on that old case!

I fear this case will go in the same direction. At least in that case they had a body. :( I hope they at least find it before the trial is over so they can submitt the evidence in time!

Ugh, I know. I hope it doesn't go in the same direction.:(

Well according to your link Baez is out on several counts...
1. He does not have the required experience.
2. He has only been in practice for I know less than 3 years.
3. According to the FL Bar site he has not even completed his CLE for the current reporting period. Which I might add would be his first reporting requirement.
Too bad for Jose... what goes around comes around!
 
I remember reading a few weeks ago that he hasn't completed some continuing education requirements that I think were due to be finished by last month and there was some questions as to whether he was qualified because of that to remain on the case.

Here's his profile from the Florida Bar Association and it does in fact note that:
CLER Pending - Requirement incomplete
BSCR Pending - Requirement incomplete

It notes that "a member must accumulate 30 credit hours over 3-year period and report completion by a set reporting date. Five of the 30 hours must be devoted to ethics, professionalism, substance abuse, or mental illness awareness."

He's also listed under the "Young Lawyers Division" but I haven't found if that designates certain restrictions or not.

Well, the Florida RCP are a great starting point, it wouldn't preclude him if someone in his law firm had more experience - ie. in big law firms a lot of times Partners will assign cases to junior associates (1-5 years), and if something big comes up the Partner (10+ years and voting into partnership) will come on and advise/lead counsel. This way junior associates get experience but if, hm, your case turns into a DP case, your firm doesn't have to back out.

BUT - since JBs firm ... has his name ... ? and ... he's only been practicing 3 years? It doesn't seem like there is any "adult" attorney to back him up.

The local Bar probably doesn't want to be made a fool of - since its such a national case, and there are plenty of fantastic law firms in Florida - where...uh...the senior partner has been practicing more than 3 years.
 
Says GA is not concerned and CA is not concerned. She knows all they have is circumstantial evidence. She's never had any doubt that KC was innocent.


Yah, right!!! This is getting so old and boring. She'll be saying twenty years from now when KC is locked away safely in jail that they convicted an innocent person.

Does he get emotionally involved in all his cases? So, he defended the guy who apparently killed his exgirlfriend's child. Can this case get any stranger?
 
I think JB is an @$$, but our Constitution give KC the right to the best representation she can get. I would much rather she has an able lawyer who defends her well than for her to keep JB and come back after the fact to appelate court crying poor representation.

Not only that, if/when Casey is charged with murder, and if/when she goes to trial, then if she is convicted she will be entitled to appeals. If he remains her lead attorney then she will almost certainly win any appeals.

It is possible that JB will retain someone to sit first chair in any murder case, with him taking second chair. Of course that is if he can find someone willing to take this case on, after the mess he has made of it to date.

It does make me wonder though, if the bar does make JB step down or someone else to take first chair (and get the media exposure) will JB still allow KC to come over and play at his office every day?

I totally agree. I want her to be convicted and punished for all she's guilty of, but only after a fair trial.

And she will still be telling people to go look for a live Caylee, but she won't have searched for her once.
 
Can the Bar really come out with such a statement in light of the GJ and in the middle of all this?! I find it difficult to believe they can trash one of their own so easily.

They are not trashing him. He simply does not meet the qualifications for a capital murder case... those rules have been in effect for years. He will probably sit as co-counsel, and one of his associates will be lead counsel.
 
The Bar did make Baez take down the advertising on his web site because it was not true. He had stated he was with the Miami/Dade PD office from 1995 and won 34 of the 36 cases he tried in the first two years there. The problem was Baez was not admitted to the Florida Bar (or any other Bar) until 2005.
I know this is true because I filed the complaint with the Bar.

I could be wrong, but I read awhile back that a licensed attorney can try cases before they pass the bar under the supervision of another attorney who is a member of the Bar association. Many newly graduated attornies work for the public defender's office in order to gain experience before they take the bar exam. They are licensed to practice law... just not admitted to the bar as yet.

Not only are they not trashing him, but they have to look out for the whole BA, if he is not fit to handle this case, it is their responsiblity to say so!
 
I also heard they attended the same school...have no idea if they knew each other, though.

This morning on Orlando Fox 35 they were speaking about JB stepping down from this case and then the news anchor asked reporter Alexis Brito how Casey came to know JB and hire him as her lawyer. The reporter stated that after Casey was arrested (and before she was segregated from the other inmates) she asked other female inmates for names of lawyers and that is where she got JB's name.
There was no mention of any association or link between Casey and JB's daughter Christina.
