Garsh to jury: power or control over object [gun/ammo in this case] means ability to decide what to do with it

Brian Fraga
@BfragaHN

Garsh to jury: possession of firearm does not include intent to use it, just control over it#AaronHernandez

Garsh: "a person who knowingly has power or intention" to exercise control over object "has constructive possession" over said object

jury exits after getting clarification on possession language, attys headed to sidebar

unless they are going out of order..........they have decided the murder charge and moved on to the gun charges and ammo charges.......

so does that mean they are down to the gun charges? If are they supposed to go from the more severe charges ie Murder and work down from there?

he will have to settle for "the big elaine".......that's what we call a big salad with all the trimmings after the seinfeld episode where george buys the salad for elaine.....:floorlaugh:

ain't no way this bee is cookin' if they are close to a verdict :winkkiss:

Queen I am pretty new to some of this stuff but when I saw your post now I am really worried....how can they be at gun already and now they seem to think he maybe did not use it?????????? I think this is trouble.

omg let's don't lose hope yet mom :(

think positive!!! they got into the room, looked at one another and someone said, can you believe what a psycho he is?????

right? right??? tell me i'm right? :anguish:

:rose: odin

hummmm. gotta try to process this. confused.

could the question have pertained to only the ammo i.e. the 22 ammo in that the jury is questioning if the 22 found belonged to aaron or the ammo found belonged to aaron since wallace stayed at the flophouse too?

just thinking outloud here

eta..........no, it says firearm

aaron could still be found guilty of murder and ng of the weapon charge.....here's how.....

someone on the jury believed how sultan told the murder went down in that wallace or ortiz did it but because of joint venture voted guilty.....

the jury voted ng on the weapon charge because aaron was seen with the gun in his own home....including the driveway.....which is part of his residence........

am i missing something? it's probably obvious, be kind :D

Thats what I would think, only way I could see that not being the case is if they are still undecided on the murder charge and want to do the lesser charges to take a break from discussing the bigger charge. Maybe they think by deciding on the first two it might help them with the murder charge? I dunno I guess we will find out soon whether they want to work late tonight. I think the judge said they had to notify her by 4pm if they intend to work past 4 30. I wouldn't be surprised if there's a verdict later today/this evening

I wonder what the jury's demeanor was in the courtroom while getting clarification. Looking at ah or ol family. Did they look tired or worn out?

Jurors do not look at #AaronHernandez as they file out to resume deliberations, but he looks at them, whispers something to his atty Rankin

I'm a bit confused at why they're at the gun charges already, I suppose they could decide that even though he was there, if they believe the defense that he didn't know what his friends planned to do there's no joint venture, but he drove them there, he had the weapon afterwards, he let them in his house with no fear of them, I just don't see how they could decide no joint venture on his part.

#AaronHernandez jury deliberating a total of approx 8 hours now.

so soon the jury would need to let the lovely Garsh they want to stay after 430pm....otherwise they leave. NFL seems very very confident...really want to know who is on that jury...has he connected with one of the women? Not only would I feel sad for Odin's family but very bad for McCauley as he really put his all into this case...he really believes in the guilt of ah as do I.

Turaj like NFL I am quite confident
