I can't help but wonder if the delay is in any way related to Michael Proctor. He was the lead investigator (or one of the leads). And he's also under investigation for his conduct in the Karen Read case. That may need to be resolved one way or the other before they can decide how to move forward.

3/4/24 Update: At the status conference at Norfolk Superior Court lawyers for the two sides established that Walshe's new, court-appointed lawyer public defender Larry Tipton, more time to get up to speed on evidence in the case based on a DNA sample that had to undergo “destructive testing” — meaning there was not enough of that sample for the prosecution & defense to conduct independent analyses. The continuation will allow both sides an opportunity to come to an agreement on the destructive testing once Walshe’s attorney has had time to review the evidence. The next date in the case was set for 5/1/24. Walshe's appearance was waived for Monday's hearing & while he had been due to appear virtually, he wasn't on the Zoom call. The hearing came less than two weeks after Walshe was sentenced by a federal judge for a years-long art fraud scheme that he pleaded guilty to before the alleged murder of his wife. On Feb. 20, U.S. District Judge William G. Young sentenced Walshe to three years & a month in prison — which would run concurrent to any state-imposed sentence should Walshe be convicted in his upcoming murder trial. But also Monday, his lawyer, Tracy Miner in that case filed an appeal to the sentence on 3/4/24.

6/13/24 Update: The attorney representing Brian Walshe has told NBC10 Boston he plans to file a motion over possible questionable conduct that names Massachusetts State Police Trooper Michael Proctor. Walshe's defense attorney, Larry Tipton said he has not yet concluded there is any investigator bias involving his client, but what he’s heard in the Read case has raised his suspicions. His motion will name Proctor, Tipton said, as well as any other investigator implicated in the Read case. While Proctor investigated Ana Walshe's murder with a number of other law enforcement officers, he was the designated case officer in the case, which involved a massive search for the missing 39-year-old Cohasset mom of three. Ultimately, her husband, Brian, was charged with murdering her, dismembering her body & discarding it in the trash. He has pleaded not guilty. Proctor said his comments about Read were "unprofessional & regrettable," but said they "have zero impact on the facts & the evidence & the integrity of this investigation."

During Monday's hearing, Commonwealth prosecutors offered an update on the discovery process that is still ongoing.

Norfolk County Assistant District Attorney Greg Connor told the court that he's received all the crime lab materials, and plans to file a notice of discovery, with the exception of the state DNA lab testing. He said the DNA lab expects to finish testing on their items at the end of this month, and he will file another notice of discovery afterwards.

Bode, a private crime lab in Virginia, has items that are exhaustive, Connor said, adding that "decisions may need to be made" about an expert perhaps being sent there or possibly a waiver.

A spokesperson for the Norfolk District Attorney's Office that the term "exhaustive" essentially means that there is such a small amount of the sample, that there will only be one opportunity to test it. In these cases, the testing must be done jointly by the state and defense.

Defense attorney Larry Tipton said that given the amount of discovery to sift through, setting a trial date wouldn't be a good idea at this point.
