There are several issues here. Raw data is only to be shared among the experts. Prosecution did not see the raw data, provided a copy to the defense for their experts to use. Defense instead got a copy of the proprietary handbook and plans on a detailed cross exam using the data and test questions.

Test questions are proprietary and are not to be shared outside the psychiatric profession. Reading them in open court could cause the tests to no longer be able to be used as people could study the tests and give answers to the tests during a psych eval to get around the malingering validity tests.

Also, prosecution has not seen the raw data and are unprepared to exam them with the doctor, or do follow-up with the doctor after the defense cross exam.
 
Wow. Yes - can't see how they thought MMPI wouldn't be allowed. The defense is toast. They should've pled guilty and asked for a plea bargain.

This was a concern for the judge and prosecution. Defense wants to use defendant statements made when answering the test questions to backdoor testimony without putting him on the stand.
 
Wow. Yes - can't see how they thought MMPI wouldn't be allowed. The defense is toast. They should've pled guilty and asked for a plea bargain.

The defense is OK with the MMPI, it's the 3 other tests the Dr. gave to validate the malingering. There is a MFast, SIRS, and another I didn't get the name of. These are the tests the defense had the Dalbert hearing on, saying they aren't age normed. After that hearing the judge said they met the requirements and will be allowed. That's when the defense said they will use the raw data from these 3 tests during their cross exam and all hell broke loose.

Never a dull moment with this defense.
 
I do wonder how long after the trial the defense will write a book?!

Yes, never a dull moment. I gotta say, this defense atty is a fighter, never gives up. I'm glad the judge seems to be very balanced and unprejudiced given the horrific nature of the crime and the fact PC already confessed to it - it would be easy to be biased but this judge seems not. He always listens to both sides and weighs all options.

What I'm wondering is, why isn't defense putting PC on the stand, wouldn't his own testimony of voices and hallucinations etc add some weight to the insanity theory? I understand that this would leave PC open to a brutal cross from the prosecutor (and maybe he himself refused to go through that) but what do they have to lose at this point?

They have a lot to lose, because right now, a few different lesser charges are on the table. It's very risky to put a defendant on the stand as it is, much less one that is a loose canon like Chism. Right now, the jury is focused on the evidence. If Chism testifies, that focus is shifted to him. Sometimes defendant testimony can help a case, but I personally can't see anything that could be gained here.

Regan is doing a fine journeyman's job providing PC with a spirited defense. It is difficult for a defense team when your client is guilty. She will probably not put PC on the stand because under pressure he might crack up and scare the jury. Proprietary test data sounds like the propriety data that some climate scientists produce - if someone makes a conclusion, then you have to be open to specific questioning of the methods used to make that conclusion. You can't just say the magical test made this conclusion. Someone is on trial for murder and has the right to question how conclusions harmful to their defense were made.

The tests are open to scrutiny of experts, and they are administered in a standard way such that the output can be studied by anyone. They just aren't open to anyone who wants to publicize them. The individual items aren't what's at question -- it's the results and what outcomes they predict that are in question. A better example would be that there are plenty of drugs that go through FDA scrutiny, and their exact formulations and methods for producing them are not made public because they are trade secret/proprietary. Same for medical diagnostics. Exact gene lists and combination algorithms aren't made public for some molecular tests, but that doesn't mean the tests and their results can't undergo scientific scrutiny.
