I would say this situation is different in that JO has two children who I assume have gotten attached to KR. She is living there most of the time. If in fact JO was not interested in making it official with KR and in fact there were issues coming up in the relationship then he more than the average guy has reason to break it off sooner rather than later. I want to hear more about that. Her behavior in Aruba seems like maybe an attempt to hang onto a guy that she perceives might be getting ready to break it up. I don't think she fit into his crowd at all. As I recall this was rekindled during covid when you really could not go out and socialize much at all. Maybe it was a handy relationship for JO at the time but then it got old. I am sure truth be told it was great to have help with the children.
So KR suddenly became muderous because she anticipated a breakup?

Also:
She owns her own home, it's not like she was would have been kicked out on the street. Women do not have to rely on men for income or shelter anymore.
 
The EMT witnesses were very clear on what they heard. It was not a question, they heard “I hit him.” Jennifer McCabe, I believe, testified that KR said several things including asking “Did I him him?” and “I hit him.” Questions and statements.

Why would KR say or ask that? If he got out of her car and walked into the house why would she even think along these lines? It makes no sense for her to say or ask that unless she hit him. It’s a confession.

Otherwise she would say ‘what is he doing here?’ ‘Who did this to him?’ Etc

RBBM -- are there set rules and ways that determine exactly how someone responds to a traumatic experience? Any deviation from that makes them a murderer??

Testifies there was snow coverage.
Believes there was snow on the ground
- Lally was asking about the lawn.
He did not look around, it was a long day, he just wanted to get home.


When he left, realized the plow was down, lifted it up with the “fish stick”.
The fish stick is not on the console.
He’s explaining how the he places the plow, depending on the circumstances.
Says he can see if the plow is all the way up.


Testifies he didn’t see any other vehicles when he left, or tire tracks.
He went to the Canon Police HQ.
Why?
He thought he’d be in NY until tomorrow.
He had left the keys to a vehicle on his desk, Berkowitz would get at him about moving the vehicles.


He went there to move the vehicles so the lot could be plowed.
Explaining where he kept the vehicles,and how he usually entered the building.
The surveillance vehicle was parked in the back.


Lally asking about the entrance, sally port, entrance to building.
Has to walk 12’ across the garage to door.
Walks past dispatch.
Was aware there were security cameras.
Assumes his key card access was tracked.


Says “newly promoted” Sgt Goode was in dispatch.
Believes he waved at him.
Lally asking again about why he went in…to get the keys to move the vehicles.
Then he went to West Roxbury, where he as living at the time.
Says he got home about 1:40.
Lally asks between 1:30 -2.

Got home, ate, had another couple of drinks, fell asleep on the couch and went to bed, or went right to bed.
6:30a both his personal & work phones were blowing up.

Chief Berkowitz called first.
He didn’t get the call.
Berkowitz is an early riser, so he didn’t pay attention.
Brian Albert called, he answered the call because they had that long day together

They had a conversation.
He did not talk to B Albert between leaving Fairview and getting home.

After talking to B Albert, he got dressed, drove the Jeep to Fairview, got there after 7am.
Doesn’t recall what he saw outside the house, “maybe a police car”
Weather was real bad.

Higgins says he got home to West Roxbury a little before 2am. He says got something to eat, and maybe a couple more drinks before falling asleep. He says both his work and personal phones were "blowing up" around 6:30ish

Just an observation: In contrast to Brian Albert who seemed very experienced testifying (introducing himself to the jury, etc) Brian Higgins doesn't seem to be at all confident. I would have thought in his job he would have testified in a lot of trials, but perhaps not.

Or maybe it's because he's nervous.

that is a theory that is floating around. I don't think she killed JO but CW needs a motive...they have implied this thinking starting with Aruba and may continue that theme. Absent that what motive is there?

You find Jennifer McCabe to be credible after watching her testify?

I just want to get that on the record.

the amount of drinking these guys do really boggles my mind. More drinks at 2am before going to bed?
