Papers: Stain in Casey Anthony's trunk looks like child outline

An FBI supervisory photographic technologist replied in a later e-mail, "We do not report conclusions about what may or may not have left any marks or impressions in cases like this -- it is too speculative. Others can draw their own conclusions about that."

WESH relied on the expertise of Dr. Bruce Levy, chief medical examiner for the state of Tennessee.

"The defense is going to want to make it as significant as they can possibly make it and claim that it belongs to a perpetrator," Levy said. "If you try to hang on to one tiny fact in a sea of facts, you may lose sight of the whole case."

The little DNA on the duct tape around Caylee's skull wasn't a surprise, either. "If it was on the body while the body was exposed to the elements, exposed to the weather, you would be not surprised to find very degraded DNA, were you might only find a small fragment," Levy said.

Anthony's attorneys said prosecutors can't prove first-degree murder was committed or that Anthony ever abused her daughter, Caylee.

"Specifically, the state cannot establish whether Caylee Anthony's death was accidental, natural, or the result of an intentional or negligent homicide," they said.

On "The Early Show" Friday, Todd Macaluso, a lawyer for Casey, said bluntly, "Casey Anthony is innocent, she will be proven innocent. The state has not produced any evidence whatsoever to prove their case. The case should be dismissed."

On "The Early Show", co-anchor Maggie Rodriguez asked Macaluso and fellow Casey Anthony defense attorney Jose Baez how they will "explain the fact that Casey did not report her daughter missing for a month, that she was out partying when Caylee was supposedly missing, and that she lied to investigators trying to help her find Caylee?"

Baez responded, "We feel that Casey has a very compelling reason for her actions, and we plan on laying them out at trial. That's the proper place for us to lay out a defense."

Considering the way the mail was sent, and his recent financial problems, George thought it was bound to be bad news inside the envelope. He was right. It was a notification from Johnson&#8217;s Wrecker Service. It made no sense. According to the company, they had possession of his family Pontiac. His daughter Casey drove this car and she was in Jacksonville. He didn&#8217;t understand how the 1998 Pontiac Sunfire ended up in a impound lot in Orlando.

Jose Baez and Linda Kenney-Baden were on the Today Show, saying new evidence released by the state proves the prosecution doesn't have a real case against Casey.

"Of all the evidence that they have, nothing. The fibers that were on the duct tape do not connect her to the crime scene. Nothing, there's no finger print evidence. There's nothing that connects her to this crime scene," Kenney-Baden said.

On Good Morning America, another member of the defense, Todd Macaluso said the same thing.

"Not a single hair fiber, not a single fingerprint, not a single speck of DNA," Macaluso said.

Newly released e-mails between FBI lab analysts suggest they have a photograph taken of the stain in the trunk liner. Within the stain, they say an impression emerged they believe was a child's body in the fetal position.

Investigators also say they have hair and air-sample evidence of human decomposition from the trunk.

Defense attorney Richard Hornsby said evidence from her car alone suggests Anthony knows how Caylee died and what happened to her body.

"Casey never said it was stolen and when she abandoned it and her own parents go find it, there's smell of death," Hornsby said.

Baez said the truth about what happened will come out at trial -- if we ever get to that point.

Eyewitness News found the same rare type of tape that was found on Caylee's skull being used by the Anthony family on a Caylee Anthony poster.

With the debate over the duct tape evidence intensifying this week, Eyewitness News re-analyzed video that was taken in the months before Caylee's body was found.

The discovery could make it even more difficult for the defense to argue that Casey didn't put the tape over Caylee's mouth. The defense has really been trying to shoot down the duct tape evidence recently.

"If the defense tries to advance that, that it was one of the volunteers that took that tape, killed the child, put the tape over the child's face to frame Casey, that strains credibility and it will turn the jury off," WFTV legal analyst Bill Sheaffer said.

However, the video taken by Eyewitness News on July 20, 2008 just days after Casey's arrest and one month after Caylee Anthony disappeared, shows that the duct tape on the Anthonys' Caylee posters has the same unique markings as the duct tape on the Anthonys' gas can and the tape found over Caylee's mouth.

The WFTV report was timely, impressive and attention-getting. Reporter Kathi Belich noted that the defense had tried to dismiss the duct-tape evidence. But she reported that the Henkel duct tape on a Caylee poster had the same distinctive markings -- a black oval logo, temperature specifications -- as tape found on the child's remains and on a gas can at the Anthony home.

WFTV legal analyst Bill Scheaffer asked: "What are the statistical chances that those three pieces of duct tape did not come from the same source roll, that roll belonging to the Anthonys?"

Sheaffer said those similarities will be obvious to a jury. Belich said WFTV had not received a response from the defense team about the station's video find.

"Hornsby said evidence from her car alone suggests Casey knows how Caylee died and what happened to her body," reporter Bob Kealing said.

Hornsby said: "Casey had the car. She never said it was stolen or anything like that. She abandoned it." And he added that Anthony's parents recognized "the smell of death" in the car.

In another report, Hornsby described Casey's "incriminating, bizarre" behavior that makes "it obvious she knows something about the post-death issue."

In a motion to strike, prosecutors argued that the paperwork filed by attorney Jose Baez and Casey Anthony's other attorneys is legally flawed. The state said the flaws in the motion to dismiss are "glaring and fatal," and that in its current form it is not even worth Judge Stan Strickland holding a hearing to consider it.

Also, a week before Caylee disappeared, Maitland computer store owner Jim Thompson said Casey Anthony came in looking to buy a monitor. Caylee sat in a chair right across from him. He said he asked the quiet little girl her name.

A week later, the day after Father's Day, Thompson said he saw the same woman coming out of this Casselberry Walmart. He said Caylee was a good ten feet behind and had to open a heavy door by herself.

Thompson estimates he saw Caylee alive at around 4 p.m. Cell phone tower pings show Anthony was at or near her boyfriend's apartment at around 5 p.m. That's less than four miles from the Walmart.

Saying the defense's motion to dismiss was &#8220;legally flawed&#8221; and &#8220;inartfully&#8221; crafted, assistant state attorney Linda Drane Burdick asked the judge to strike the motion &#8211; meaning it should not be considered because it violated Florida Rules of Criminal Procedure.

&#8220;The flaws in Miss Anthony&#8217;s motion are glaring and fatal,&#8221; Drane Burdick wrote, saying Anthony herself would need to swear under oath to whatever facts she claims prove she is being illegally prosecuted.

&#8220;The court cannot even begin to consider the motion because Miss Anthony has alleged no facts and had not sworn to any material facts,&#8221; the prosecutor claimed.

The defense motion did not include a sworn statement from Anthony.

&#8220;If and when Miss Anthony decides to swear to any or all material facts, the State of Florida will issue the response required,&#8221; the state said.

The state&#8217;s motion to strike goes on to say that even if its evidence is &#8220;all circumstantial,&#8221; the judge must wait until the close of all evidence at trial before ruling whether the charge should be dismissed.

For the very first time in the case against Casey Anthony, her lawyer says he won't rule out the chance of a plea deal.

"Any plea that would ever be taken would have to be taken by Casey,&#8221; Jose Baez told Geraldo Rivera during an interview over the weekend.

Prosecutors still haven't publicly offered a deal to Casey, but over the weekend talk show host Geraldo Rivera asked Baez, with all the evidence against Casey, why not agree to a plea deal to save her life. Baez says it&#8217;s up to Casey.

&#8220;Well, that&#8217;s not my decision to make. Umm, that, any plea that would ever be taken would have to be taken by Casey and she would have to accept a plea, if one were offered,&#8221; Baez told Rivera.

&#8220;The proper response would have been, &#8216;Are you kidding me? She&#8217;s innocent! We pled not guilty. We are going to trial,&#8221; WFTV legal analyst Bill Sheaffer said.

Eyewitness News received no response from Baez in attempts to get his comments Monday.

Sheaffer again blasted the defense's approach: "There's one thing consistent about the defense. And that's their ability to continue to make inconsistent statements, one right after another."

Baez had no response to WFTV's story, Belich said. But WFTV put the Rivera interview at the top of its 5 o'clock news tonight. "Up until now, Casey's defense team and her family have insisted there would be no deal," anchor Bob Opsahl said.

It all started with Casey's defense attorneys filing a motion saying that the charges of first-degree murder and child abuse should be thrown out.

The state said the motion is flawed and should be thrown out.

The state attorney's office actually calls the motion "glaring and fatal."

Casey Anthony case: State responds to defense's motion to dismiss murder and child abuse charges

Prosecutors in the case against Casey Anthony responded to her defense team's motion to dismiss the murder and aggravated child abuse charges by reminding them about Florida's criminal procedure rule.

Assistant State Attorney Linda Drane Burdick called the defense motion "legally flawed" and "glaring and fatal."

Last month, Anthony's defense team filed a motion to dismiss the murder and aggravated child abuse charges. They argue there isn't enough evidence to support the charges.

Burdick ended the state's response by adding that it will be decided at the "close of all evidence" if the state carried its burden of "excluding all reasonable hypothesis of innocence."

The judge has not ruled on the issue.
