Judge Denies Casey Anthony Motion For New Hearing

Judge Perry didn't have much to say in his order, simply denying the motion. However, he did write that "no other motions for rehearing shall be considered."
WFTV legal analyst Bill Sheaffer believes that only reason Casey's lawyer would make these kind of accusations at this time is that they are trying to bounce another judge or at least delay the trial while they try.

The defense is accusing Perry, who is the second judge to preside over the case, of being biased against Casey Anthony and being flat out wrong about the facts and the law.

Both sides will continue the battle over scientific evidence at another hearing. They'll discuss "plant growth evidence," detectives collected along with Caylee's remains and a stain found in the trunk of Casey's car.


Judge Perry will also hear testimony about a heart sticker discovered near Caylee's remains.

Bombshells from the prosecution's scientist that even got Casey's attention.
Dr. Arpad Vass, told the prosecutor his reaction to opening the sealed container holding the carpeting.

"I jumped back 20 feet. It was very strong. To me it was the smell of human decomposition," said Dr. Vass.

Casey's eyes widened when he said that, and then she looked down.

Dr. Arpad Vass, found eight times more chloroform emanating from her trunk carpet and 10,000 times more chloroform in the air from her trunk than he's even seen with unventilated decomposition.

Vinnie Politan of "In Session" called it "the biggest moment of the day" at the Casey Anthony hearing today.

Dr. Arpad Vass: "First I jumped back about two feet," Vass said.

"It was, to me, the smell of human decomposition,".

WFTV's Kathi Belich called it "a bombshell that got even Casey's attention."

WESH -Channel 2's Amanda Ober reports: "Vass said over his career he's personally overseen studies on at least 50 decomposing bodies and is intimately familiar with the unique odor," Ober reported.


Ober also highlighted Vass' testimony that chloroform detected in the trunk carpet was 10,000 times greater than what would found in a controlled sample.

"As an attorney that had a powerful effect on me," Sheaffer said. "That's going to have even a greater effect on a juror when they hear that."

Arpad Vass, senior research scientist at Oak Ridge National Laboratory is testifying about his extensive research in buried body decomposition as well as surface decomposition.

Anthony's team is trying to stop air-sample evidence used in her murder trial.

Vass said Detective Melich contacted him about this case.

"He had some odor issues in the trunk of the car," he said.

Vass said in hundreds of such samples he'd collected through the years he'd never seen chloroform levels that high. His reaction, he said, was "surprise."

Vass says the amount of chloroform found in the air sample from the car was too high to be just from decomposition of a human body. "I don't think so," he said when asked by Assistant State Attorney Jeff Ashton. "It's much greater than that."

He estimated the levels found to be 10,000 times greater than normal human decomposition levels.

WFTV Corrects Jose Baez Complaint Story

ORANGE COUNTY, Fla. -- CORRECTION: A spokesperson from the Florida Bar Association says a grievance filed against attorney Jose Baez does not concern misrepresenting facts to the judge in the case against Casey Anthony. Channel 9 had reported the case did concern misrepresentig facts to the judge. The spokesperson said the grievance against Baez dealt with “ethics or misrepresentation.” The spokesperson also confirmed Baez had been informed of the complaint filed against him. The Bar refused to say who had filed the complaint.

Belich noted that Casey can’t use abuse as a defense but might cite it as an explanation for her lack of emotion when her father testified earlier this month. Sheaffer pointed to evidence that would support the George-as-suspect approach: He had access to Casey’s car and other materials in the home, such as the duct tape and the laundry bag found with the toddler’s remains.

“Sheaffer says George could even go along with this, even going so far as to take the Fifth if he’s directly asked whether he killed Caylee,” Belich said in ending the segment. “Sheaffer says Casey could also testify that she was abused and traumatized and that she lied to protect George.”

Belich didn’t cite any comment from the defense team, so we have no confirmation this theory has any connection to reality.

Casey Anthony's defense team today filed new motions attacking the reliability of two important prosecution witnesses that the state wants to testify about science-related matters in the upcoming murder trial.

First, the defense filed a motion attacking "the unreliability of expert opinion testimony" of Dr. David Hall, a forensic botanist for the prosecution.

The defense also filed an amended motion regarding another state witness, FBI fiber examiner Karen Korsberg Lowe.

On Friday April 1. , a second round of hearings on scientific issues in the case is scheduled to resume.

Hearing set for 10 a.m. March 31. over whether to allow new defense witnesses.

Two witnesses are Dr. Jeffrey Danziger and William Weitz, Ph.D. The defense wants both "to rebut recent rulings related to the defendant's state of mind and consciousness of guilt."

Other late witnesses include Assistant State Attorney Kenneth Lewis; Daniel Kondos, a supervisor responsible for maintaining landscape on Suburban Drive, near where Caylee's remains were found; Patricia Young, a Texas EquuSearch member "found to have material testimony necessary for the defendant; and Sharon Cadieux, another "necessary witness to the defendant."

Defense attorneys for Casey Anthony were in court this morning for a brief hearing about why they should be allowed to add late witnesses to the case.

Cheney Mason, was in court today, Jose Baez, was not.

Aside from Dr. Jeffrey Danziger and William Weitz, the defense wants to use four other late witnesses.
