Attorney faces new court test to represent Nancy Garrido

The hearing scheduled for 2 p.m. in El Dorado Superior Court normally would be a routine and brief court session, devoted to mundane issues.

But there will be an element of drama, with Maines and another lawyer expected to be there on behalf of Nancy Garrido.

The judge then appointed veteran defense attorney Stephen Tapson as Garrido's interim counsel pending an outcome of the increasingly tangled legal battle.

The couple accused of kidnapping and raping Jaycee Dugard will be back in court Friday.

And one topic that may come up is Nancy Garrido's apparent past drug use.

Numerous sources tell CBS News her was heavily into methamphetamines, supplied by her husband, Phillip Garrido, reports "Early Show" National Corresondent Hattie Kauffman.

"If her lawyers could establish that, not only did he have this sort of Svengali-like control over her, but he also increased that mind control over her with this heavy supply of drugs, this heavy supply of drug use, then maybe that cuts in her favor," says CBS News legal analyst Trent Copeland.

Still, says fellow CBS News legal analyst Lisa Bloom, "Certainly (her dependency on meth) will give her a diminished capacity defense, that she didn't intend to cause the harm that she did but, over the years, if somebody is taking any kind of medication or drugs over and over again, knowing the effects it has on them, juries tend to be unsympathetic to that kind of a defense."

CBS News has also learned the Garridos hid Jaycee and the girls in plain sight, taking them out in public, to the beach, the library, and the movies. They even went trick-or-treating, with Phillip Garrido in a gorilla costume.

Nancy Garrido's reported to be very frail behind bars. She's had visits from family, Kauffman says, but Mr. Garrido hasn't had any visitors.

Accused kidnappers Phillip and Nancy Garrido returned to court this afternoon, but the continuing dispute over who will represent Nancy Garrido delayed any progress in the case for at least a month.

El Dorado County Superior Court Judge Douglas Phimister set the next hearing date for January 21, and said the court had received new information regarding the case from the district attorney's office that he was going to keep secret.

Gilbert E. Maines, the attorney Phimister originally appointed to represent Nancy Garrido, is fighting to stay on the case, but new allegations against him may complicate that effort.

The judge indicated he had received new information from the District Attorney's Office on Friday that he ordered sealed from public view, as he had two other sets of allegations against Maines.

"I don't want anything to prejudice this case, potentially," Phimister said.

The issue of who her lawyer is now rests with the 3rd District Court of Appeal in Sacramento, which is considering Maines' appeal of his removal. The allegations were sealed by Phimister and sent to the appellate court. Maines said Friday that the court has rejected his request to view the material.

Nancy Garrido's Attorney Struggle Continues

A decision to remove her original attorney, Gilbert Maines, has been delayed pending further review by a state appeals court. Maines is fighting allegations that he drunkenly boasted about plans to write a book about the Garridos.

El Dorado County Superior Court Judge Douglas Phimister said he received one or more additional allegations in a fax on Friday, but declined to offer any further details. All of the complaints against Maines have been sealed during the appeals court review.

Phimister set Jan. 21 for further proceedings. In the meantime, Nancy Garrido's primary representation will come from court-appointed attorney Stephen Tapson.

The man believed to be Dugard's biological father and the woman Phillip Garrido kidnapped and raped in 1976 both showed up Friday to watch the couple sit quietly in red jail jumpsuits and leave the courtroom in a few short minutes.

Phillip Garrido appeared pale and thin in the jury box, his hair buzzed short. Nancy Garrido, too, appeared to have lost weight. They did not share glances.

Sitting in the front row of the courtroom gallery, staring down Garrido, was Katie Callaway Hall, the victim in the 1976 kidnapping and rape.

"Looking at him, I saw the same creepy guy I saw so many years ago," said Callaway Hall, who lives in Las Vegas. "I just want to make my presence known. Any day I can see that man in shackles is a good day for me."

Appellate court moves to reinstate lawyer kicked off Nancy Garrido's case

But the 3rd District Court of Appeal in Sacramento today ruled the trial court must reinstate Maines or explain why he shouldn't be on the case.

"We have carefully examined the record, including the sealed transcripts of two proceedings and other material placed under seal" by the court, the order from Presiding Justice Arthur G. Scotland said.

Scotland wrote that the evidence Judge Douglas Phimister used to remove Maines "does not support" the removal action.

The appellate court instructed Phimister to issue an order by Dec. 24 that reinstates Maines or to pursue the veteran attorney's removal with papers to be filed by Jan. 5.

Until the El Dorado County judge responds to the 3rd District order, Tapson technically remains as Garrido's lawyer.

Attorney Gilbert Maines is back on the case.

Maines won a battle Tuesday in the on-again, off-again saga of his efforts to represent Nancy Garrido in the Jaycee Lee Dugard kidnapping case.

On Tuesday, a state appellate court in Sacramento sided with Maines and essentially told the trial judge to return him to his job after more than five weeks of legal limbo.

Both Garridos have pleaded not guilty and are due back in court Jan. 21, when Maines hopes once again to appear on Nancy Garrido's behalf.

Until then, he has some reading to do. The first round of discovery papers in the case consists of 1,100 pages. The next is expected to total about 25,000.

The decision to reinstate Maines to the case was made by a state appellate court on Tuesday, December 15, 2009. However, it is still up to Judge Phimister whether or not to put Gilbert Maines back as Nancy Garrido&#8217;s counsel. In an order issued by the appellate court, Judge Phimister has until December 24, 2009 to notify them whether or not he will reinstate Maines as Nancy Garrido&#8217;s attorney.

Though the appellate court did not point fingers at Judge Phimister they did state that they believed he had made an error by relieving Maines from the case. A statement reads, &#8220;In reaching this preliminary conclusion, we mean no criticism of the trial judge in this case, who has labored to address serious allegations leveled against Attorney Maines. However, on the record before that court on November 5, 2009, it appears that respondent court erred in ordering Maines relieved as counsel."

An appeal court ruled that Gilbert Maines is still on the case - although the issue hasn't completely resolved yet.

Superior Court Judge Douglas Phimister, who originally took Maines off the case, must now decide if he will present new evidence that Maines has a conflict of interest.

&#8220;It's still in limbo,&#8221; Tapson told the Democrat on Thursday. &#8220;Judge Phimister can attempt to reopen the case, and provide the (appeals) court with new information. Or he can say forget it, and let Maines stay on as the attorney.&#8221;

The Garridos are currently being held in the El Dorado County Jail.

Both are due back in court on Jan. 21.

Enter David Ruiz, 43, a 1983 Novato High School graduate who became an imagery specialist in the Army. He is a senior manager of Pacific Aerial Surveys in Oakland and does freelance work on the side. Ruiz contacted the Hayward Police Department, which was interested in Garrido as a suspect for a separate long-dormant case, and volunteered his services.

"After (Garrido) was caught, I got involved," Ruiz said. "It wasn't until it came out that he had locked her up in the back yard for so many years that aerial shots were thought to show evidence of that and of his intentions. If you kidnap someone at such a young age, the photos could show a progress of how the property changed."

Ruiz looked at aerial images of the Garrido property dating to the mid-1980s and compared a series of shots through the years to establish changes that had been made.

Hayward police Lt. Christine Orrey said her department wasn't even aware of aerial photo specialists as a field, but she's glad Ruiz called. His conclusions helped investigators decide where to focus their attention. This week Ruiz received a thank-you letter from the police chief there for his work.

"He was extremely helpful," Orrey said. "It was big for us."

Phillip and his wife Nancy have been charged with kidnapping, rape and false imprisonment, and they're currently awaiting trial in a California prison. On The Oprah Winfrey Show today, it was revealed that Jaycee is still living in seclusion with her mother Terry Probyn, with whom she was recently reunited. Considering that her escape was one of the biggest stories of the year, it's no surprise she wants to stay out of the spotlight.

According to ABC, a spokesperson said Jaycee was excited to spend the holidays with her family after so much time apart, but she wanted to keep details private. These days, she spends most of her time riding horses and bonding with loved ones. Her daughters by Garrido have tested at a normal intelligence level for their ages.

Dugard and her two daughters fathered by alleged kidnapper Phillip Garrido have been living in seclusion with her mother, Terry Probyn, in northern California since Garrido's ruse was uncovered with the help of police and parole agents.

A spokeswoman for Dugard and her family told ABCNews.com recently that she was very excited about spending the first Christmas and New Years in nearly two decades with her family, but that details of the celebration would be kept private.

Now 29, Dugard spends her days riding her beloved horses and bonding with the family she left behind, including her 19-year-old half-sister who was just an infant when Dugard was abducted near her school bus stop.

Her daughters have reportedly tested at their appropriate grade level, a testament, her family has said, to Dugard's intelligence despite having only a sixth grade education herself.

Lawyers for Dugard have said she intends to testify at the trials of Garrido, a registered sex offender, and his wife, Nancy Garrido. The two are accused of hiding Dugard and her daughters, now 11 and 15, in a backyard lair of sheds and tents that were wired for electricity and computers.

Gilbert Maines has been fighting to keep his job as Nancy Garrido's court-appointed defense lawyer since last fall, when he was fired by El Dorado Superior Court Judge Douglas Phimster over conflict-of-interest allegations. He won a reprieve last month when an appeals court ordered Phimster to either to reinstate Maines or to provide more evidence showing why he should be kept off the case.

But in an order Thursday, the Sacramento appellate court vacated its order. The court said its earlier judgment was made moot by new evidence presented to the El Dorado judge. That evidence has been sealed.

Maines tells The Sacramento Bee he may appeal if Garrido wants him to keep trying to stay on the case.

Appellate court upholds ouster of Nancy Garrido's lawyer

"This came as a complete surprise to me," the Placerville attorney said shortly after the order was issued by the 3rd District Court of Appeal.

He was accused of boasting about the case and the possibility of a book deal over afternoon cocktails at his Placerville country club in late October.

Those allegations made their way to El Dorado Superior Court Judge Douglas Phimister, who had appointed Maines to the case.

Phimister heard evidence on the claims in closed session and ordered Maines removed because of a conflict of interest. Maines denied the allegations and went to the appellate court, where he won a stay of his ouster.

The new evidence, which was sealed by the court, included five exhibits and testimony from various witnesses, including a police officer, discussing Maines' alleged behavior.

"They generally said I was talking out of school, I was talking about the case," Maines said. "First of all, there's not a gag order.

"And, even assuming I did talk &#8211; and I don't admit I did &#8211; if there's something wrong with that, it's up to my client to say."

Nancy Garrido has said previously she wanted Maines to stay on the case, and Maines said he will appeal the latest order if she still wants to retain him.

He cannot contact her directly because he is not her attorney. Instead, he must go through Stephen Tapson, a veteran Placerville lawyer appointed as interim counsel while the matter is being decided.

Media seems to focus on sensational missing persons

)It's hard to believe Kiplyn Davis, a missing person who has received more media attention than anyone not named Elizabeth Smart, has been forgotten, but it's my belief she has been in the past few years. The Davis Family and local authorities have done an excellent job at keeping her memory alive.

However, in response to the arrests in the case, a majority of the population has let her case slip into the endless abyss of their memory.

Sure, people have been arrested in conjunction with the case, but we must never forget that she hasn't been brought home to her wonderful family.

The media latches onto the case of a missing person because it's either a great human interest story (Elizabeth Smart) or is sensational enough to get ratings (Jaycee Lee Dugard). A lot of stories slip through the cracks because they wouldn't translate well on the small screen. The stories that do receive media attention end up getting a lot of it. As a result, the viewing audience gets bombarded with every minute detail of this person's case. Sometimes this exposure results in the case being solved, but other times it makes the public tired of hearing about it. Missing persons can get overexposed like celebrities or Hollywood's latest blockbuster.

The memory of Kiplyn Davis should glow brightly like the front porch light at Richard and Tamara Davis' house, never to be turned off.

Survivor's tale highlights special CASE meeting

Maria Suarez tried not to weep, but her eyes misted in the memory of a life shattered from the time she was an innocent girl of 16, the age when she was stolen off the streets of Los Angeles and sold into sexual slavery for $200.
Suarez told her story Monday at a special meeting of San Bernardino County's Coalition Against Sexual Exploitation observing the National Day of Human Trafficking Awareness.

When she finished, the audience of nearly 200 people gave her a standing ovation.

District Attorney Michael A. Ramos, Board of Supervisors Chairman Gary Ovitt and Sheriff Rod Hoops were among the high-ranking city and county officials attending the meeting to show their support for the efforts by CASE to halt child prostitution in this county.

When she turned 18, he made her find a job and turn all of her earnings over to him. He continued to use her for sex as well.

Such things bring to mind Jaycee Dugard, who was kidnapped on her way to school when she was 11 and eventually bore her abductor two children and kept business records on a computer for the family business.

Suarez had been the man's prisoner for more than five years, she said, when a tenant of the slaver beat him to death with a cudgel. The killer ordered Suarez to hide the club under the house, which she did.

That involvement cost her 22years in California State Women's Prison at Chino. She said she didn't understand what was happening when she was convicted. She was released from Chino on May25, 2004.

Suarez spends her days counseling others about domestic violence.

She has no husband, no children and at 49 - "I'm too old for children. I have no money for medical miracles."

Say what you will about Gilbert Maines -- and plenty of people have, recently -- but no one can say he's not a fighter.

The embattled former attorney for Nancy Garrido plans to return to court today in yet another bid to get back on the case.

"I'm doing what my client has asked me to do," Maines said Friday. "I don't have a choice."

So, the 69-year-old Placerville lawyer will be filing an appeal of his removal from the case in El Dorado Superior Court today.

It will mark the fourth time since November he has filed an appeal to continue representing Garrido, who is accused along with her husband, Phillip, of kidnapping Jaycee Lee Dugard from her South Lake Tahoe neighborhood in 1991, when Dugard was 11.

Maines said his latest appeal will focus on the basic question of whether a client can be denied the attorney she wants.

The Garridos' next court hearing is scheduled for Thursday and likely cannot proceed without the attorney issue settled.

If Maines loses his appeal in Superior Court, he will proceed to the 3rd District appellate court, he said. Meanwhile, he intends to be in court Thursday along with Nancy Garrido's current interim attorney.

PLACERVILLE — Phillip and Nancy Garrido are scheduled to appear in El Dorado County Superior Court this afternoon to set a date for a preliminary hearing, according to the El Dorado County District Attorney's Office.
The Garridos have both pleaded not guilty to 29 felony charges, including kidnapping, forcible rape and false imprisonment, in connection with the kidnapping of Jaycee Dugard.
The couple allegedly snatched Dugard, who was 11 at the time, on the morning of June 10, 1991, as she waited for a school bus near her South Lake Tahoe home, according to the El Dorado County Sheriff's Office.
Dugard, now 29, is believed to have been held captive for 18 years in a series of makeshift sheds and tents in the backyard of the Garridos' home on Walnut Avenue in unincorporated Contra Costa County just outside of Antioch.
While living on the property, Dugard gave birth to two daughters allegedly fathered by Phillip Garrido.
Prosecutor Bill Clark said today that his office is ready to set a date for a preliminary hearing, but that he believed the defense would ask the judge to further delay the hearing.
The district attorney's office does not plan to offer either defendant a plea deal in the case, Clark said.
Today's hearing is scheduled for 1 p.m.

A judge said Thursday that he wants Stephen Tapson to be Nancy Garrido's attorney and set her bail at $20 million.

Meanwhile, Gilbert Maines continues to file appeals to be Garrrido's attorney, because he says that she wants him to represent her in court.

El Dorado Superior Court Judge Douglas Phimister said the back-and-forth with Maines' appeals have held up the case.

"This has sidetracked the case and adversely affected the rights of the defendant because this issue continues to hold up the trial," Phimister said

Phillip and Nancy Garrido are scheduled to appear in El Dorado County Superior Court this afternoon to set a date for a preliminary hearing, according to the El Dorado County District Attorney's Office.

The Garridos have both pleaded not guilty to 29 felony charges, including kidnapping, forcible rape and false imprisonment, in connection with the kidnapping of Jaycee Dugard.

The district attorney's office does not plan to offer either defendant a plea deal in the case, Clark said.

Today's hearing is scheduled for 1 p.m.

Fed up with delays in the kidnap case against Phillip and Nancy Garrido, a judge in Placerville today booted defense attorney Gilbert Maines as Nancy Garrido's lawyer and ordered the case to move forward.

Maines said he would continue his fight to represent her, adding that Garrido wants him as her attorney.

But the judge instead appointed Stephen Tapson as the attorney to handle the case.

"This case has been sidetracked by the issues of counsel, and that could adversely affect the rights of the defendants," said El Dorado Superior Court Judge Douglas Phimister.

Tapson later asked Phimister to allow Nancy Garrido to be released on bail, noting that she has no previous criminal record.

Phimister agreed, setting her bail at $20 million, saying, "I consider her to be a danger to the community and also a flight risk."

Tapson said after court that Nancy Garrido wanted to send a message through the media to Jaycee and her two daughters that she "misses them and loves them."

Tapson said Nancy Garrido was extremely emotional about not being able to see them.

"I've got an old briefcase with tears on it," Tapson said.

Phimister set the next hearing in the case for March 25.

Maines filed a new appeal Tuesday in Superior Court in Placerville and said if that is denied he will return for the third time since November to the 3rd District Court of Appeal in Sacramento.

Phillip Garrido is not eligible for bail because of a hold placed on him by corrections officials in Nevada, where he was previously convicted of rape and kidnap.

El Dorado Superior Court Judge Douglas Phimister set the bail for Garrido at $20 millions, calling Nancy a threat to the public.

"I consider her a danger to the community and clearly a flight risk," said Phimister.

Also at today's hearing, Phimister addressed a writ filed by Nancy Garrido's former attorney, Gilbert Maines, to get back on the case.

"I've got your writ. I read it," said Phimister. He continued to say that he had already ruled on it and that the second request would not work.

"Nancy, I know you want Mr. Maines as your attorney, but for reasons that remain confidential, I am removing him from your case and appointing Mr. Stephen Tapson as your news council," said Phimister.

Maines said that he would have no choice but to go to the court of appeals.

Susan Gellman is a former big-city lawyer now living in a small California town and working a case that everyone's talking about.

She's representing Phillip Garrido, who's accused in the kidnapping of Jaycee Lee Dugard.

As a public defender, you get assigned cases -- you don't pick them.

Gellman said she has a high caseload and is busy.

"I would say that finding the time to work on all of my cases is a challenge right now. And this case is important, but all the cases I have are also important," Gellman said.

Gellman has 43 other clients she's been assigned to along with Phillip Garrido.

Would those be the same parole agents who kept an eye on convicted rapist and kidnapper Phillip Garrido for 18 years without noticing he kept Jaycee Lee Dugard in the back yard as his sex slave from the time she was 11?

Nancy Garrido&#8217;s former attorney, Gilbert Maines, was in attendance and had hoped to be re-appointed to the case. He was removed for reportedly speaking publicly about the case and considering writing a book. Judge Doug Phimister appointed Stephen Tapson to represent Nancy Garrido.

Phillip Garrido remains in custody at the El Dorado County Jail without bail.

They are scheduled to return to El Dorado County Superior Court March 25.

SACRAMENTO, Calif. --
Jaycee Lee Dugard's daughters are officially listed in the state's records. In December, a state judge ordered birth certificates for both girls.

The documents list the official names of the two girls, but KCRA 3 will not release them. One of the names listed is different from what has widely been reported. Both of the girls' last names are listed as "Dugard" on the document.
