George Zimmerman won't have pre-trial 'stand your ground' hearing

During the hearing, Zimmerman was questioned under oath by Circuit Judge Debra Nelson. The state had asked the judge to demand an answer from Zimmerman about whether he was waiving his right to a "stand your ground" hearing.

Over O'Mara's protestations, Nelson questioned Zimmerman, asking if he had made the decision to waive his right to a pre-trial immunity hearing.

"After consultation with my counsel, yes, your honor," Zimmerman replied.

SANFORD, Florida (AP) — The former neighborhood watch leader charged with fatally shooting a Florida teenager told a judge Tuesday that he agrees with his defense attorneys' decision not to seek an immunity hearing under the state's "Stand Your Ground" self-defense law.

Under questioning from Circuit Judge Debra Nelson, George Zimmerman repeatedly said "yes" to a series of questions asking if he was aware he was giving up the right to a hearing before his second-degree murder trial in June. A judge would have sole discretion in an immunity hearing to decide if Zimmerman is exempt from culpability in the shooting. A jury would make the determination in the murder trial.............

Prosecutors and defense lawyers in the case against the man charged with murdering Trayvon Martin squared off in a pre-trial hearing today in Orlando.

Under oath, defendant George Zimmerman waived his right to a self-defense hearing prior to his trial. Zimmerman told Circuit Judge Debra Nelson that he understood Florida's self-defense laws, that he had talked to his lawyers about the stand-your-ground statute, and that he has decided not to have a pre-trial immunity hearing.

The questioning confirmed that Zimmerman has waived his right to an immunity hearing before the trial but leaves open the option to have a hearing later....more at link........

Key court hearing set in George Zimmerman case

With jury selection scheduled to get underway in George Zimmerman's second-degree murder trial in less than two weeks, prosecutors and defense attorneys will be in court Tuesday morning as the judge considers more than a dozen motions.
Zimmerman will be asking the judge to postpone the trial for an unspecified period, claiming his attorneys need more time to research one of the state's witnesses.

ORLANDO, Fla. -- A court employee who retrieved photos and deleted text messages from Trayvon Martin's cellphone has been placed on administrative leave after an attorney testified that prosecutors didn't properly turn over the evidence to the defense, an attorney said Wednesday.

Former prosecutor Wesley White said he was ethically obligated to reveal that Fourth Judicial Circuit Information Technology Director Ben Kruidbos retrieved the data that weren't turned over.

Kruidbos was placed on leave shortly after White testified during a hearing in George Zimmerman's second-degree murder case on Tuesday. White said Kruidbos was interviewed by state attorney investigators twice before the action was taken.

White said he wasn't surprised of possible evidence violations by Zimmerman prosecutor Bernie de la Rionda.

George Zimmerman's murder trial will start next month as scheduled, a judge decided Tuesday, and the defense cannot use its opening statement to impugn Trayvon Martin's reputation.

But the judge ruled that some derogatory information could be admitted during the trial if the defense can show relevance.

The Fifth District Court of Appeal today ruled that Benjamin Crump, an attorney for Trayvon Martin’s family, must sit down and answer questions under oath by George Zimmerman’s attorneys.

In the just-released ruling, the court wrote that Zimmerman’s lawyers have a right to question Crump about his dealings with a woman who’s expected to be the state’s most important witness.

She’s a young Miami woman who was on the phone with Trayvon moments before he was shot.

Zimmerman's attorney apologizes for remark regarding Trayvon Martin cellphone video
Attorney Mark O'Mara said during a hearing on May 28 that Martin's cellphone had video of two of his friends who were "beating up a homeless guy."
O'Mara said the statement inaccurately described the video. He said the video actually was "two homeless guys fighting each other over a bike."

Trayvon Martin text messages reveal a troubling side

"....he repeatedly appears to inquire about a gun with a friend: "U got heat??" Hours later he's asked by text: "You want a 22 revolver?" The friend who sent the message said it was bought by "my mommy."

On Feb. 21, Martin appeared to be heading to Sanford to live with his father. But he hadn't lost interest in guns.

Before George Zimmerman goes to trial in the death of Trayvon Martin, his attorney is asking the judge to block jurors from hearing a few words about his client – at least during opening statements.
“Profiled … vigilante … wannabe cop” are among them, according to a motion filed by attorney Mark O’Mara.
 
The audio played in court Thursday remains as chilling as ever, cries recorded in a 911 call that captures the violent struggle between George Zimmerman and Trayvon Martin, ending in a fatal blast of gunfire.

Lawyers played the recording Thursday as part of a crucial hearing to determine the extent of expert testimony that will be allowed during the trial when jurors will try to decide who was hollering in fear during the confrontation.

For prosecutors, the testimony at trial -- set to begin with jury selection Monday -- could show Zimmerman as the aggressor in the fatal shooting of the unarmed Miami Gardens teen, whose slaying drew worldwide scrutiny on the small town of Sanford.
