State Supreme Court asked to review Stislicki murder case

State Attorney General Dana Nessel’s legal team has not banished its hopes of using Floyd Galloway’s sexual assault on an apparent stranger as evidence against him in the murder case of Danielle Stislicki,.

Nessel's team failed to get the decision they wanted from Oakland County Judge Phyllis McMillen and then the Michigan Court of Appeals.

Supreme Court staff confirmed that state’s Assistant Attorney General Scott Shimkus filed a formal request for the attention of Michigan's highest court on Feb. 11, and Galloway’s attorney Ellen Michaels has until next month to formally respond.

Michaels has countered that the Hines Park case and Stislicki’s murder case are too dissimilar to be used in the same trial.

Galloway’s next Oakland County Circuit Court hearing is scheduled for March 18.
 
I hope that justice prevails and that Dani will be found. Dani lived less than .5 miles from my old workplace so this is close to home.

FG, please allow Dani’s family to find closure. You don’t gain OR lose anything by not disclosing the location.
 
I have to have faith that the evidence against FG as laid out in the preliminary hearing and the arrest warrant will be enough ... and they have probably amassed more evidence against him (hope). The ruling that the attack on the jogger is inadmissible really chafes me, though ... I’m a lawyer and I appreciate his rights and all that, but dammit. It hurts. #finddani

Trial was set to begin on 4/20/20 (thru 5/1/20)-postponed to 12/7/20 has been continued. No further dates.

12/17/20 Update: Any jury charged with deciding whether Galloway schemed & successfully murdered a missing Danielle can ignore his 2016 sexual assault on a Hines Park runner – for now. The assault happened a few months before Stislicki’s December 2016 disappearance, and the Michigan Court of Appeals said in an opinion released Thursday that the cases are too dissimilar to risk "unfair prejudice" against the defendant. Appellate judges affirmed Oakland Circuit Judge Phyllis McMillen’s decision. State prosecutors still can take their arguments to the Michigan Supreme Court. Pretrial status conference hearing on 1/14/21.
1/14/21 Update: pretrial status conference hearing was held. Next pretrial hearing on 3/18/21. 2/5/21: On Friday, a court of appeals ruled that part of Galloway’s past cannot be introduced in as evidence. Galloway’s admission to sexually attacking a jogger has been ruled as non-admissible.
2/24/21: State Attorney General Dana Nessel’s legal team filed a formal request for review of Danielle's case after Oakland County Judge Phyllis McMillen denied the motion.
 
Funny you should ask about a trial date @Mominmi ! I couldn't find any articles - recent ones - for the hearing yesterday, but the court site has the trial date set.

Trial Date Scheduled For Alleged Killer Of Danielle Stislicki - Mar 19, 2021


"Jury selection is set to begin Oct. 12, 2021 in Oakland County Circuit Court for the case against Floyd Galloway, Jr., charged with first-degree premeditated murder in Stislicki’s death.

Investigators believe Galloway was attracted to Stislicki but she didn’t feel the same way. It’s also believed Galloway concocted a ruse about car trouble on the day she went missing to get a ride from her and then killed her in his Berkley home.

An Oakland County Medical Examiner determined Stislicki was the victim of some type of assault, possibly strangled to death.

Galloway is serving a 16 to 35-year prison sentence for the kidnapping, criminal sexual conduct and assault of a woman in Hines Park in Wayne County that happened three months before Stislicki vanished. The conviction, however, can’t be used as evidence in Galloway’s upcoming trial, as ruled by the Michigan Court of Appeals. Appellate court judges said there aren’t strong similarities between the two cases to demonstrate motive, contrary to what the prosecution believes."
 
Then poor family - that's a long time to continue to wait. I'm dying to know what evidence the state has in addition to all that was presented in the preliminary hearing - I'm hoping they didn't show their whole hand at that time, and they've been able to use the time since to do more digging.

The state’s highest court will not let Floyd Galloway’s prosecutors re-assert that sexual assault evidence can be used to prove he murdered a missing Farmington Hills woman.

The Michigan Supreme Court issued an April 27 order that denied the request to appeal “because we are not persuaded that the question presented should be reviewed by this court.”

Oakland Circuit Judge Phyllis McMillen and the Michigan Court of Appeals already have ruled that the assault evidence should not be used to prove the premeditated murder of Danielle Stislicki, 28, because the two cases involved facts too dissimilar.

Ellen Michaels, Galloway’s murder defense attorney, said the Michigan Supreme Court obviously ruled that the right legal decisions already had been made. Now, she and Galloway can focus on the murder investigation.

Bummer. A conviction would have been a lock if the Hines Park incident had been allowed in.
