"Dale is really at a point now where he wants to put this behind him," Dale's attorney, Larry Leib, said Friday. "After two years of looking, searching and hoping, he's comfortable with allowing her to be declared deceased and hopefully can move on."

Dee was 52 when she was last seen in the early morning of April 25, 2021, at her residence on Munger Road in Franklin Township. She has not had any contact with her family or friends since she went missing.

Dee's nephew, Parker Hardy, said Dale's decision shocked the family because Dale's legal representation has argued against efforts by other members of Dee's family to declare her legally dead, instead claiming that she had instead left to start a new life.

But despite withdrawing the petition, Dale had nothing to do with Dee's disappearance and "still believes that she's out there somewhere," Leib said.

Hardy said the family of Dee intends to file a wrongful death suit against Dale after Dee is legally declared deceased.

The trial to declare her deceased was initially scheduled for June 20 and 21 at 9 a.m.

Dale's withdrawal comes a week after Michigan State Police executed a search warrant on approximately 70 properties in Tipton that culminated in excavation equipment digging on a Paragon Road property on May 4. Authorities have not released the results of the search nor the warrants that led them to search the properties.
WTOL 11 submitted a Freedom of Information Act request for the search warrants for these properties.
 
In the midst of it all, the Hardys are in a fierce legal battle with Dee Warner’s husband, Dale Warner, whom they suspect murdered Dee April 24, 2021. Several of Dee’s close friends say that she was crying all day after getting into a heated argument with Dale and was going to ask him for a divorce that night.

The Hardys are seeking a declaration of death for Dee among other legal action and hired several private investigators to look into Dee’s disappearance before settling on attorney Billy Little. Little interviewed more than 50 people in the investigation and is still in contact with Hardy on a regular basis discussing strategy and the intricacies of the case.
 
Dale Warner, along with his personal assistant and accountant Mark Weisberg, were found to be in civil contempt of court by Lenawee County Probate Judge Catherine A. Sala after Sala found enough evidence was presented during Wednesday’s conservatorship hearing showing that Warner and Weisberg have not been adhering to court orders regarding sharing financial documents and transactions with attorneys representing his missing wife.

The jail time ordered by Sala at the conclusion of the more than two-hour hearing was not stated as part of her ruling, but she did note the two men would be held at the Lenawee County Jail until the proper documentation and records have been presented.

“Clear and convincing evidence” was shown, Sala said, that Warner and Weisberg have no intention of complying with the court’s orders, unless “I take action in order to require them to do that,” she said, which resulted in the two men being taken into custody inside the courtroom.

Lenawee County Probate Judge Catherine Sala ruled Wednesday that Dale Warner is in criminal contempt of court. The judge ruled Warner did not cooperate with a court-appointed conservator in the case.

Warner was arrested in court Wednesday and sentenced to 93 days in jail.

Judge Sala first found Warner in contempt Aug. 9, ruling that Warner and his personal assistant, Mark Weisberg, did not produce financial documents as ordered. The pair spent several days in jail on civil contempt charges before being released.

ADRIAN, Mich. — The family of missing Lenawee County woman Dee Warner will be holding a rally on Sunday, November 26 in hopes of bringing awareness and encouraging authorities to take action on a case they do want to go cold.

Months later there's been no ruling on Dee's Declaration of Death and no word if charges will be filed against her husband.

This has Dee's family feeling frustrated.

"It seems as though our air came out of our sails," says Hardy. "We had some momentum up and we lost it because we're not getting that ruling from the judge."
