Wayne County Prosecutor Kym Worthy told county commissioners Tuesday that budget woes are affecting her office’s ability to handle its growing workload and slowing down high-profile cases like the death of Jane Bashara.

“In any other office we would have been done probably already,” Worthy said of the Bashara case, adding that her office has had to pull resources away from the case to handle other matters.

Former handyman Joseph Gentz pleaded guilty to second-degree murder for Bashara’s death. Her husband, Bob Bashara, maintains his innocence but was named a person of interest by police and is serving time for trying to hire a hit man to kill Gentz in jail.

Worthy told the committee on public safety that her office has already made changes to operate more efficiently, but her general fund budget—$25.6-million this year— doesn’t allow for enough people to get all the work done in a timely way.

That budget is down from $31.7 million the previous fiscal year and roughly $8.5 million less than she was promised in a memo of understanding three years ago.

County Executive Robert Ficano has said the county lost about $100 million in property tax revenue since 2009 and the budget for the Prosecutor’s Office is a matter of numbers.

Wayne County Prosecutor, Kym Worthy, met with the commissioners pleading her case to tell them why her office can't survive on the money budgeted her office. It's 9 million dollars less than she was planning on.

"Just ignore it. Just ignore the agreement," says Worthy.

Wayne County Prosecutor Kym Worthy claims that's what Wayne County Executive Bob Ficano said after her office spent nearly a year proving where the dollars go and why it needs the nearly 34 million dollars they agreed upon to effectively prosecute cases.

"A cut from 34 million that you were promised to 25 million it is absurd. I've looked and I've never seen any department that has taken cuts like this," says Wayne County Commissioner, Irma Clark-Coleman.

"The officer who is responsible in that role in this county did not keep his word and did not do anything to fix the situation," says Worthy.

Worthy is in the process of suing the county to stop the budget cuts. With already 50 unfilled positions, her office is forced to lay off 26 more prosecutors last week. No money she says, no prosecutions, and severe delays in bringing cases to trial, pointing to the murder of Grosse Pointe Park mom Jane Bashara.

The escalating battle involving the budget of the Wayne County Prosecutor's Office is expected to be the focus of a hearing in a Detroit courtroom this morning.

Wayne County Circuit Judge Wendy Baxter will hear a motion filed by Prosecutor Kym Worthy challenging the layoffs of 26 people -- including 22 lawyers -- on March 15 as part of her ongoing lawsuit against the county.

Worthy said she needs more people and contends she can't fulfill her constitutionally required duties with her current budget.

Cases kicked to curb

THE GROSSE POINTES — Staff cuts in the county prosecutor's office are causing some police to chase their tails more than criminals.

Action against a third-time drunken driving suspect in the City of Grosse Pointe is delayed because the shrunken pool of prosecuting attorneys is frying bigger fish.

In the Farms, detectives got nowhere trying to check the status of a felony arrest warrant for a person accused of identity theft against senior citizens.

DETROIT (WXYZ) - Wayne County prosecutor Kim Worthy was quick to choose a chair at the committee table that put her back to television cameras present to cover her appearance.

She came to take questions, but also to reiterate her position - her prosecutors' office needs more money ... millions more than what the commission had budgeted for it.

She talked about how responsible she is a steward of taxpayer dollars, that among her first things to do was to audit spending.

"We set salaries to what people should have had, and downgraded others," Worthy said, talking about her administration in 2004.

The next fiscal year, millions less were available ... and, she claims, every year "we found a way to save money and work within our budget."

Worthy fights to bring back Prosecutor’s Office staff at hearing

Oralandar Brand-Williams / / The Detroit News

Detroit — Lawyers for the Wayne County Prosecutor's Office and the county squared off Thursday in a hearing held over Prosecutor Kym Worthy's lawsuit against the recent pink slips in her office.

Worthy wants 26 staff members brought back from layoffs and to get enough money from Wayne County to fund about 12 additional positions in her office.

Thursday's evidentiary hearing on a temporary restraining order fighting against the furloughs of 26 contract staffers, which included 22 attorneys and three investigators, was held before Wayne County Judge Wendy Baxter.

During Thursday's testimony Wayne County Prosecutor Office's Chief of Staff Donn Fresard testified that the staffing levels in the office are inadequate and the office has relied substantially on grants to fund many of its assistant prosecutors' wages and salaries but they are restricted mostly to work on cases the grants cover.

Attorney Thomas Bruetsch, who is representing the county, questioned at the hearing how the prosecutor's office is using its staffing level of attorneys.

The proceedings will resume April 4.

DETROIT -
Joe Gentz has a new home at the Macomb Correctional Facility in New Haven.

Gentz, who was the Bashara family handyman, took a deal and pleaded guilty to second degree murder for his role in Jane Bashara's death. He recently was moved to the Level 4 security prison March 28. He is being kept in his own cell for his protection.

It's not far from his family and friends who, as of now, are allowed to visit Gentz on specific days. However, that soon could change if the former handyman causes any more issues behind bars.

The Local 4 Defenders have learned that on March 12 Gentz, who at that time was being held at the Chippewa Correctional Facility in Michigan's Upper Peninsula, had an altercation with a prison guard.

The incident was written up and disciplinary action was taken. It was the first time Gentz has received a behavioral violation while he has been locked up. If he is written up again his security level could change. His opportunity to have visitors could be taken away.

This could also call into question his credibility as a potential witness against Bob Bashara, Jane's husband.

The Defenders are told from insiders that Gentz is extremely agitated in prison and has been having behavioral issues. They say if this continues Gentz may not be able to further help investigators as they work to tie up the case against Bob Bashara.

Bashara's Grosse Pointe Park home now up for sale

Investigators believe Jane Bashara was killed at Grosse Pointe Park home on Middlesex Road

GROSSE POINTE PARK, Mich. -
The Bashara home in Grosse Pointe Park is where investigators believe Jane Bashara was killed.

It's where her husband Bob Bashara later confessed his innocence and where he talked with Dateline NBC about his wife's murder. The home now is up for sale.

Photos from Realtor.com take you inside the 2,800 square-foot house on Middlesex Road. It features four bedrooms, four baths and an incredibly sad story of a family's tragedy. It's a story that must be revealed to any potential buyers.

Local 4 is told the home is in a trust and any money from the sale would likely go to the Bashara children.

Selling a home that made headlines for a murder mystery is difficult but not impossible. For instance, the Washington Township home where Stephen Grant murdered his wife Tara was sold after he was convicted. A family bought that home well under its asking price.

The Bashara home is available for showings but all potential buyers must be screened and prequalified.

Bank tried to sell Bashara home in Grosse Pointe Park for $63,865.57

GROSSE POINTE PARK (WXYZ) - The listing agent for the house where the B ashara fa mily lived in Grosse Pointe Park is not saying if Bob Bashara is behind an attempt to sell his former home for $415,000.

But Action News has learned that someone might have been able to purchase the 2 ,800 square foot home on M iddle sex for just $63,865.57 last November.

According to county records, the mortgage holder, Comerica Bank, foreclosed on 552 Middlesex and tried to unload the property in a sheriff sale, but no one bought it.

We're told Bob Bashara has until May 15, 2013 to redeem the property. And though he's now in prison, he could be behind recent efforts to sell the house that is still in his name.

< SNIP >

When Action News called the listing agent at II Elite Real Estate Services in Roseville, we were told they would not be commenting.

And when it comes to details about a house, Michigan law obligates the seller to disclose certain conditions of the property, but declaring that someone was murdered there is not one of them.

If knowing what crimes may have taken place would affect your desire to purchase any property or how much you want to pay for it, real estate attorney Rod Dunlap suggests potential buyers do their own research, including talking to neighbors and local police.

I can see why it didn't go at foreclosure - who could live in that house? You'd have to exorcise the essence of Bob out of there.

It won't be sold until years and years from now - evidently according to the news there is no legal obligation for the Realtor to divulge what happened at the house.
