And the Judge is?...
:judge::facepalm:
:judge::facepalm:
TM's phone data is where in all this?
The filings in court are to secure out-of-state witnesses for 12 days starting Aug. 29 and ending Sept. 9.
An affidavit filed in the Sidney Moorer kidnapping case has requested a witness attend the Court of General Sessions starting Aug. 29 and last for approximately 12 days.
According to the affidavit filed July 13, Stephen Schiraldi was asked to be in court during the period of Aug. 29 through Sept. 9.
I didn't realize you had already posted about this, PTF. Is this normal?That's gotta be a hassle being a witness IMO. BBM

What the what? Any clue what this is about?

Thanks magnolia. After reading the article from WPDE that PTF posted, it all makes sense now. From the WMBF article I posted, it wasn't clear those were potential dates for a retrial.SS will again be a witness for the state. Nothing unusual going on, IMO.

I wonder if Truslow intends to ask for a change of venue.
BBM - I totally agree, I think it will be hard to convict her. I believe SM was the easier one to try.
Are you comfortable sharing why you think it will be hard to convict TM? Just wanted your thoughts. Thank you!

I think it will be hard to physically place her in the events of that night. So far we have not seen much evidence of that.

Well, we have Sid's word on camera in the against-gag-order interview saying she was in the truck at Walmart (and presumably at the payphone as well). :facepalm:
Since the case was heard in MB last time, not too sure. But since he was very close to being convicted 10/2- maybe Truslow will be more aggressive this time around. Could this be seen as a delay tactic and not seen in favor of the state? Interesting to ponder.

I'm basing my question on an interview Truslow gave right after the trial. He said there would probably be a new venue for the retrial.
Perhaps he thought his trial strategy was the best approach for this case. I thought he was a too passive myself.
That has got to be something Mr. Elvis regrets. I don't think the cop or Terry instantly understood the seriousness of her car being left there. Terry probably thought he was protecting his daughter by taking it. Unfortunately, the moment he left with the car, possible evidence was contaminated. That could have been instrumental in determining if she drove herself there, if there was someone else's fingerprints/DNA in car. I always had a problem with LE insistence that she drove herself to PTL and that the crime took place there. With the addition of the LB information, I highly doubt she drove herself to PTL. The way they insisted, I thought there may have been video of Heather driving herself there, but I don't think that was the case. This could have been the missing piece to this puzzle. How much time passed from when Terry took the car until it actually got processed? Did Mr. Elvis clean out the car before it was processed not realizing that it could contain evidence?
