Came across this while looking at other stuff this morning. IMO this is the very thing the Prosecution should have had ready to present: From TM's own mother:
“It’s hard for me to go out,” she said. “It’s hard for me to go to sleep. You don’t never know who might pull a gun on you. We don’t trust anybody anymore. You don’t know who you can trust. It’s terrible. It’s like living a nightmare.”

It could've been argued that with TM out on the streets - out with her children - etc - that they could be endangered. That would go to 'risk', no?
Judge said he didn't care if they were endangered--only the public and Moorers said they didn't care either--they would take their chances.
