So, would this subpoena be for AD's mom to appear at the Dec. 3rd court appearance for Ad I wonder?

And since it says active, that means they have not served it yet???

ETA: and why does it say Phyllis D is the defendant?

I wonder if this is a typo; they changed the spelling of her first name.

Hi lbm, we have seen three variations of AD's first name--but it's under this "Antoniette" spelling which current charges were eventually located. Wonder what's up w subpoena for good-up grandma... ETA and why all the aliases?

:parrot:

Ok, I've been doing a little research on the other 2 subpoenas issued on the same day as Phyllis'.
The one for Holland on Hay st.
There is only one Holland on Hay St.
He or she is the director of Divine Intervention Nursing Home.
Is that where AD worked?

There are so many. I may have found BD's alias; won't say anything unless I can find her birthdate to verify. I believe both BD and SD (other sister on obit) both have less common first names.

Keeps them guessing; people can't link one name to the other. Not sure how they do it; reason for fingerprints.

I'm trying to figure this out and just not tracking real well. Do you mean alias names for BD and SD? Because BD's first name is Brenda. Not uncommon. What am I missing? TIA.

I haven't verified but yes, less common than Brenda.

Let me check; doesn't sound familiar. It may be a different person.

AD worked at the Carolina Inn and the Haymount Nursing Rehabilitation Facility

Yeah, it just seems odd that a director of a nursing home is being served, subpoena issued same day as AD's mom.

I know we keep revisiting this...but there's always a variation in describing Shaniya going to AD's house.

Lockhart said he last saw Shaniya in early October as he left for an out-of-state work assignment. Shaniya moved in with her mother about a week later after initially staying with Lockhart's sister, he said.

:boohoo: Hey Neighbor ~ My son has got a raging staph infection, so we are under quarantine. No Thanksgiving over at family's. Would you mind sending one of those pies over to my place by cab???? And a couple turkey sandwiches???

Hey Neighbor - Sorry to hear about your little guy. I remember one year we all got sick at the same time. Had TV dinners for Thanksgiving!

On page 23 of the 49 page document, number 11, it says that there is a five year limit. Then it's over, unless there are some special unusual circumstances such as a death or disability.

So I wonder what she was living on. She must have gotten something for the 7 year old. I think her options were over. Her five years were up.

This gives me the chills. The next step would be taking Brad to court for child support.

That may have been posed to BL as a threat? He may have thought OK, if that's the way it's going to be, take the child and the responsibility that goes along with it? Then Shaniya goes to AD and there's no money coming with her? Maybe that's why she went the route she did with Shaniya? Money?

Davis worked in the kitchen at Carolina Inn at Village Green, an assisted living facility in Fayetteville.

CES, a South Carolina-based staffing company that has a contract with Carolina Inn, hired her in June 2008 after an extensive background check, an official said. She had a good employment record at both Carolina Inn and the Haymount Nursing Rehabilitation Facility, but she is no longer employed by the company, the official said.

Davis worked as a dietary aide at the Carolina Inn at Village Green, preparing meals for residents at the Fayetteville assisted living community, according to owner Franklin Clark. She was employed by CES Inc., a South Carolina company that provides certain workers for Carolina Inn, Clark said.

Davis had worked part-time for Village Green since August, according to a CES executive. CES had done a state background check on Davis before she was employed by the company, the executive said, and her record was clean.

Who knows to whom else CES may have contracted out.

I know we keep revisiting this...but there's always a variation in describing Shaniya going to AD's house.

Lockhart said he last saw Shaniya in early October as he left for an out-of-state work assignment. Shaniya moved in with her mother about a week later after initially staying with Lockhart's sister, he said.

http://www.fayobserver.com/Articles/2009/11/24/955235.aspx

One article stated Shaniya "split the time w" CDL and AD, these say "allowed her to move in w mother," and "until he (BL) recently let her move in w her mother." In last article it states simply "take out of school," then principal says "withdrawn." Mitchell, Cromarties, and AD's side of the family, all seem to deny knowledge of any problems. :waitasec:

Although Lockhart said he would try to forgive Davis for Shaniya's disappearance and death, his sister said she never cared for Davis and how she cared for her children.

"Never have I allowed my children to live in an environment that was unsafe," Lockhart-Davis said....

A search of court records turned up no previous criminal charges against Davis, but she lived at a home on Wall Street in July that police raided. Officers found "narcotics manufacturing materials" in the house, but no one was charged, according to an incident report.

Residents said they had seen Shaniya running around the neighborhood unattended, but Davis' family maintains she was a good parent.

"I know she’s a great mom. She’s a great mom. Antoinette really loved her children,” said Davis' uncle, Arthur Cromartie.

Cumberland County Schools officials said Shaniya was a kindergarten student at Morganton Road Elementary School until mid-October, when she was taken out of the school and wasn't enrolled elsewhere.

"We have no knowledge of what the reason was for her being withdrawn from school," Morganton Road Principal Charlotte McLaurin said.

Lockhart said he allowed Shaniya to move in with her mother on Oct. 9.

http://www.wral.com/news/local/story/6435879/

Antoinette's relatives told Eyewitness News she would never harm her children.

"She's not a bad mom," said Leona Cromartie, Antoinette Davis' aunt. "She wouldn't hurt her kids. That's not her style."

Cromartie says her niece was doing a good job raising Shaniya.

Shaniya was living with her father until he recently let her move in with her mother.

"Net gave him Shaniya until Antoinette could get on her feet and get a better place for her children," Cromartie explained.

Family members do not believe the charges against Antoinette are true.

"But you can't stop people from saying things," said Yvonne Mitchell, Antoinette's aunt. "You don't know whether they're true or not. But if they don't have any proof of it, they really should not be saying that."

Antoinette has another child and authorities say the Department of Social Services had been looking into living conditions at the family's home in the Sleepy Hollow Mobile home park. However, relatives say they had no reason to believe Shaniya was in danger living with her mother.

"They seemed to be doing fine," Mitchell said. "When I seen them, they seemed to be doing fine. We all was at my mother's house. Antoinette seemed fine. Shaniya seemed fine. They was laughing and playing with the other little brother. He was fine. I mean everybody seemed to be ok."

CL speaks/misspeaks on Nancy Grace (contradicts her other statements, imo)

http://transcripts.cnn.com/TRANSCRIPTS/0911/16/ng.01.html

CHEYENNE LOCKHART: I knew her enough, but I -- you know, I was never really friends with her. But her mother, I would never think that she would do something like that.

GRACE: Why do you say that, Cheyenne?

CHEYENNE LOCKHART: She just seemed like the sweetest woman. I mean, she didn`t come from much, and stuff, but her -- like, if you just met her, you know, she had the sweetest voice. She had the sweetest personality, and especially towards me. I would never think that she would do anything like that.

GRACE: It`s my understanding that department of family and children`s services had been to the home on many occasions and that there was a problem with drug use in the home. Were you familiar with any of that?

CHEYENNE LOCKHART: I did know about Antoinette using drugs, but I -- I knew of DSS going to her home, but I never knew that -- somebody told me that she wasn`t supposed to have her, so I didn`t know of that.

GRACE: I`m sorry. I can`t hear you. Repeat?

CHEYENNE LOCKHART: I was told that she wasn`t supposed to have Shaniya, but I did know about -- you know, I knew she did drugs and stuff.

GRACE: Do you know what drugs she was on? It`s our understanding it was cocaine.

CHEYENNE LOCKHART: Yes. I mean, I didn`t know for a fact, but I figured that. But I did know she smoked marijuana. But I`ve always thought that she did cocaine.

BUT then she talks about cigarette burn with the "sweet lady" ...."I would never think that she would do anything like that." HUH?????? FOS.imo
