A sentencing panel must consider if the aggravating circumstances justify a sentence of death, Johnson says, and if further mitigating circumstances are present and if a death sentence would be excessive.

Trail said earlier he attempted to remove her tattoos in order to make her body unidentifiable.

Loofe's wounds were so severe it has difficult for doctors to determine how and when she actually died during an autopsy, Johnson said.

It is reasonable to conclude Trail thought no one would immediately miss Loofe, Johnson says. Loofe lived alone in Lincoln hours away from her family in Neligh, and was interested in dating Boswell, which made her their ideal target.

George Loofe's head sinks and he started rubbing his forehead as Johnson reads the mutilation and damage done to Loofe's body.

Trail and Boswell dismembered her, but went to gruesome lengths to do so, Johnson said.

It was more than would have been needed to dispose of the body, and reveals his state of mind, weighing heavily against him.

She had no prior connection to them, and simply enjoyed Boswell's company and believed she was going on a date.

"She was completely harmless and her murder completely unnecessary."

One mitigating circumstance would be if Loofe had participated in the act which led to her death.

As we heard Trail say earlier, Loofe was not part of any kind of group sex with he and Boswell.

Johnson said the evidence also doesn't match up with Trail's earlier assertion that Loofe was killed accidentally. That mitigating circumstance doesn't exist, the panel found.

Johnson also said Trail has a criminal history dating back to 1983, but said he was not experiencing any kind of "extreme mental disturbance" during the time of the murder.

For non-statutory mitigating factors, Johnson says Trail grew up in a troubled household. His mom was 17 when he was born and he had a 2-year-old brother. When he was 2, his mom sent he and his brother to live with their grandparents.

Trail later moved back in with his mother and her new husband, who abused him. He would stay with his grandparents as much as he could until his grandmother died, then he went back to live with his mother. He skipped school often and stole cars.

He later entered foster care, but ran away often from his foster family, and then was put into a facility. After unsuccessful attempts to escape, he was moved to a maximum security facility, where he dropped out in 10th grade.

Trail spent time in prison (83-89) on a robbery charge. When he got out, he continued to get in trouble on a slew of theft-related offenses, and did time again for having a gun, and later after a barfight. He was charged with rape in 2004, but did time for a lesser charge.

During that prison stint, he was stabbed. Johnson said he later married a jailer he had met as an inmate, but they divorced after he had an affair with a coworker.

Trail did time in Nebraska, Missouri and Iowa, mostly for fraud involving bad checks. He met Boswell in 2016, and she joined him in con jobs, which led them to Wilber in 2017.

The standard for non-statutory mitigating circumstances are based on Erik Vela and Jose Sandoval, who are on death row for a murderous bank robbery in Norfolk.

Yup same thoughts. I think we got a little bit more of the truth today, but only for his own benefit of trying to protect BB.

"On Wednesday, he was sentenced to death after telling a court in Omaha that he 'couldn't care less' what kind of punishment he received.

He did not apologize to the victim's family, saying it would be an 'insult' to do so. He also repeated earlier claims that Boswell is innocent and didn't take part in the killing.

She has not yet been sentenced but she also faces the death penalty and could become Nebraska's first female death row inmate.

During his 2019 trial, three women testified about how Trail would lure women into his sex cult via the dating app , then convince them he was a vampire who could fly and read minds.

The women said they were all recruited via Boswell's Tinder account between July and November 2017.

They described how Trail made them call him 'daddy' and how they engaged in group sex with him, Boswell and other women.

The women said Trail also referred to Boswell as the 'queen witch'.

One woman testified that Trail had a group of witches and that for her to become one of them she had to kill someone and 'take their last breath', the Omaha Herald reports.

She would gain more 'powers' if the person killed was tortured for hours beforehand, the woman testified."
 
Here's a bit more about capital punishment in Nebraska. I suspect at Aubrey Trail's age this verdict is mostly symbolic and that Trail will die of old age.

"In 2015, the state legislature voted to repeal the death penalty, overriding governor Pete Ricketts' veto. However, a petition drive secured enough signatures to suspend the repeal until a public vote. In the November 2016 general election, voters rejected the repeal measure, preserving capital punishment in the state.

Nebraska currently has 12 inmates on death row.

On August 14, 2018, Nebraska executed Carey Dean Moore, who was convicted of murder, in what was the state's first execution in 21 years and the first by lethal injection. This execution was also notable for being the first in the United States performed using fentanyl, the powerful painkiller at the root of the country's opioid epidemic."
