Monday, July 8th:
*Trial continues (Day 12) (@ 9am CT) - NE - Sydney Loofe (24) (Nov. 15, 2017, Lincoln; found Dec. 4 & 5, 2017 in Edgar, east of Clay Center) – only for *Aubrey C. Trail (51) charged & indicted (6/11/18) & arraigned (7/13/18) with 1st degree murder & improper disposal of human remains (plead guilty to this charge 6/18/19) & charged (3/1/19) with conspiracy to commit murder. Plead not guilty. No bond. DA will seek DP.
Trial started 6/17/19 with jury selection. Trial started on 6/18/19 & runs thru 7/8/19. Jurors: 7 women & 5 men, with 3 women alternates. One juror was excused for family emergency on 6/28/19 (no gender available). Jurors could be 8 women & 4 men. Now 2 women alternates.

Found Deceased - NE - Sydney Loofe, 24, Lincoln, 15 Nov 2017 - #3

7/1/19 Day 9: Trail is not in court this morning. State witnesses: FBI Special Agent Mike Maseth continues testifying. Woman #1 (A.H.) (one of Trail's "witches"). Trial continues on 7/2.
7/2/19 Day 10: Trail is not in court this morning. State witnesses: Woman #1 (A.H.) finishes testifying (left the group in Sept. 2017). Woman #2 (A.G.) (one of the witches). Woman #3 (K.B.) (one of the witches). All three women said they were recruited to the group through Boswell's Tinder account between July and November of 2017. Trial continues on 7/3.
7/3/19 Day 11: Trail not in court today. State witnesses: Pam Shay, works at Boarders Inn in Grand Island. There is video surveillance of Boswell & one of the witness’ yesterday checking into the hotel on November 19th. Ayla Frerichs, General Manager of La Quinta in Kearney. Boswell, Trail & another witness checked into the hotel on Nov. 22nd. Prosecutors showed video of Boswell checking in at the front desk & shows Boswell & Trail unpacking their car to check in that day. Trail was seen walking into the hotel with a cane for disguise. Chris Hamblin, Casino Manager at Ameristar in Council Bluffs. He says he received a request from The Division of Criminal Investigation, (DCI) to see if Boswell checked in. Surveillance shows Boswell checking into the casino around 5:30 PM - the weekend of Nov. 17. About 20 minutes later Trail & one of yesterday’s witness’ checking into the casino. Trail brings the witness to Boswell at a slot machine - the three leave the casino. FBI special agent Mike Maseth (presented the jury with 12 pages of a Tinder conversation between Loofe & Boswell). Trial continues on Monday, 7/8.

Pathologist Dr. Michelle Elieff is the first witness to take the stand.


She claims she has done around 3,500 autopsies.


Elieff did the autopsy for Loofe’s body on Dec. 7, 2017.

FBI contacted Elieff to do this autopsy. Elieff requested an x-ray done for Loofe’s body.


Elieff says Loofe’s body was received in several, sealed body bags.


13 body parts were recovered in 6 body bag containers.

Elieff describes to the jury what evidence she found while examining Loofe’s body.


She describes her head, neck, arms, legs and pelvis (& more)...Elief said there was not a lot of blood found in Loofe’s body.

First evidence: Elieff said she looked at Loofe’s head.


She noticed some discoloration and dots of red on her forehead from hemorrhages.


Loofe was recovered in a field - Elieff said here was corn and debris found on her.

Elieff said inside of Loofe’s throat/mouth - inside of her throat were gone and you can see right into the roof of her mouth.


There was no blood vessels or soft tissues found.


Elieff said it did not seem to be from animals.

. Elieff noticed small scratches and bruises on Loofe’s upper back.


“The red/tan marks were concerning for a cutting type - to cut up the body after death.”

Elieff said there was no scab formations. She said every autopsy she has done, every person is different.


Elieff said there were signs of strangulation in the neck - she did not see any signs of a sharp object being used.

Elieff continues to talk about bruises/cuts found on Loofe’s wrists.


She said she believed it was from restraints.

There was no blood available for Elieff to perform a toxicology - instead they used urine and brain.


Found a little bit of anti-anxiety medication. No drugs of abuse were found in Loofe’s system.


Cause of death: Loofe died of homicidal means including strangulation.

Elieff said the amount of tissue missing from the neck was concerning.


She asked if there were any signs of removal using tools - results indicated there was not tools used to remove them.

In previous testimony, we’ve heard Trail was involved in a sexual fantasy act with two women - choking Loofe with an extension cord during sex.


Elief said “Strangulation is a process; unconsciousness can happen within 10 seconds. It usually takes minutes to result in death.”

Defense attorney’s ask Elieff if the bruises on her wrists could be from sex - she said it could have been.


“We’re missing a heart, a lung...is there anything you can determine that would be ‘ritualistic’ about this?”


Elieff: “Not specifically, no”

Elieff said based on the results of the autopsy - the cause of death could not be determined as intentional or accidental.


Defense attorney’s clarify with Elieff that “a homicidal death” does not distinguish between an accident or intentional.

Am I the only one who is confused? There seems to be contradictory statements by Elief?

Thanks Jenni. I think she also indicated it didn't appear to be from animal activity.

JMO, at least not from the four-legged variety of animal. I wonder if AT and BB thought this would make determining the cause of death more difficult?

Next witness: Forensic Anthropologist, Steven Symes.


Symes said he usually writes a report before he looks at the criminal background of the case.

. I am not going to go over every single cut he examined on Loofe's body but to give you an idea, Symes said he found 14 cuts to look over.


He also agreed there was not a strong indication that the lack of tissue on Loofe's body was from animals.

Symes explains there were many cuts on Loofe's body that had "false starts" - meaning the cut had started but did not make it's way through the bone.


He says the bones that were cut into seemed to be done by some kind of a saw.

I know this is demented, but i have a scientific mind and morbid curiousity. I probably cpuld have gone into forensics, but i wish i could see the photos. I feel that i would have a better grasp than the way eilief described. I dont completely inderstand about the throat inside of the mouth being gone. Did they cut out her tongue and maybe ripped it out and it pulled connective tissue? How would animals get to it in bags, were they torn and showing animal activity. I am sure if an animal or animals went at it they would go for more than internal organs. Wouldnt there be animal bite marks? Wouldnt they be interested in bone as well? Wouldnt they should cut marks even from a knife showing they were removed by cutting? I feel that maybe if he did slit her jugular to drain blood it would have left signs? So many questions.

JMO, Mr. Loofe has shown himself to be a real gentleman, as well as a very good father and husband. He's taken his place in the courtroom, every single day, and he is hearing it all, and on the toughest days, like today, he's still there, and he's sparing his wife and other children from having to listen to it.

I don't know how he can bear it, but he is. He's determined there will be justice for his daughter, Sydney. I imagine the jury has taken notice of this as well.

Justice for Sydney and prayers for her family.

My husband and I were just talking about this. There's no way I could go to any of it. There can't possibly be anything more devastating than losing your child, especially in this way. I'm glad that her mom doesn't feel like she needs to be there to hear and see every detail. It won't change anything, and would only bring her even more suffering, if that's even possible.
