One of four suspects being tried in absentia for the 2014 downing of Malaysia Airlines Flight 17 has denied any involvement with firing or supplying the missile used in its destruction, a lawyer said in court on Monday.

After an international investigation lasting nearly six years, four defendants went on trial in absentia in March, of whom only Oleg Pulatov has instructed a lawyer to defend him.

Australian government launches legal action against Russia

Netherlands also.

Australia and the Netherlands have launched legal proceedings against Russia through the International Civil Aviation Organization for the downing of Malaysia Airlines flight MH17.

The legal action could compel Russia to take part in stalled negotiations with the two countries, and could also result in it being penalised by the United Nations-linked organisation which is responsible for the administration of international aviation law.

Australia and the Netherlands have been seeking compensation and an apology from the Russian Federation for the MH17 disaster that saw 298 people, including 38 Australians, killed when it was shot down over Ukraine in 2014.

However, Russia, which has denied involvement despite the findings of an international investigation, unilaterally withdrew from negotiations with the two countries in October 2020.

''SCHIPHOL, Netherlands (AP) — A Dutch court has convicted two Russians and a Ukrainian of the murders of 298 people who died in the 2014 downing of Malaysia Airlines flight MH17 over Ukraine. One Russian was acquitted for lack of evidence.

Presiding Judge Hendrik Steenhuis said that evidence presented by prosecutors at a trial that lasted more than two years proved that the Boeing 777 flying from Amsterdam to Kuala Lumpur was brought down by a Buk missile fired by pro-Moscow Ukrainian rebels on July 17, 2014.

None of the defendants appeared for the trial that began in March 2020 and if they are convicted, it’s unlikely they will serve any sentence anytime soon. Prosecutors had sought life sentences for all four. Prosecutors and the suspects have two weeks to file an appeal.''

On 17 July it will be 10 years since flight MH17 crashed in eastern Ukraine. All 298 people on board, including 196 Dutch nationals, died. Dozens of staff members of the Ministry of Foreign Affairs were involved in dealing with the aftermath of the disaster. Some helped with the recovery of the victims. Others were involved in the Netherlands’ efforts to achieve justice, in their capacity as diplomats. The disaster will always stay with them: ‘It got under my skin.’

When the report came in, on that rather cloudy summer’s day on 17 July 2014, the seriousness of the situation was immediately clear. A civilian aircraft that had departed from Schiphol airport had crashed in eastern Ukraine. The wreckage had landed in wheat fields near the village of Hrabove, where heavy fighting was going on between the Ukrainian army and pro-Russian separatists. ‘It was a minefield, in more ways than one,’ says Michael Pistecky, who had started work as a Ukraine policy officer in May 2014.

Crisis teams

Crisis teams convened that same day, both at the Ministry of Foreign Affairs and at the embassy in Kyiv, the latter led by chargé d’affaires ad interim Gerrie Willems. Robert Dresen, team leader for Russia and Central Asia at the time, helped the crisis team in The Hague monitor political developments in the region. Every few hours, the team issued a bulletin with updates.

‘It was clear from the start that this was a crisis that would require a lot of stamina,’ says Mr Dresen. ‘On the one hand we had to respond quickly, for instance in terms of dealing with the separatists in the area, so that the bodies of the victims could be repatriated. On the other hand, we had to be mindful of the diplomatic consequences of such contacts in the longer term.’

‘When flight MH17 crashed, the war in Ukraine suddenly reached the Netherlands.'
