According to two physicians who spoke with the Globe, both of whom specialize in cases of child abuse or neglect, the details outlined in the autopsy report paint a particularly grim picture. Though neither is involved with the case or privy to case files, both described the autopsy findings to be extreme, even within the realm of neglect cases.

“This is not like an everyday thing,” said Dr. Suzanne Haney, a Nebraska-based child abuse pediatrician who serves as the chair of the American Academy of Pediatrics’ Council on Child Abuse and Neglect. “This extreme of a case, fortunately, is very rare.”

Both doctors described the bedsores, in particular, as highly irregular in a developmentally normal child. The painful, circular lesions are almost never seen in young, physically mobile patients, leading them to believe that Elijah could have been restrained in some way prior to his death.

“Skin breakdown or bedsores is not something you’d ever see in a healthy 5-year-old,” said Newton. “That, to me, speaks to being tied down . . . or [being] so weak or malnourished that he was unable to move at the end of his life.”

Added Haney, “If you combine malnourishment and pressure ulcers, I’m thinking he was either restrained or his malnourishment was to the point where . . . he was unconscious or semiconscious for a period of time.”

The last days of a 5-year-old: Medical experts say Elijah Lewis appears to have been ‘tortured’ - The Boston Globe

The mother of a Merrimack boy whose body was found buried in a Massachusetts state park last year might stay behind bars for a while longer.

Danielle Dauphinais and her boyfriend, Joseph Stapf, are charged with witness tampering and child endangerment.

Prosecutors have filed their second motion to extend the time allowed for Dauphinais' indictment.

An autopsy shows that her son, Elijah Lewis, had injuries to his face and scalp and had fentanyl in his system when he died.

No one has been charged directly with his death.

Elijah Lewis case: Prosecutors seek extension for indictment

WTH?!!! Color me confused on why they haven't been charged yet, or would consider releasing that . They fled once, not a snowball's chance she won't do it again.

Joseph Stapf will plead guilty to manslaughter, second-degree assault, falsifying physical evidence and witness tampering and faces a sentence of 22 to 45 years. A plea-and-sentencing hearing for Stapf has been scheduled for January.

"Since he is pleading guilty to both manslaughter and second-degree assault, I would expect that there would have been more than one incident that they have evidence of," she said.

Dauphinais remains in custody. Stapf's plea deal makes mention of a memorandum of agreement, but there's no indication of what's in it. But LaFrance said it's likely he will cooperate with prosecutors.

"It appears it would be some type of cooperation, perhaps in the case against the co-defendant," she said. "That would typically be part of any type of agreement."

Stapf would have no doubt about what he is being asked to do under that agreement, and if the agreement does call for him to testify, he would have to testify truthfully, according to LaFrance.

A plea-and-sentencing hearing for Stapf was scheduled for Jan. 4, 2023. The fully negotiated plea carries a sentence of 22 to 45 years in prison,

MANCHESTER, N.H. —
The mother of a Merrimack boy killed last year could be called to testify in the firearms trial of Adam Montgomery next month.

News 9 Investigates has learned that Danielle Dauphinais is on the witness list in the trial of the father of Harmony Montgomery, a girl who was reported missing and who police believe was killed. Adam Montgomery has not been charged in connection with her disappearance or death.

Dauphinais has been held at the Valley Street Jail since she was arrested a year ago and charged with murder in connection with the death of her son, Elijah Lewis. Adam and Kayla Montgomery are also being held in the jail on charges unrelated to Harmony's disappearance.

Patricia LaFrance, a former county attorney who is not involved in any of the cases, said it's likely Kayla Montgomery and Dauphinais were on the same cell block.

Dauphinais was arrested about a year ago in connection with her son's death. She was indicted in April and plans to plead not guilty. LaFrance said it's possible that her role as a witness in Adam Montgomery's trial indicates she's trying to get a deal.

"A defense attorney would not be doing their job if they were not trying to get some consideration for their client's cooperation," LaFrance said. "You see that a lot of times."

LaFrance said it's likely Harmony's stepmother, Kayla Montgomery, and Dauphinais were on the same cell block at times over the past year, but how prosecutors can use Dauphinais' testimony in a firearms trial for a man she is not connected to would be limited.

In closing, the state said any further delay will affect the rights of the victim's family and the interests of justice.

No kidding, I could see if the trial were next month, but it’s seven months away and the defense is asking for for a four month delay on top of that? Ridiculous!!!!

Investigators said there were no photos of Elijah in the home, and a trash bag of boys’ toddler clothing was found. Police believed there was evidence Elijah no longer lived at the home and had been harmed, which sparked the manhunt for Duaphinais and Stapf.

It is believed Elijah died between Sept. 21 and Sept. 24, 2021. An autopsy revealed he died of violence and neglect and that his death was a homicide. Officials said Elijah suffered facial and scalp injuries, acute fentanyl intoxication, malnourishment and pressure ulcers.

During Stapf’s 2022 sentencing hearing, it was learned Elijah endured systemic abuse while living with his mother and Stapf. A series of disturbing text messages between Dauphinais and Stapf in which they talked about abusing Elijah and not feeding him were read at the hearing.

At one point, Stapf texted Dauphinais that they needed to feed Elijah and let him sleep so he would look better so they could go out and do things, but Dauphinais responded that she didn't want to do that, according to prosecutors.

"He said he wants food and he wants me to stop starving him because it's not nice," Assistant Attorney General Bethany Durand said, reading one of the texts at the hearing.

Prosecutors said at the hearing that as the abuse went on, Stapf at one point began urging Dauphinais to stop what he referred to as "torture," but she refused.

“(W)e believe that unsealing the arrest affidavit at this point in the prosecution of the case would be consistent with other criminal prosecutions where the Office of the Attorney General has sought to unseal previously sealed Probable Cause Statements specifically noting that because the defendant had been ‘indicted and the indictments have been made public, there is no further need for the items above to remain sealed,’” Sakowich wrote.
