I am not clear on all that happened. Is the judge allowing any of the statements SM gave to the police early on?

The judge didn't really say that I heard. The way I took it was inferred by the Prosecutor that the statements have to come through the witness, such as Kathryn (Kat).

For as much talking as the judge seems to do explanatory-wise, I seem to miss all the decisions based on motions. lol

Seth Mazzaglia, 31, is charged with first-degree murder in the death of Lizzi Marriott. Friends of Marriott's packed the courtroom and heard graphic, troubling and conflicting stories of how she died.

In opening statements, prosecutors said Mazzaglia choked Marriott with a rope and raped her when she denied his sexual advances. But defense attorneys said it was Mazzaglia's girlfriend, Kat McDonough, who caused Marriott's death.

Good morning Jewels53, Popsicle, and 6 guests. I finished with the Julie Schenecker trial a couple of weeks ago and now I'm pulling up a seat here. It promises to be a florid trial.

This judge has a radio voice and seems to run a tight ship.

Day 2 of the Mazzaglia Trial is about to begin. Lizzi Marriott's family is filing into the courtroom, just as many of them as yesterday so they're filling two long benches. Many of them have brought along seat
cushions! Smart move, this wood is killer after just a few minutes.

Seth Mazzaglia's High School Church advisor has been here both days, as he was during a suppression hearing two months ago. He says he's visited Seth eight times... describes him as very tired ... says he's been reading a lot of legal texts... has been exercising... When asked if his demeanor is usually as stonefaced as its been in court, he says yes. But says he is a gentle person. He is sitting directly behind Lizzi's family.

It's Diane Rebecca Hanna - 'Becky', she's a 7th grade math and science teacher from Chester.. lives with her husband and 3 children, and Lizzi lived with her back in 2012... Lizzi is her niece - her brother's daughter.

Bubbling, happy, always happy to tell stories, loving, always giving a big hug. Always had friends, went to events with family, had fun with the family. Had a good relationship with her family, would go out with her Mom on her Mom's day off in Lee and go out to lunch.

Lizzi's Dad called Aunt Becky to see if she'd let her live there, wanted to go to community college in Manchester, to be able to get into UNH... and to do it cost effectively.

Lizzi was very helpful, settled right in with 3 other teenagers, checked in with the family about her schedule.. she even wrote down her schedule for her Aunt ...

She brought friends up from Massachusetts and visited them there, but always left notes. She had a really close girlfriend, Brittany, that hung out with them in Chester. She never mentioned Kat McDonough.

Last time she saw her was Monday, October 8th... she remembers because she had forgotten she needed boots for a lab trip to the water... she was very excited.

Aunt Becky says Lizzi left her a note after, saying she'd fallen in the pond... and was sorry because the boots had gotten wet, and they were her daughter's boots. She is acknowledging the actual note shown to her by Atty Ward.

Aunt Becky had to pause to read the note, holding back tears... "the rain boots got a bit damp at the beach, very sad, had to wade out … which is a story in itself, I rinsed them thoroughly in the lab… stuff them with pape rtowels and turned them upside down to see of that would help " The juror who had been taking notes appeared to wipe away a tear.

Defense Attorney Melissa Davis is up now... asking if she had her own bedroom at the house... yes... and is showing her a photo of the room that she has identified.

Defense asked a question about Lizzi's car... bench conference followed... Atty Davis entering a photo of Lizzi's car from the back, as evidence - Aunt id'ing another photo from driver's side... now that we are in the testimony phase of the trial, the very tedious work of laying out the many puzzle pieces appears to have begun in earnest.

Up next, Nathan McNeal - lives in Portsmouth - bartender at the Music Hall. Knew Lizzi Marriott, met her thru work at Target where he was working from October 2010 to September 2012. They were co-workers and friends - a nice person who would come over and say hi, quickly got to know her.

Davis is asking about Kat McDonough... says he'd known her in high school, acknowledges she was into art, and that she had a girlfriend at the time... said he remembered when Davis asked... then that she was going out with Seth ... had been having problems at home with her family... that she was taking EMT classes... and was asked specifically if she was being forced to take the class. He said no.

Davis shows him notes from his interview from police where Nathan said Seth was always doting on her. Now talking about the fact that he and Lizzi didn't work together long at Target cause he went to Barnes and Noble, but their relationship grew after... played World of Warcraft... he describes it as a fantasy world where people hang out and have different names and characters.

When asked, Nathan says he did not know or discuss whether Kat or Lizzi were bisexual and the issue of BDSM never came up... Atty says he told police Lizzi mentioned going to Kat's apartment and that both she and Seth were really nice...and that she'd go over again.

Atty Davis asking if Nathan had texted Kat to ask if she'd seen Lizzi... the next day... shows him a photo of the texts with Kat ... and she reads it... "hey had you heard from Lizzi lately, did she come over Tuesday night?... her response.. she was supposed to and never showed up... Who is this I'm worried as well. Sorry its Nate.. have you talked to police? she said yes... Kat... please tell me you are ignorant of all this", she didn't reply? He says no.

State's Atty Ward... going back over the issue of Brittany's jealousy of his relationship with Lizzi ... he said he'd had issues with jealousies in the past and wanted to make sure it was okay. How serious was it? He says Lizzi and Brittany seemed very serious, he and Lizzi would talk about her online all the time.

Says he became aware Lizzi was missing was when a State Trooper came to his door on Thursday... it blew his mind... that's why he texted Kat.
