Borndem :hug:When I first heard it I thought it was coming from one of the five or six screens I have shrunk on this desktop. Then it hit me. Someone was being laid to rest across the street. And I thought of Lizzi and how that was just one more thing those animals denied her.

I never heard the pipes before. Yeah sure on TV but this was sadder. One person playing. So alone.

The sadness tore my heart Borndem and I said a prayer for that person and our Lizzi. :(

And I will say that I don't think it was a mere coincidence that those pipes were near enuff for you to hear them.

And Lizzi is flying high and she has all the sea treasures that Heaven has to offer now. For a long, long, long, long time.

Peace to her good father and her amazing and loving family, and to her partner.

When Kat gets out and on parole is she able to come and go as she pleases? Venture outside of NH?

In most states, the probationee (or whatever she will be called) has to ask permission & give a good reason for doing so. If granted, the probation duty and office of the state to which she moves will assume responsibility if it is for an extended period of time. Reciprocity of the states.
 
So now that we have a conviction of this killer and we have heard the state's case and evidence...do web sleuthers think that the state did the right thing in giving Kat the immunity as unjust as it seems? I'm on the fence...wondering if two trials could have gotten two convictions?

As much as I hate it, yes I think it was the right thing to do.

Although I didn't believe her entirely, I did believe parts of her testimony. And that coupled with Dr. Duval's testimony and Ward's excellent closing is what sealed the deal IMO.

I also wonder how much input (if any) Lizzi's family had in the decision to just go after one and have a stronger case?

Just my thoughts, too, Xara -- I think KM's testimony (I hate to call it that) was very important and necessary. Also I feel that the jurors prolly felt as we did about it -- a salad bowl of truths, half-truths & lies.

I would like to know how she brokered a deal such as she got. Her prison time is miniscule, but as I've said so often, the probation time is looonnnggg, hee-hee-hee. And when (not if) she fails, I hope we will hear all about it.

Now I, too, am curious -- since you mentioned it -- if the Marriott family did have input to/was asked about KM's testimony being traded for short jail time. Will we ever know?
 
Im not sure, but there are two eye witnesses, Paul and Roberta, seeing LM deceased in the apt. with bags on her head. That would be enough for me to believe murder. I think those too sealed the deal for this case. Just my thoughts. KM was not credible but confirmed she was there. R & G were off but its confirmed they were there and saw the same thing.

I agree with you. They didn't need to give Kat immunity to convict Seth. She could have been charged in the murder, and still be ordered to testify. Paul and Roberta (seeing the dead body) was enough for me, because I didn't believe anything Kat said.

What a relief!


Damn Straight! Nice and Neat. Congrats to the prosecution even though they had to sacrifice measures, unfortunate measures must be done to maximize the odds. See my previous post on immense frustration concerning why they really had to do it(Grr). Pleasant feeling as I know the Marriot's have some semblance of peace knowing SM will endure punishment- in this case- spending all of "time" in a cage.
As for Barth, and I don't mean to "nickel and dime you" counsel, this case , from the defense;s perspective could have been beaten. The fact it was not reveals perhaps there is additional education for you, and perhaps the arrogance, and brash demeanor should be tucked away until it is earned.


To the Dream Team - always sad when these days arrive, knowing we will never be together again... although maybe for a small case over in AZ... I hope sooner. Great work - the impact, and achievement demonstrated on this thread by everyone has marked new analytical and innovative ground. That's why you are the Dream Team (*we - smile).

EPILOGUE
I always get a kick out of defendents watching their attorney navigate closing argument. On this day, SM's eyes twinkled... the tapping offered up an accelerated tempo, with a few new staccato beats introduced, symbolizing flashes of happiness. His lips puckered, and from time to time gapped open one half inch-the usual drool absent. As he marveled at his attorney, who stood near the jury to the right, his head cocked to the left -yielding its greatest action to date, without regression. His chin sloped upward, proud, as he followed his counsel's every word, every step. The staccato beat of his tapping feat ascended to marcato at certain dramatic moments early in the close, his entire body tremored as one unit with each set of stringed together taps. Suddenly, brief concern dawned regarding the chocolate bar in his pocket, and the likelihood of it melting, comforting thoughts return as he mentally pulls up a visual of the small satchel of jelly beans he secured in his sock... he remains focused on the warm candy bar, though, and loses complete track of what his attorney is saying, preferring the thought of fresh nougat blended with soft almonds under a warm coating of dark chocolate. Now he has returned to his usual tapping tempo, unaware of what his attorney is remarking on... he closes his eyes and pictures himself dancing in Willy Wonka's Chocolate Factory, as he skips along the tootsie rool path, his ankle gets caught between a pair of jolly rancher stones - it snaps fast -and he collapses into the thick marshmallow swamp. Similar to quicksand, the marchmalow swamp is for scooping, not swimming. Paralyzed, SM descends downward and the thick, white marshmallow goo slowly takes him under.

Sadly, it was a necessary evil, to put that monster away...

I appreciate the effort and service of the jurors, the state's attorneys, law enforcement, all of the witnesses and certainly Lizzie's family and friends. There is no justice here, imvho, but I hope Lizzie will be returned to her family at some point.

As for Kat, well I suspect she will be popping up through out her life because she seems pretty soulless. I don't know if that kind of broken can be fixed tbh.

:blowkiss: to the sleuthers here who kept a vigil for Lizzie. The devotion shown is awesome to behold.

yep! I think they did the right thing, and I'm in the minority who believes that her story is essentially true.

Thanks Snoopy for that article, always good to hear from Jurors. I am glad they kept their statements short, and didn't talk about other juror's feeling.

I agree SM did not show any remorse of any kind. Now we will have to wait and see if he says anything at sentencing. IMO it might just be best if he doesn't say a word, what good will it do now.

KM's attorney announced her intention to plead guilty on July 24, 2013 and her court date was two days later, on July 26, 2013.

On the day of her sentencing/plea, Bob Marriott posted on Facebook, "I am still heartbroken but we have taken one more step down the path. Is it fair – not even close, am I satisfied – nothing could. I do, however, accept that compromises have to be made in our best, but imperfect system. I am so thankful to the family and friends who continue to support us."

His quote would suggest to me that LM's family did have some input, or at least gave the State their blessing because they felt it was necessary to get a conviction against SM.
 
:twocents::twocents: Regarding KM's deal of the century (my opinion!), an undergrad classmate of mine who's a well connected Esquire in NH stated that without the body, getting her to turn "State's evidence" was regarded as a necessity. The "eye witness" bolstered the postmortem witnesses and forced the defense to attack & deflect THREE reporting parties.


The family was aware of the "deal" & circumstances for it.

Skigirl you are not alone in your feelings about Kat and testifying. I feel it was totally necessary for the state to get to the truth and the only way was through Kat. I agree with you it is not a popular decision, but it had to be done.

IMO I think Barth had everyone so confused in crossing Kat that even I was lost. The prosecution made it seem so much clearer and understandable.

so juror in interview said they did take Kat's testimony as mostly true given she had so much to lose with the immunity deal. That was sort of my reaction too...I mean why lie...she could tell the truth and nothing would happen. The state's decision was no doubt the right one.
 
OK....so where is everyone headed, thread/trial wise?
:sigh: still following Hulsey but nothing until the 14th for that one and even with that no stream.
