Burch gets life in prison without parole for murder of Nicole VanderHeyden

"...Zakowski called VanderHeyden's murder the most brutal in Brown County's history.

"Mr. Burch, you have to die in prison," he said.

Family members and others who spoke during the sentencing hearing urged Zakowski to make sure Burch would not be released from prison.

Brown County District Attorney David Lasee read a statement from Doug Detrie, who Burch claimed had killed VanderHeyden.

Detrie, VanderHeyden's fiance and the father of her youngest child, condemned Burch for murdering VanderHeyden and trying to pin blame on him.

“George Burch is a monster and should rot in prison the rest of his life,” he wrote."

Trial set for former suspect in VanderHeyden murder on accusation of endangering her sister

"GREEN BAY — Nicole VanderHeyden’s live-in boyfriend, who was once considered a suspect in her murder, is headed to trial for endangering her sister’s safety.

Douglass R. Detrie, 36, is scheduled for trial Aug. 15 before Brown County Judge William Atkinson on felony charges of second-degree reckless endangering safety and false imprisonment. Both offenses, charged as domestic abuse violations, involve VanderHeyden’s sister.

Defense lawyer Jason Luczak on Tuesday asked for a small delay in the trial due to concerns about an upcoming episode of the nationally broadcast TV show Dateline about VanderHeyden’s murder....

VanderHeyden’s sister told police she had been staying with Detrie in his Ledgeview home since her sister's May 21, 2016, murder to help care for Vanderheyden’s child.

In February 2017, Meyer and Detrie went to a birthday party at an Allouez tavern and were driving to another place when Detrie touched her leg in a sexual manner, the complaint says. Meyer told him, “please don’t,” and Detrie got angry.

He drove at high speeds and refused her entreaties to stop and let her out, the complaint says. At one point, he ran a stop light and only stopped and let her out when she started kicking his windshield, the complaint says...."

Dateline to air episode on George Burch trial Friday

"GREEN BAY, Wis. - Friday, Dateline will run a two hour episode highlighting the George Burch homicide trial....

In an exclusive Dateline interview, Burch is standing by his story.

"I'll say this to you straightforward so you understand it correctly, I have not made up any single part of this at all, in this least little bit," Burch said. "Everything I have stated is exactly what happened."...

The Dateline episode will feature interviews with those prosecutors and investigators, as well as members of VanderHeyden's family.

It runs on NBC26 at 8 p.m. Friday night."

George Burch launches first step of appeal of life sentence for Nicole VanderHeyden murder

"...George S. Burch, 40, last week filed a notice of intent to seek post-conviction relief. That means he’ll be asking Brown County Judge John Zakowski to reconsider the case that otherwise ended in his courtroom on May 7, when he sentenced Burch to life in prison without the possibility of parole.

An appeal for post-conviction relief is a required first step in the appeal process.

That Burch will be taking that step should come as no surprise to anyone who has been following the case. For one thing, it was just Friday that Burch, interviewed on NBC’s Dateline, maintained his innocence.

“Never in a million years — I’ll never confess to something I didn’t do,” Burch told reporter Andrea Canning on the program Friday night. “I’ll go to my death bed.”

Defense and prosecution lawyers and even Zakowski himself, during the trial, were well aware of the likelihood that the case would eventually make its way to a higher court.

That’s because of some of the pretrial decisions Zakowski had to make — some of them groundbreaking — were based on defense motions that had nothing to do directly with Burch’s guilt or innocence.

“I just need to make a good record, because we know this is going to be appealed,” Zakowski told a reporter during an intermission in the trial....

The state’s case relied heavily on technology, and technology is sure to be a main focus of the appeals process...."

"A document obtained by Action 2 News shows family members and a Crime Victim Compensation fund have requested $269,000.86 from George Burch.

VanderHeyden's mother requested $6,223 for wage loss and the cost of her daughter's headstone and engraving.

Siblings asked for a total of $3664.35 for wage loss.

Crime Victim Compensation requested $4292.78 for wages, funeral and burial costs, and counseling.

The largest request comes from VanderHeyden's boyfriend, Douglass Detrie. Detrie is asking for $254,820.73 for funeral expenses, wage loss, counseling, child care, mileage, attorney fees and loss of property.

The next step is to ask for a restitution hearing before the Brown County court commissioner...."

Detrie enters agreement to get charges dismissed

"BROWN COUNTY, Wis. (WBAY) - The former boyfriend of a slain Ledgeview woman has asked for the court to dismiss charges as part of an agreement in a domestic violence case.

Douglass Detrie appeared in Brown County court Friday. A deferred judgment agreement was filed for Counts 1 and 2--2nd Degree Recklessly Endangering Safety and False Imprisonment.

In Wisconsin, a deferred judgment agreement means the court agrees to dismiss charges as long as a defendant meets the expectations of the agreement or conditions of probation...

Prosecutor Toney said he took into consideration Detrie's cooperation in the Burch case and time served when making his recommendation.
Another hearing on the matter is scheduled for Oct. 21. Detrie's bond continues."

"GREEN BAY - The gesture likely will be little more than symbolic, but Nicole VanderHeyden’s killer got an additional penalty tacked onto the life prison term imposed against him in May: $269,000 in restitution.

That’s $254,820 that George S. Burch must pay to Douglass Detrie, VanderHeyden’s live-in boyfriend, who still must raise the child he and she had had together before her May 21, 2016, murder.

The restitution also includes $9,887 to VanderHeyden’s mother, brother and sister, and $4,292 to the state Crime Victim Compensation Fund, which compensates crime victims all over the state...."

Court orders Burch to pay restitution to Nicole VanderHeyden's family

"GREEN BAY, Wis. (WBAY) - A court commissioner has ordered convicted killer George Burch to pay restitution to family members of slain Ledgeview mother Nicole VanderHeyden.

A hearing was held in Brown County Court Monday afternoon for a restitution hearing....

During Monday's hearing, Burch's attorney said his client makes about $8 per month and asked the court to take that into consideration. The court said the defense would need to provide a financial statement to prove it.

"Mr. Burch still maintains his innocence, he maintains this was a wrongful conviction in this case, he is actively appealing this decision," said defense attorney Scott Stebbins. "However, as it stands, we acknowledge there is a conviction in place, and at least while that conviction stands statutorily, these victims are entitled to restitution pursuant to that conviction."

The court, without proof of his inability to pay, ordered Burch to pay the following restitution requests:

VanderHeyden's mother requested $6,223 for wage loss and the cost of her daughter's headstone and engraving.

Siblings asked for a total of $3664.35 for wage loss.

Crime Victim Compensation requested $4292.78 for wages, funeral and burial costs, and counseling.

The court still has to decide on a restitution request from VanderHeyden's boyfriend, Douglass Detrie. Detrie, who is the father of one of VanderHeyden's children, is asking for $254,820.73 for funeral expenses, wage loss, counseling, child care, mileage, attorney fees and loss of property. Detrie's hearing is scheduled for January.

The court will also at that time consider Burch's financial ability to pay restitution...."

Burch attorney granted extension to file appeal

"BROWN COUNTY, Wis. (WBAY) - The attorney for convicted killer George Burch has been granted more time to file her client's official notice of appeal.

Attorney Ana L. Babcock filed a motion with the Court of Appeals District III on Dec. 27, asking the court to give her until March 4 to file.

The court granted the motion and gave Babcock until March 4 to file the post-conviction motion.

In a document obtained by Action 2 News, Babcock lists a number of reasons why she asked for an extension. She says the materials in the case are "voluminous" and transcripts were delayed.

She says she has spent more than 125 hours on the case and she believes she'll need another 200 hours to complete the review.

Babcock also has to prepare for Burch's restitution hearing on Jan. 7....

A court has ordered Burch to pay restitution to Nicole VanderHeyden's family members.

A Jan. 7 restitution hearing will decide on possible payment to VanderHeyden's boyfriend, Douglass Detrie..."

Court hears arguments on murder victim's boyfriend request for restitution (with clip)

"BROWN COUNTY, Wis. (WBAY) - A court commissioner listened to testimony Monday on whether a convicted killer should have to pay restitution to the victim's boyfriend....

Douglass Detrie, the father of VanderHeyden's youngest child, is asking the court to grant his request for $349,046.74 in restitution from Burch.

Burch's attorney argues Detrie was not a victim and therefore shouldn't receive restitution.

The court commissioner made Detrie go line-by-line through his restitution request to explain the amounts he's asking for.

A document obtained by Action 2 News breaks down the request.

Detrie is asking for:

$8,500 for funeral expenses
$40,000 for childcare, mileage and lost business income
$20,333 in lost salary and commissions
$8,095 for counseling costs
$124,459.80 for damages
$14,505.36 for items that were taken as evidence
$133,153.08 for legal expenses...

"There has not been sufficient proof to show evidence that he is actually out these dollar amounts," defense attorney Scott Stebbins argued. "I emphasized one item on the list to show how potentially unreliable these requests are Detrie prepared himself. He evaluated based on his own opinion. I haven't heard enough hear today, in receipts or other testimony, to document this is what he is actually out."

"What we are talking about is expenses Mr. Detrie had to incur. He did not sign up for this. This came out of the blue. He was taken into custody. Through great efforts, he was released. To say he has been put through the wringer is an understatement," Detrie's attorney, Raymond Dall'osto, said.

The court commissioner said he will review the case law and the documents submitted for Monday's restitution hearing. He has 30 days to make a recommendation to the Judge John Zakowski, who can approve or deny it.

Detrie is not the only one who's requested restitution from Burch. In November, the judge ordered Burch to pay more than $10,000 in restitution to Vanderheyden's immediate family....

The court previously ordered Burch to pay restitution to VanderHeyden's family and a crime victim's fund.

"....Judge Zakowski noted that Burch is serving life in prison and lacks financial resources or income, so he's leaving it to the state Department of Corrections to decide how Burch will pay the restitution.

"Trial counsel was originally appointed by the State Public Defender and the financial circumstances of George S. Burch have not materially improved since the date of such appointment and the initial determination of eligibility," reads the motion for post conviction relief filed March 26.

This filing is separate from Burch's appeal of his murder conviction. That case is currently in Court of Appeals District 3. His attorney has been granted several extensions to file briefs in the appeal, which are now due on June 3."

Burch’s appeal was originally due in December, but extensions were granted to March 4 and then to Monday. The new deadline is Aug. 2, court records show.

"LEDGEVIEW - The man found guilty of murder in the brutal 2016 killing of Ledgeview resident Nicole VanderHeyden has appealed the conviction.

Ana Babcock, a Green Bay lawyer representing George Burch, now 41, filed notice in Brown County Circuit Court July 31 that Burch is appealing his 2018 conviction for first-degree intentional homicide....

The filing does not spell out the grounds for the appeal. But it is expected to seek reconsideration of rulings Judge John Zakowski made involving technological evidence in the case....

Data from the devices helped convince the jury that Burch was at the murder scene and in the field where VanderHeyden’s body was found on the night she was killed.

They also were able to use the data to prove her car wasn’t used to transport her body and that her live-in boyfriend, investigators’ first suspect in the case, could not have been present at the spot where VanderHeyden's body was found. Burch had claimed that the boyfriend, Douglass Detrie, was the killer...."
