They were arrested, but the charges were dropped and they were released. At the time, prosecutors had vowed to refile charges. Now, they are each charged with one count of reckless abuse of a child resulting in death.


Also, Zuber was charged with tampering with evidence. There wasn't much more. I'm probably bumping the 10% line with what this much.

5/8/19: DA files new charges. Arraignment set for 5/17.
*David “DJ” J. Zuber (26) “father” recharged (5/8/19) with 1 count of reckless child abuse resulting in death & tampering with evidence.
Originally arrested (1/4/19) with child abuse resulting in death, tampering with evidence & conspiracy. Held without bond; Judge releases him (1/13/19). DA dismissed (1/8/19) all charges without prejudice, awaiting autopsy report.
5/8/19: DA files new charges. Nothing on court site as of 5/17/19.

Had to look this up! :)

A pretrial detention hearing in federal court is much like a bail hearing in state court. It's a hearing at which the court determines whether to detain the defendant without bail.

So - no bail for either of them, since the Judge denied both motions! Good!

Do I have that right??

OMI: 1-year-old found dead in January had meth in her system


A 1-year-old Albuquerque girl who was found dead, wrapped in two plastic bags, stuffed inside a duffel bag and buried in a backyard earlier this year had methamphetamine in her system, according to a recently released autopsy report.

However, the state Office of the Medical Investigator could not determine how the baby, Anastazia Zuber, died. Her body was found about two weeks after concerns were first raised that she might have died.

“There is no minimum amount of methamphetamine that is considered fatal,” the autopsy report states. “Any concentration has the potential to cause increases in blood pressure, heart rate, and/or body temperature and may result in seizures, arrhythmias (irregular heart beat), or sudden death. There is no indication as to the route or the circumstances by which Anastazia was exposed to methamphetamine.”

Anastazia’s parents, David Zuber, 26, and Monique Romero, 23, have been charged with child abuse resulting in death. Their cases are pending, and they were released from jail while awaiting their trials.
