''A new look at the physical evidence in 2019 helped scientific experts match the DNA to John Sauberan, whom Erie County District Attorney John J. Flynn referred to as a “drifter,” per the Buffalo News.

Matching the suspect’s DNA to Sauberan was possible because he had previously been arrested in Oregon in 2008, which required him to submit his DNA.

Sauberan reportedly lived in many places around the country, including Oregon, Florida and Georgia. At the time of Tschari’s murder, he allegedly lived near Buffalo's Elmwood Avenue and Bird Avenue, about half a mile from Tschari’s home.''

''My client denies having anything to do with her murder. He did not know this young woman,” Dell previously told the Buffalo outlet. “Our position is that DNA samples found at the murder scene 42 years ago have degraded to the point that there is not sufficient evidence to prove John was there.”

''Dell also denounced the prosecution’s portrayal of Sauberan as a “drifter” because it implied the defendant left town to avoid investigation when, according to Dell, Sauberan lived in Buffalo until 1990.''

During the trial, parties on both sides battled over how much of Sauberan’s criminal history should be introduced as evidence. Erie County Court Judge Shiela DiTullio previously prohibited prosecutors from entering his record into court, though witnesses alluded to some of Sauberan’s alleged crimes while on the stand.

Buffalo Police Detective Mary Evans testified that the defendant, who allegedly went by the name “Chief” or “Chief the Thief” (a nod to Sauberan’s Native American heritage), reportedly bragged about residential burglaries and bicycle thefts.

The trial will continue into next week. If convicted, Sauberan faces 25 years to life in state prison.''

“He was banking he would get away with murder, and for 44 years, he has,” said Erie County Assistant District Attorney Ashley Morgan in her opening statements. “Until now.”

Prosecutors rested their case on Wednesday, the defense doing the same the following day. Both sides are scheduled to deliver their closing arguments on Tuesday before the Erie County jury begins deliberations.

Investigators said Tschari was stabbed and slashed "multiple times” while in bed and is believed to have been caught by surprise when the attack began.

10/11/22 Tuesday, Trail Day 5: Closing arguments done. Jury instructions & jury started deliberations. An Erie County jury on Tuesday afternoon convicted Sauberan of killing Linda. The guilty verdict to a charge of 2nd degree murder came after about 2½ hours of deliberations. Sauberan's sentencing before County Judge Sheila DiTullio was scheduled for 12/13/22 @ 11am.

It was Feb. 8, 1978 and Buffalo was in the grips of a blizzard.

Now, 42 years later, cold case cops say they’ve busted 19-year-old Tschari’s killer.

The young woman had been stabbed multiple times in various parts of her body. She was found by her brother after the family were unable to contact her and became worried.
Tschari had lived in a cottage behind the larger home where her mother, father and brother resided.

Cops theorized she had been surprised by the killer and butchered in her bed. The only thing detectives had to go on was a witness description of her attacker, who fled in a car into the snowy night.

And the blood in the alley? It likely belonged to the murderer.''

DNA has a long memory and it paid dividends with the arrest of John M. Sauberan, who is now charged with second-degree murder. Police say his DNA matched that left at the crime scene long ago.

The 60-year-old’s DNA was in the national database as a result of a 2008 Oregon arrest, Erie County District Attorney John J. Flynn told reporters.

Cops described Sauberan as a “drifter” who moved frequently around the U.S., including Georgia and Florida.'

He’s definitely killed many more. I think I found him on the nyshistoricnewspapers.com he was arrested 1979 for unauthorized use of motor vehicle and petty larceny.

Tschari was open-minded and genuinely decent, her loved ones said Tuesday in Erie County Court, where they recounted the devastating effect of her murder and the long wait for justice that culminated with her killer’s sentencing.''


“Linda, your story has taken 44 years long to write. But, today, we have reached the final chapter. With today's sentencing, you will finally claim your justice,” Jeff Sawyer, a close friend, said in the victim impact statement he read on behalf of Tschari's family. “It took an instant to lose you, and it will take our entire lifetime to grieve the loss of you.”

''Outside the courtroom, Tschari’s family and friends hugged each other and wiped away tears. The two-dozen people who came to court to support the Tschari family included many of Sauberan’s own relatives.
“He deserves it,” Amanda Saubaren said of her estranged father’s prison sentence. “That family suffered for 44 years.”

“I hope that he finds God and apologizes to this family. That’s what I hope he does,” she said. “He doesn't have many years left. So, hopefully, he can get it right.”

Howard Tschari, Linda’s brother, and his wife, Julie, said they appreciated the support of the Sauberan family at the trial and the sentencing.''
