Judge to Defense: I'm ready to proceed wtih Huntly hearing and that's what we're going to do, you can make other arguments later. - 3 mins ago.

Defense keeps going, says these things have to be addressed to have Huntly; Ms. Mohl conceded she had convos with us regarding audibility and playability of video.

Mohl: I can't create a different format than the one that exists (five minute increments) - 1 min ago.

First witness takes the stand, town of New Windsor and Cornwall officer Stephen Bedetti - 6 mins ago.

Bedetti: a little after 7:50 p.m. on April 29, he responded to a call for kayakers overturned in Hudson River - I left station and went to Cornwall landing - when I got down there I noticed a local fire chief and a village police officer. I walked over to gazebo - looking out in river. Towards New Windsor, I could make something out in the water. - 3 mins.

Bedetti: spoke to Gaswald when she got off rescue boat; she told him:
"The male she was with went over in the water, she kind of lost sight of him, I guess because of the waves - she waited like 5 minutes before dialing 911 from time she lost sight of him. - just now.

Bedetti: I noticed - as I was talking to her - while paramedics tending her, I heard a cell phone ringing - what struck me odd was no one was reacting - I asked - I definitely heard it down by my feet - where there was a black bag and a life vest that Ms. Graswald had on.
Ms. Graswald sat up on the gurney and looked at me.

Bendetti: I decided to go to the hospital and interview her. When I got there a woman was in there talking to her, I walked in. I asked her questions again. I was informed when I was down there that she (had been) speaking to 911 operator.

Graswald told him that her phone went in the water at the time on the incident. - 1 min.

Mohl: Did you ever see the phone at the landing or later at the hospital.
Bendetti: I did not. I went to go lean down to grab the vest and again she sat up, and asked what I was doing.

Bedetti: She said the water got rough and when she went over (capsized) the phone did too.

Mohl: What was Graswald's demeanor?

Bedetti: At the landing ... calm .... very. Like you and i are talking right now. At the hospital, she seemed a little anxious to get out of there.

Someone asked whose phone was ringing in the bag. Reporter responded:
"The officer indicated it was Graswald's phone, despite her statement, but he never saw it. Just heard a ringing from where her bag and life vest were sitting."
