IANAL so I’m not going to attempt that.

I was just pointing out that it's a pretty open subjective law. I think purposefully. It's up to a DA to determine what constitutes "substantial risk" in any given scenario.

Total example; But locking a child out in 15 degree temps likely wouldn't be looked at in the same way as a 65 degree day.
 
According to these articles, Harley climbed onto the roof and entered the home through the chimney then died in the chimney when he became compressed and couldn't get enough air.

Then he left his glasses and coat on the 2nd floor of the home.
How is this possible?


It's not possible. He somehow got inside safely then decided to go up the chimney for some reason. Probably removed his coat so it would not be such a tight squeeze. Sounds like he was exploring options of how to get in and out of the house...(opinion)

Harley had a choice. It wasn’t for long, and his mother was in contact with him before, during and after.
 
I do want to say that the night they found Harley, I watched the live at the house from start to finish. I'm sure the videos are still up somewhere, and it would be hours of watching and listening. At one point it was reported that walls were being taken down, that is most likely where people are getting this sledgehammer idea. The fire dept was there and were most likely designated to perform that task . Once that was done, I believe a couple of ambulances came and then vehicles started leaving. The chief then went to the Dillys,and I'm assuming that is when they notified them that Harley had been found, after that an ambulance went to the Dillys, again assuming that Mom was beyond distraught. All my opinion and what I remember watching all night, which turned out to be the night Harley was found.

If I had to guess, he threw his glasses down first, coat second. The glasses easily made it onto the floor of the room. The coat was PUSHED by Harley through the flu so it could be observed by law enforcement- it doesn’t mean it made it all the way to the floor. I took it to mean it was VISIBLE to them when looking at the flu - I would guess Law enforcement pulled it the rest of the way out and hung it on that closet door

Right. Imo, there is not a chance in hello that would ever be prosecuted. It's important to remember what the people dealing with these issues in LE/social services have seen.

And the rumors on Facebook were the Dilly’s garage was taped off cause they found a bloody sledgehammer, Harley’s dad committed Suicide in the garage ....on and on it went

He couldn't go up the chimney from inside the house. There was no fireplace or other opening big enought to accomodate him.

I get why people are upset with mom. People need to separate their feelings from the facts here. I don’t like her either. She’ll never get a Parent of the Year Award - She could benefit greatly by taking some parenting classes.

BUT

She had NOTHING to do with the decision her son made that day. He made a foolish choice and died as a result.

The Dilly’s do not deserve to have lunatics outside their home acting like a lynch mob.

You’ve missed a lot In the threads, including diagrams of chimneys with small cap openings inside that explain how the coat and glasses got there. Search”flue cap” in the threads for pictures.

There's a flue hole that could allow something small or compactible to be pushed through from inside the chimney, but not big enough to accomodate a person. Which is why he was stuck. There are pics of the flue in this thread. It's a small circle about the size of the exhaust pipe for a wood burning stove - which is it's intended use.

Theres no fireplace - just an 8” flu hole - like a VENT - visible on the second floor

No fireplace. Indoor flue caps where stovepipes attached. Easily removed/kicked out.

There is no fireplace or stove pipe, just the flue hole. So the items were found either on the floor or partially in the hole. Look at the pics in the thread if you can find them.

House where Harley Dilly's body was found becomes stage for protests

Police believe Harley got onto the roof of the house by climbing an antenna tower, and then decided to climb down the chimney. The chief said during a news conference that the chimney was blocked between the first and second floors, and that’s what led to him getting stuck. They also believe the boy was able to push his coat and glasses through a chimney flue into the second floor room, although the chief did not detail how exactly that would have happened or why investigators believe he took this action.
