BBM. I don't get it. Some laws need to be changed, imo. An alleged charge of murder and this person is allowed to post bond? Ugh!


He is scheduled to be back in court July 11 for a pretrial hearing. His attorneys, Chris Pagan, Jacob Long and Lawrence Hawkins III, left without comment.

Carter was in Butler County Common Pleas Court Tuesday for a pretrial hearing where Judge Dan Haughey set his trial to begin June 24, 2024. Carter was released from the Butler County Jail at about 11 a.m. Tuesday after posting $1 million bond.

Carter was fitted with a GPS monitor when released on bond. The judge reminded him, despite having a medical marijuana card, that as part of his release he can not test positive for drugs. Carter said he understood.
 
This article popped up on my local news feed. It seems authorities believe he had assistance in the disposal of her remains. I wonder if that is the guy charged with perjury? Hmmm.

This case really got me as I used to live not far from Sacred Heart where the festival was happening the night she was killed.

 
Unsealed search warrants in the John Carter case outline the county prosecutor’s office investigation into the 2011 death of Katelyn Markham: It points to circumstantial evidence for the murder charge against the man who was her finance’, using computer data, cell phones and witness statements, but it does not give a cause death or proof she was killed.

Butler County Prosecutor Michael Gmoser said the case is circumstantial, as are many, but that doesn’t mean the evidence, coupled with corroborating experts and witnesses, isn’t compelling.

“Even a body is not necessary to have a conviction for murder,” Gmoser said. “Defendants are still proven guilty without a body. That’s not an impossible situation.”
 

On Tuesday, Butler County Prosecutor Mike Gmoser asked for the charge to be dropped. Judge Jennifer McElfresh granted the request.

Gmoser said Palmerton may be called as a witness in John Carter's case. Carter is a childhood friend of Palmerton's and is accused of murdering Katelyn. At the time of her disappearance in 2011, the three hung out together.

Since Palmerton's trial was scheduled to take place before Carter's, prosecutors said that could have caused a conflict.

The trial of John Carter, the man accused of killing Fairfield’s Katelyn Markham in 2011, is a year away, but evidence collected by the prosecutor’s office for months that led to the indictment in the cold case has been turned over to the defense — all 107 plus items.

Carter, Markham’s fiancé when he reported her missing from her Fairfield townhouse, is free on $1 million bond after the March indictment. The case is scheduled for a pretrial conference Tuesday in Butler County Common Pleas Court.

It took 12 years of investigation by multiple police agencies before the Butler County Prosecutor’s Office arrested Carter, 34, on March 22 in Markham’s death that happened on or about Aug. 13, 2011. Her remains were found in Indiana in 2013.

On June 26, prosecutors filed a list of “documents and tangible evidence” in the case that includes 13 written statements; 63 individual interviews and/or polygraphs; tips from the public; phone records; work records; Facebook, Yahoo and Google records; dental records; vehicle records; property records; Fairfield Police, Forest Park Police, Indiana State Police, Butler County Sheriff’s Office and county prosecutor’s office reports; news media coverage, and interviews throughout the years investigation, specifically interviews with Carter.

Tuesday’s pre-trial conference scheduled for the man accused of killing Fairfield’s Katelyn Markham in 2011 has been rescheduled until September.

John Carter’s murder trial in not scheduled to begin until next summer, but the prosecution has turned over evidence in the investigation to the defense — more than 100 items.

Carter’s defense attorneys Chris Pagan and Lawrence Hawkins III left judge’s chambers an hour before the scheduled hearing. Carter was not present. He said the hearing had been continued.

When asked why, Pagan said, “the discovery is voluminous and we are working to see if it is correct.”

The hearing was continued until Sept. 12.

A hearing scheduled for John Carter who is accused of killing Fairfield’s Katelyn Markham in 2011 will not happen today in Butler County Common Pleas Court. The status report hearing was continued at the request of the defense until Oct. 17, according to court records.
 

Markham was an art student. The purpose of the gathering was to determine how the community can continue to further her legacy.

“She loved life. She loved art, she loved color, and we want to carry that forward,” Barrett said. “This is about forwarding her message that you should get together, make some art and have some fun.”

That’s exactly what happened in Harbin Park, where attendees enjoyed chalk, balloons, pumpkin painting, art raffle giveaways, and snacks.

Next week’s court hearing for the man accused of killing Fairfield’s Katelyn Markham in 2011 has been rescheduled for November.

It is the third continuance for John Carter, who is free on $1 million bond. Carter has not been in a Butler County courtroom since April 4.

Carter is charged under two sections of the murder statute, according to indictment: The first for allegedly purposely causing the death of Markham and the second for allegedly causing her death as “the proximate result of the offender’s committing or attempting to commit an offense of violence ...”

He was scheduled to be in Butler County Common Pleas Judge Dan Haughey’s courtroom on Tuesday for a “status report hearing,” but a continuance was requested Thursday by the defense. The Judge indicted he will grant the continuance to Nov. 28, according to prosecutors.

In the continuance motion, defense attorney Chris Pagan said, “The prosecutor does not object to this continuance.”
