PIKE COUNTY TRIAL: The jury in the #GeorgeWagnerIV trial has started deliberations. We're told the jury is waiting on/getting exhibits first.

George Wagner walks into court this morning - hurry up & wait to learn what a jury of 9 women + 3 men decide about his involvement in the Pike Co. massacre of 2016. The esteemed @ldufour behind the lens.

PIKE COUNTY TRIAL: Jury has asked another question - attorneys and Judge Deering are NOT going on the record for them. Will work on figuring out what they're asking - but it all seems like it's evidence-related.

PIKE COUNTY TRIAL: Attorneys will be going on the record in the courtroom in a couple minutes - standing by for what it is. FWIW - prosecutor ROob Junk mentioned on his way up it was some minor stuff.

PIKE COUNTY TRIAL: On the record in courtroom - jury is still in jury room. Judge Deering says jury wants a transcript of Jake Wagner's testimony - it is 764 pages. Special prosecutor Canepa says it is practice not to provide it. Defense atty Parker says it should.

PIKE COUNTY TRIAL: Judge Deering will provide the transcript of Jake Wagner's testimony - but is going to bring the jury in to give them a cautionary instruction about it. State is worried jurors can put too much emphasis on things in writing.

PIKE COUNTY TRIAL: Prosecutor Rob Junk says he thinks it will take 30 mins or so to print the 764 page transcript. But jury is headed into the courtroom right now to be given instruction on reading/interpreting the transcript.

PIKE COUNTY TRIAL: After Judge Deering explained the concern over the transcript, the jury foreperson told him they didn't need it. So, jury returns to the room to continue deliberations without transcript of Jake's testimony.

PIKE COUNTY TRIAL: Prosecutors and defense team are currently in Judge Deering’s chambers after the judge got a note from the jury room. Hoping we know what this is about soon.

AC keeping her lawyer hat on, it is always a good idea to speak to jurors who have convicted one defendant so that you can learn what they thought proved guilt, what evidence did they find compelling, what evidence did they see no relevance too

will help them when it comes to BW trial, and he may be considering his options considering how fast the verdict was

What likely made them most mad was George taking the stand to proclaim how innocent he is. It's one thing to allow your attorney to defend you and make the state prove their case, but when you take the stand and lie (and based on this unanimous guilty on all counts verdict I'm going to say they think George was lying) it's just seen as another attempted manipulation. George testifying may have made their decision that much easier.

Guilty of conspiracy. Guilty of aggravated burglary counts. Guilty of Unlawful possession of a dangerous ordnance. Guilty of tampering with evidence. Guilty of forgery.

Guilty of unauthorized use of property. Guilty of Interception of wire, oral or electronic communication.

Ct. 22 Guilty of engaging in a pattern of corrupt activity and all three specifications. But, the jurors unintentionally failed to circle a did or did not benefit. Jurors sent back to circle that option and will be brought back up.

Jury finds George Wagner IV guilty of all specs on Ct. 22 and all other counts. Sentencing will be for a date in December.
 

Good morning from the Pike Co. Courthouse where deliberations will begin momentarily in OH v. #GeorgeWagnerIV. Jurors heard closings and jury instructions yesterday.

Jurors in OH v. #GeorgeWagnerIV have been deliberating for about an hour - give or take - and have asked to see exhibits. Prosecutors met with Judge Deering in chambers to discuss which exhibits jurors want to see. We saw a big box of photos brought down.

We now have a third question from the jurors. Not sure what #2 and #3 were. Will try to get more info. OH v. #GeorgeWagnerIV

Ok. So, I just found out these "questions" from the jurors are not really questions. They were more requests for evidence. Prosecutors have been bringing down various items and handing them to the bailiff to give to the jurors.

Sometimes it's handled in chambers. If it's a big enough deal they'll put it on the record in open court.

State objects to jurors being given transcripts. Defense wants jurors to get the transcripts. Rob Junk says they’re not printed yet. They can print in prosecutor’s office. Jury being brought in to caution them about transcripts.

Now the jury is no longer requesting the transcripts of Jake’s testimony.

Bailiff in OH v. #GeorgeWagnerIV sent a note from the jury to the judge. Prosecution and defense summoned to Judge Deering's chambers.

Angie Canepa came out of Judge Deering's chambers and grabbed some papers. The court stenographer then went into chambers, too.

Whatever note was sent to the judge by the jury was handled in chambers. No update yet on what the request was and they're not going on the record in the courtroom.

By our count, the jury deliberated 7.5 hours - give or take. They broke for lunch. Not sure how long OH v. #GeorgeWagnerIV

Special prosecutor Angie Canepa makes it known that she wants to speak with the jurors. She realizes they don't have to speak with her or anyone else. Judge Deering instructing them that they shouldn't speak off the cuff

Now, Judge Deering is instructing them about speaking the press and realizing their name will be put out there and the person reporting can use just parts of what they say (never heard this done before with a jury).

Judge Deering tells jurors it's their choice whether they speak about serving on this jury. They are released from jury service
