NORTH RIDGEVILLE — Lakewood mother Janet Tyburski suffocated her daughter Rachele Tyburski and kept the body in her home for two days before dumping the body in a North Ridgeville field in March, according to North Ridgeville police.

Janet Tyburski plead not guilty by reason of insanity last February. She is accused of killing her daughter, Rachele, in their Lakewood home in March of 2015 and dumping her body in a North Ridgeville field. She is charged with aggravated murder, tampering with evidence and abuse of a corpse.
Police say Rachele's body showed signs of blunt force trauma and she appears to have been suffocated.
Her other daughter, Hannah, will also have pre-trial Monday. Hannah allegedly helped her mother move Rachele's body. She is charged with tampering with evidence, abuse of a corpse and two counts of obstructing justice.

A county judge on Monday approved $1,000 for a private investigator to look for additional evidence in the case of a Lakewood woman accused of killing her daughter and hiding the body in a North Ridgeville field.

Lorain County Common Pleas Judge John Miraldi granted the request after defense attorney Patrick Hakos said Janet Tyburski has given her lawyers new information that police didn’t look into while they were first investigating the death of Rachele Tyburski in 2015.

“She has provided us additional situations and evidence that we’d like to investigate regarding the death of her daughter,” Hakos said.

I feel bad for her sister because I don't really know how willingly she was involved.

I can just imagine the type of call she must have gotten from her mother. "Hey, me and your sister got into it again and she's dead and I don't know what to do!.." How would somebody respond to that coming from anyone they know, much less their own mother? This is probably something she'd ever choose to do in any other situation.

And, apparently Abuse of Corpse isn't what I'd assumed that it meant. Wikipedia must agree with my original impression of what it means, though. "Abuse of Corpse" redirects you to to Necrophilia, which includes a terrifying picture of a living creepy-looking lizard having sex with a dead creepy-looking lizard.

The Ohio law is this, which is similar to what it seems to be in most other states...
2927.01 Abuse of a corpse

(A) No person, except as authorized by law, shall treat a human corpse in a way that the person knows would outrage reasonable family sensibilities.

(B) No person, except as authorized by law, shall treat a human corpse in a way that would outrage reasonable community sensibilities.

(C) Whoever violates division (A) of this section is guilty of abuse of a corpse, a misdemeanor of the second degree. Whoever violates division (B) of this section is guilty of gross abuse of a corpse, a felony of the fifth degree.

Effective Date: 07-01-1996 .

Who is authorized to desecrate corpses? Coroners and Funeral Home directors? It sounds like it could be used against anyone who doesn't go through "proper" Funeral Home channels when a loved one dies. Like it's a legal favor to that industry. Even if, for some reason, it happens with no malice on the part of the accused, they're lumped in with people that dismember or have sex with a corpse?

I wonder if it applies to loved ones that hold a private service and private burial in a family cemetery without the deceased being examined by a coroner or having an autopsy?

It seems like it's mental illness. It looks like Rachele (the victim) had some mental issues and had assaulted both her mother (the accused) and her late father's mother before. So it actually kind of does seem like Rachele's bipolar behavior and violence could have caused her mother to just "snap" (as mental illness often runs in families and can pop up in any era of our lives).

I don't think the mom should get a "free pass" or anything like that, but it sounds like her daughter might not have been the "totally innocent" and non-confrontational victim like it once seemed.
 
Tyburski pleads guilty to daughter's killing, sentenced to 19 years to life

Janet Tyburski may have confirmed Wednesday that a statement she made to North Ridgeville police about killing her daughter was true, but the 47-year-old woman stopped short of apologizing for causing her daughter’s death when she spoke just before being sentenced to 19 years to life in prison.

“I so sincerely apologize to my family, friends, neighbors, the Lakewood community and the North Ridgeville community for putting them through this trial – this mess,” Tyburski said during a plea and sentencing hearing at the Lorain County Justice Center. “My actions were just egregious. Taking my daughter’s body – I was not in my right mind – and placing her in a field in North Ridgeville. For getting my other daughter – who was just going about her business in college – and involving her in helping to move her sister’s body.”

In a plea agreement reached with prosecutors, Tyburski pleaded guilty Wednesday to two counts of murder, two counts of felonious assault, one count of tampering with evidence and one count of abuse of a corpse. The plea dismissed a charge of aggravated murder. The deal called for a sentence of 19 years in prison to life.

“That 19 years is mandatory time. You are not eligible for early release,” Judge John Miraldi said to Tyburski before handing down the agreed upon sentence.

Still, Tyburski wondered if she could be exonerated if new evidence is found years after she pleads guilty and is imprisoned. Miraldi said he could not advise her on those kinds of post-conviction matters.

The deal also resolves the case against Tyburski’s other daughter, Hannah, who in 2015 was an Oberlin College student called by Tyburski to help her dump her dead daughter’s body in the North Ridgeville field. The state will offer Hannah Tyburski a plea that calls for her to plead guilty to one count abuse of a corpse, a misdemeanor offense.

“We won’t go beyond that now or in the future,” Assistant Lorain County Prosecutor Paul Griffin said. “It is not our intention to seek any other charges with respect to her now or in the future.”

Hannah Tyburski pleaded guilty Monday to helping dump her sister’s body in a North Ridgeville field after their mother killed her.

The 21-year-old’s plea to the misdemeanor charge of abuse of a corpse came less than a week after her 47-year-old mother, Janet Tyburski, pleaded guilty to murder and other charges and received a sentence of 19 years to life in prison.

Part of the agreement in the elder Tyburski’s case was for her daughter to receive a plea deal with prosecutors that saw additional charges of obstructing justice and tampering with evidence dismissed.

“This entire experience has been very difficult for me, and I just want to express how sorry I am to everyone my action has impacted, most importantly my sister, who I love and miss dearly,” Hannah Tyburski said before Lorain County Common Pleas Judge John Miraldi sentenced her to one year of good behavior.

He suspended a 90-day jail sentence and a $750 fine.

Nick Hanek, one of Janet Tyburski’s attorneys, said Rachele Tyburski’s son, who was 4 years old at the time of his mother’s death, is now in the custody of relatives.

I just saw this story on "Diabolical' on ID-- From my perspective Janet Tyburski is the embodiment of evil, a true sociopath: she was a hateful biotch towards Shelly: she hated her and nothing Shelly would do could change that. Janet also hated her husband and I feel she was involved in the fatal auto accident that took his life. I felt like I was watching a horror story. There were comments from people during that program that pointed in the direction of Janet being just an awful hateful human being and her children, especially Shelly paid the price. Imagine also, asking your other daughter to help you (the mother) to dispose of the body. Despicable.
