Under a new state law, a child may be found competent only if able to grasp the seriousness of the charges, if able to understand the court proceedings, if able to aid in the defense and if able to understand potential consequences.

The law says a child with a mental illness or an intellectual or developmental disability may not be found competent.

I wonder if they have established a motive in this school shooting.

New court dates set. I actually know the psych doctor who evaluated him. The evaluation is sealed so we likely won't hear anything until May with the competency hearing.

I'm not sure how to take setting a competency hearing and then a hearing 10 days later to determine if he will be tried as an adult. According to everything I've read if he's declared incompetent then he cannot be tried as an adult, so it seems indicative to me that the evaluation determined he is, in fact, competent to stand trial or why else would the judge set that second date on a Saturday none the less ? ?

No motives surfacing yet, but honestly it's been pretty quiet locally about the entire thing. The link above has video of the hearing in which I'd say TJ Lane appears pretty at east and even relaxed.

Link got lost in the transfer so reposting. If any websleuthers would like to help Nick Walczak he is looking for votes to win a mobility van. Link to vote is at the bottom of this article. Type in code 848 and he will receive 5 bonus votes. Unfortunately, Nick was left paralyzed :(

This is the direct link. The server crashed and the site was down the last couple days but it is up and running again :) When I originally posted this he had around 8600 votes. Keep it going websleuthers! This boy sure didn't deserve a day at school like this :(

He is saying the motive is a love triangle. Two of those who died were the shooters ex-girlfriend and her new boyfriend.

TJ Lane will be tried as an adult, judge rules

The judge said he found probable evidence in all six charges for which Lane is charged, including aggravated murder charges. He rejected a defense request to release Lane on a $500,000 bond and said Lane would pose a risk to flee and a safety risk to the community.

At a hearing Thursday, a police officer testified that Lane admitted killing the victims but didn't know why he did it. Sheriff's Deputy Jon Bilicic said that Lane was wearing a T-shirt with the word "Killer" when he was arrested about one mile from the school.

CHARDON, Ohio (AP) — A teenager pleaded not guilty Friday to shooting and killing three students and wounding three others in the cafeteria of a high school in suburban Cleveland.

T.J. Lane, 17, told a judge that he understood the charges during his first court appearance since being indicted this week on charges of aggravated murder, attempted aggravated murder and felonious assault.

T.J. Lane is sentenced to life in prison without the possibility of parole.

He wore a white T-shirt with the word KILLER is capital letters across the front, and flipped off people in the courtroom, including family members of the victims.

WHY was he able to come to court wearing this shirt?? What an insult to the families of the victims!

I don't understand why the presiding judge did not order him to put his other shirt back on - or have him removed. That is insulting, disrespectful, and a blatant in your face statement. Why didn't the judge do something?

JMHO

Good questions Wise Old Owl. And why was he not in handcuffs during the sentencing?
This stinks.

Terrible judge.
The murderer should have been shackled. Upon the first verbal outburst, he should have been forcibly (and roughly) removed from the courtroom.

Just awful, what the poor families had to endure today.
