Maybe it's part of the health condition that precludes him from going to prison, like glaucoma or something? Did he recently go blind?

So, if he was going blind and had murdered someone, would he still have gotten probation?

This is so strange. I don’t understand the logic of the sentencing on this case. That poor girl. So many people let her down, imo.

This is absolutely outrageous. I have a family member who is legally blind (functions quite well but has to use large text on her phone, etc.) and they had no problem sending her to jail for charges light years less than this monster’s.

I’d like to petition the powers that be for a big red VR tattoo on these guy’s foreheads if they’re sending them back out into society. It would work a lot better than the practically worthless registry... imo only helpful possibly finding a perp after a crime has been committed and so many don’t register it just boggles the mind. All the curse words over this one[emoji35]

What is crazy about this is that the impact of his crime on this poor innocent girl is in no way reduced or minimised by his 'disability'. So his capacity to do harm to others is as real as anyone committing the same crime without said 'disability'. So why is the punishment any different? If there is some legal loophole that says he can't go to prison well confine him to a medical facility. Why are his needs placed above those of his victim, and potential future victims? Legal blindness does not impair his ability to know right from wrong or his cognitive capacity, so odds are he will commit the same crime again, if not a worse crime, all because he was protected from punishment because of his 'disability'. Why should an individual's rights override the rights of every other female that crosses his path? Grrrrr this is just ******ed (sorry, it just is!!)
 
My son got more time for a minor drug offence and theft at a liquor store.
12 mths my son got.

outrageous you can be legally blind and live a normal life. You just wouldn't be able to drive and it can limit some of the things your able to do but there are people who are classed as "legally blind" who can see but there sight is extremely limited.

That statement was challenged Wednesday by Oklahoma City attorney Bruce A. Robertson, who is representing the girl's interests in a civil case currently pending in Oklahoma County.

“Contrary to statements made by the Murray County Assistant District Attorney David Pyle, our client and her family never expressed reservations about traveling to Oklahoma for the criminal case against Benjamin Petty," Robertson said in a written statement. "In fact, our client traveled to Oklahoma and was present in the courthouse on April 10, 2017, for the preliminary hearing and anticipated testifying at trial. Further, the family consented to the plea agreement based on the representation by Mr. Pyle that Petty would not serve meaningful time in prison due to his medical conditions. The family was not provided any other alternative.”

(Pyle's boss, District Attorney Craig) Ladd released a statement Wednesday, which read in part, "I want it to be known that I strongly disagree with the lenient manner in which the Benjamin Petty case in Murray County was prosecuted in many respects. The manner in which that case was prosecuted does not reflect my thoughts or position on how rapists, especially those who prey on children, should be dealt with in the criminal justice system."

No prior felony convictions? That’s interesting, because we have learned that Benjamin Lawrence Petty received a DUI in Oklahoma County in 2013. I wonder if his “blindness” got him out of jail on that one, too?

So per the last quote...here in Australia, if a judgement is given that a higher authority is not satisfied with, particularly amid public outcry, they appeal it or overthrow it - is that possible here or will he just say 'oh I don't agree but I'm not going to do anything about it?' :thinking:

Edit: ok so I saw this in the article:
"In the release, Ladd also stated that because the defendant was sentenced, jeopardy had attached, and "therefore I cannot legally undo what has been done."

Surely a cop-out? If he really wanted something done he'd do it wouldn't he? There are always exceptions - everything about this is just disgusting.
