The brother of the York man facing the death penalty for allegedly kidnapping and killing his girlfriend’s son has been arraigned on charges for an incident at the courthouse Wednesday afternoon.

Jawwad Rushdi, 33, of the 900 block of Castle Pond Drive, York, is facing criminal charges for allegedly going “ballistic” in a courthouse hall and attempting to attack the lead investigator in the murder case...

“(Criminal Investigator Edward) Silberstein was at the courthouse for a grand jury,” Police Superintendent Michael Chitwood said of Wednesday’s incident with Jawwad Rushdi. “Rushdi had just visited his brother at the prison and came to the courthouse to hook up with his family. (Silberstein) greeted him and held out his hand and (Rushdi) started threatening him. He went ballistic.”

Judge James Nilon has so far authorized up to $30,000 to pay for the services of a psychiatrist and death penalty mitigation specialist. He said he would happily authorize additional funds for another psychiatrist, with the understanding that payment would be rendered upon submission of an itemized bill.
The next status date has been set for Sept. 14. The judge said he hopes to set a scheduling order at that time or shortly thereafter.
 
November 2015:

An Upper Darby man facing the death penalty for allegedly killing an infant in 2013 began calling out that he is a good person during a status hearing Monday.

"I'm in this position for being good, whereas everybody else lives in sin," said Ummad Rushdi, 32. "I'm in the position trying to be the best I can be. I'm attacked harder than everybody else on a spiritual basis."...

Nilon set a new status conference date of Feb. 1, by which time he said the reports should be provided to Wills. A trial date could be set at that listing as well.

Rushdi began to mumble to himself shortly after that date was set, then began interacting with the judge. He continued to call out about spirituality as he was led from the courtroom.

"Peace and blessings," he said. "Hopefully somebody finds the light to be joy. Let there be light."

Judge James Nilon said Tuesday that he intends to hold a hearing with a psychiatrist retained by death penalty counsel in the case of accused baby killer Ummad Rushdi.

Rushdi, 33, is accused of killing 7-month-old Hamza Ali in August 2013 at his parent’s home in the 6600 block of Chestnut Street, Upper Darby, then transporting the body elsewhere and burying it at an unknown location.

Following a string of delays, two new experts have been approved to provide defense reports for accused baby killer Ummad Rushdi.

Rushdi is represented by defense attorney Michael Malloy and death penalty counsel Scott Galloway. He was previously being evaluated by defense expert Dr. Muhamad Aly Rifai, but Galloway told Judge James Nilon last month that a final report from Rifai still had some issues.

The court has now approved psychologist Dr. Drew Nagele and forensic psychologist Dr. Drew Atkins to take over. It remained unclear Thursday whether the county will recoup any of the $10,000 paid to Rafai for his services.

Nilon set a new status date of Nov. 7.

A Bryn Mawr psychiatrist has diagnosed accused baby-killer Ummad Rushdi with schizotypal personality disorder and determined that he is not competent to stand trial.

“His judgment about his ability to prevail, about the case, about what he would be presenting as a defense are so severely impaired that he lacks the sufficient capacity to stand trial,” Dr. Stephen Mechanick told Deputy District Attorney Stephanie Wills during a hearing Tuesday.

Mechanick’s conclusions differ from that of forensic psychologist Dr. Drew Atkins, who opined that Rushdi suffers from schizophrenia based on his delusional beliefs, his inability to care for himself and his inability to hold steady employment, according to testimony presented Tuesday.

Mechanick said Rushdi’s inability to provide defense attorney Michael Malloy and death penalty counsel Scott Galloway with any meaningful assistance is not based on an intellectual disability or delusion, however, but rather from his belief structure.

“I think he has the capacity in the sense he has the intellectual capacity – he has the overall capacity – but his preoccupation with his spiritual beliefs is where he puts his time,” said Mechanick.

Delaware County Common Pleas Court Judge James Nilon indicated Rushdi, who faces charges of first-, second- and third-degree murder, kidnapping and abuse of a corpse, would be under lockdown at Norristown State Hospital until that designation changes.

A man accused of having kidnapped and killed his girlfriend’s 7-month-old son in the Philadelphia suburbs almost eight years ago has been deemed incompetent to stand trial for the foreseeable future due to mental illness.

Doctors from Norristown State Hospital testified at a Delaware County hearing late last month that the mental illness of 30-year-old Ummad Rushdi is not improving, making him unable to participate in a trial or accept a plea deal from prosecutors.
