Thursday, October 13th:
*Trial continues (Day 2) (@ 1:30pm ET) - PA – Nichole Pumphrey (31), her daughter, Ameriah Emery (10) & Lawrence Cannon (31) possibly BF (Oct. 16, 2018, New Castle) – *Steven Procopio (19/now 23) arrested & charged (10/17/18) with 3 counts of criminal homicide, 3 counts of criminal conspiracy, attempted murder & gun offense. Plead not guilty. Bail denied.
Trial began on 10/11/22. (10/13 @ 1:30pm & 10/14 @ 9:30am) but might go into to next week.

10/11/22 Tuesday, Trial/Jury Selection Day 1: A jury was chosen and seated Tuesday for the trial. Trial begins on 10/12/22.
10/12/22 Wednesday, Trial Day 1: Opening statements by District Attorney Joshua Lamancusa & Procopio’s court-appointed defense attorney, John Bongivengo.
Testimony began Wednesday morning. State witnesses: New Castle police detective Branddon Hallowich was on the witness stand for the rest of the day, describing the crime scene, the investigation and the discovery of the shell casings in the house.

Trial continues on 10/13/22. DA Lamancusa said the trial is likely to extend into next week.

The trial is underway for a man accused of killing a 10-year-old child in New Castle.

On Thursday, an interview between a detective and Procopio was played, where he admitted to being at the home when the death occurred but denies that he shot her.

The trial is expected to last throughout the week.

A jury of seven women, five men and two women alternates for two days have listened to several hours of the taped interviews with Procopio.

District Attorney Joshua Lamancusa, who is prosecuting the case, said there are three hours left to be played on Friday for the jury of the back and forth questioning of the suspect.

After that, the detective on the witness stand, New Castle police detective Branddon Hallowich, will be cross-examined by Procopio’s court-appointed defense attorney, John Bongivengo.

He anticipates calling an 11-year-old eyewitness, Emery’s younger sister, to the witness stand on Monday, along with the forensic pathologist who conducted the autopsies.

Detectives gave Steven Procopio every opportunity to tell the truth during many hours of questioning about a triple homicide that occurred Oct. 15, 2018.

During those recorded interviews, Procopio changed his story multiple times about where he was that night and whether he was inside of the house where 31-year-old Nichole Pumphrey, her friend 31-year-old Lawrence Cannon, and her daughter 10-year-old Amariah Emery, were found dead of gunshot wounds the morning of Oct. 16 that year.

The entire recorded interviews were played for a jury this week during Procopio’s trial in the Lawrence County Court of Common Pleas. President Judge Dominick Motto is presiding over the proceedings.

New Castle police Detective Branddon Hallowich was on the witness stand for the third day Friday as three more hours of recordings were played for the jury of the interview with Procopio. During the interview, Hallowich, and then-detective David Cumo tried to reason with Procopio to tell the truth.

Procopio’s court-appointed defense attorney, John Bongivengo, spent Friday afternoon cross-examining Hallowich about the recordings.

The trial will resume after 9 a.m. Monday, with the 7-year-old witness, now 11, taking the witness stand to tell first-hand what she saw that night. Also testifying next week will be the forensic pathologist who conducted the autopsy, and a former jail inmate to whom Procopio reportedly told the entire story of what happened that night during their incarceration.

10/14/22 Friday, Trial Day 3: State witnesses: New Castle police detective Branddon Hallowich, was on cross-examined.

It’s a first for Lawrence County, District Attorney Joshua Lamancusa said.

The murder trial of 21-year-old Steven Procopio, accused of his involvement in three shooting deaths and of being the gunman who killed a 10-year-old girl, has been suspended until 9 a.m. Oct. 24.

Lawrence County Common Pleas President Judge Dominick Motto, who is presiding over the trial, advised the jurors they all had been exposed to COVID-19, because one of their fellow jurors tested positive for the virus.

Court was to have convened Monday, when key witnesses were expected to take the witness stand. However, when the jurors filed into the courtroom in the morning, one of them was missing.

Cross-examination was to have continued this morning before Lamancusa called more witnesses, including an 11-year-old girl who reportedly was the eyewitness to her 10-year-old sister’s death. The child was 7 when she witnessed her sister being shot, according to court records.

Oct. 25—An 11-year-old girl testified in court Monday she did not remember who pulled the trigger of the gun that killed her 10-year-old sister.

Her statement was contrary to accounts she gave a forensic interviewer after her mother, Nichole Pumphrey, 31, her mother's 31-year-old friend Lawrence Cannon and her sister, Amariah Emery were shot to death inside Pumphrey's house the night of Oct. 15, 2018.

The child was called into court to recount her version of what happened that night when her sister was shot in front of her eyes on the steps of the house. Police in a report and through testimony in the courts determined Amariah was the last of the three shot that night after she witnessed two intruders in the living room, then her mother's and sister's deaths.

Taking the witness stand in the morning was New Castle detective Branddon Hallowich, who testified Hammer, with whom Procopio and Cooper were living in Pulaski, initially was charged in the case, but her charges later were dismissed, because "we never had evidence that Hammer was at the house" later that night.

He said through interviews, he learned Procopio's role in what is believed to have been an attempted robbery, was that of the lookout person.

he judge recessed the trial just before 1 p.m. until Tuesday morning, so he and the attorneys could discuss a technical issue that had arisen.

A former inmate who befriended Steven Procopio in jail gave the jury a detailed description in court Tuesday of Procopio’s account of a robbery plan gone awry that resulted in his shooting a 10-year-old girl.

Sides took the witness stand with conviction Tuesday during Procopio’s trial for the Oct. 15, 2018 shooting deaths of Nichole Pumphrey and Lawrence Cannon, both 31, and 10-year-old Amariah Emery. He told of how Procopio laid out his story of what happened the night the three were shot dead in Pumphrey’s West Side house at 319 North St.

He told the jury that the prosecution made no special provisions for him to testify, nor did he have any prior knowledge of Procopio’s case, or any requirement to testify.
