I hope LE questioned all of the restaurant employees. Someone has to know how the acid got into the cups. If accidental, simply throw away the contaminated cups. That's a lot less expensive than paying a lawsuit to cover damages.

What type of caustic acid would be used in a restaurant anyway?

As if the poor boy doesn't have enough going on :(

I wonder what the heck went wrong here.

Could it be some kind of cleaning product? But why would it be in the same kind of cups/containers used to serve drinks?

What types of Strong Chemicals would be
used in a Restaurant, anyway?

http://www.foodsafetysite.com/resources/pdfs/EnglishServSafe/ENGSection11Cleaning.pdf :

Cleaning Agents are Divided into Four Categories:

• Acid Cleaners -- Use periodically on mineral deposits and other soils that detergents
cannot remove. These cleaners are often used to remove scale in warewashing machines
and steam tables.

• Solvent Cleaners – Use periodically on surfaces where grease has burned on.
Solvent Cleaners are often called Degreasers.

• Abrasive Cleaners -- Use these cleaners to remove heavy accumulations of soil that are
difficult to remove with detergents.
Some Abrasive cleaners also disinfect.

• Detergents – Use detergents to routinely wash tableware, surfaces, and equipment.
Detergents can penetrate soil quickly & soften it. Examples include dishwashing
detergent and automatic dishwasher detergents.

So from the articles it appears the restaurant is still open. Does the health dept think the substance in the children's juice came from elsewhere? I would have thought (and hope) the first thing they would do is close the place down until they found the source of the caustic substance....

I wonder if the poison was already in the glass </Mags Bennet>, or in this case the plastic cups. It's obvious from the failed inspections that they do not follow basic protocols of kitchen safety.

Sure, they keep the cleaning supplies from the food, but do they keep the cleaning supplies away from the dishes?

My first thought was that employees used the cups to scoop out crystalized laundry detergent. Or maybe measured some cleaning solutions or dishwasher soup using the cups, rinsed them quickly with water and put them back? Or even there was some at the bottom of the cups and employee didn't notice when pouring the apple juice. Could be that there are a few plastic cups they use to for this and someone didn't realize that and took the detergent cups instead of the customer cups when preparing the meal.

It is possible that the cups were stored near chemicals that somehow got into the cups -- a stack of cups got knocked down onto a shelf and stuffed dripped inside them. Employees just stacked them back up and then they got used.

The one report did say that n an inspection found chlorine way above what was considered safe. It also stated:

The state Department of Agriculture first became aware of the incident Monday morning from news reports, said spokeswoman Shannon Powers. Police are not required to notify the Department of Agriculture for investigations related to food safety.

“We are working to improve that communication chain," Powers said, "but the local police are not bound by the food code.”

It says the drink contained menthol in it. Some people use juice like apple juice to make moonshine and if you do it wrong it can be in lethal doses. I wonder if someone was making homemade alcohol with the apple juice and used the same container.

Thank goodness it sounds as though the kids are going to be okay

Whatever it was, it must have been very caustic.

From your (14) link,

An adult also suffered burns to his mouth after taking a sip of the juice, but did not swallow it.
