Meemaw, I am really concerned about this case. I walk away and come back. I thought the sentencing phase would be short and sweet, thought it was a done deal. The defense is retrying the case and the judge is allowing it. Since there is a new jury, with trial no more than two days a week, with all the computer stuff being thrown at everyone, and possibly the *advertiser censored* coming in, and secret witnesses, it muddies the waters for the facts of the prosecution's case. Apparently, morals and ethics mean NOTHING to defense lawyers anymore. I can actually see her walking away due to some type of mistrial or appeal. I cannot fathom why JSS let it get to this place. If this sentencing phase ends with an actual sentence I will be surprised. If she receives a DP sentence, I will be shocked.
Westerfield is a man who raped and murdered a child. It is apparent that jurors go softer on women than on men, which is grossly unfair. Then you get defense counsel who bring in psychologists who hate men to lie for Jodi. So even though she admitted the killing, and even though Juan Martinez has the evidence, I am left with a sickening feeling in my stomach. I just have to sometimes get away from it all. I wish Travis's family could walk away. My heart goes out to them.
As for JSS, she is a major disappointment. I pray she never gets another death penalty case before her.
Well said and I completely agree with what you have written. I just keep thinking rebuttal is coming. Mr M will put it all back in prospective. By the end of the trial (hope I live long enough to see it) either the jury will trust Mr M or the defense. IF they trust Mr M they will use his facts to reach a decision if not they will go with the def. I have never served on a jury but I think that is what happens.
It's sad that a trial can be conducted this way, but it is the American way. Seems the defendant has all the rights, victim has none.
I agree about the judge, she needs to rein in the def and hopefully tomorrow she will. I'm sure she is hearing in AZ how disgusted people are. It seems in death penalty cases, the def is allowed the broadest latitude to present a case even if it's a lie. It's up to the jury to figure out if there's mitigation or not.
Having to hear about this trial by Twitter is making it harder to get a feeling how it is going for me anyway. For me I think wow Mr M put on a compelling case, then came the defense and it's been a wreck since and IMO def wants it that way so the jury will get lost in the look here not over there. Then Mr M will get back up and bam we are back to reality. Now if the jury feels that way dunno. Seems to me the delays will hurt the def also dunno. The hardest part for the judge is to keep this jury intact so she will have to do something. Maybe #3 asking to get off is what is bringing the status hearing tomorrow. After it she will have to decide to extend court hrs. stop some of the crap etc. after all she told jury Dec 18th. I would think her superiors might counsel her on getting it over with.
We shall see how this week goes.
