I know his lawyers have to try to get him off, but, does anyone give a rats behind they think it's unconstitutional to put him to death for the murder of NINE people who welcomed him into their church and who he murdered simply for the color of their skin?!! I know I don't.

I believe that he has a constitutional right to make that argument in a court of law. I support the court making a decision in that matter.

If the Death Penalty is still a legal punishment in the Federal system (and it is) or in a particular State's system (and it is), then the DP is what this crime deserves. They can't hardly be many murder cases worse than this -- although we have seen some very, very bad ones. imo

Not NO BUT HELL NO!!!

DR even prayed with these innocent victims before he took their lives!! He deserves to be executed. I don't want to hear anything about mental illness either, in case his lawyers try to toss that in.

O/T One of my church members was at the church and was going to go but was called back to his hotel or he would have been a "white" victim.
 
I believe in using the DP for certain crimes. If any crime deserves death, this one does. What does it take for a human to look at an 87 yr old woman, in a church, and decide that killing her is what he wants to do? But every day we read about parents who look at their own innocent baby/child, and somehow decide to kill it.
But, if you give someone the DP and they get appeal after appeal, and linger in prison for years ( or till their natural death), all that money spent by the taxpayers is a waste. Just like trying this guy by the state and the federal systems, you can only kill a person one time. Don't make it for show.
For the DP to be effective ( in my opinion) you get walked out of the courtroom immediately after being found guilty and either hung on main street or shot by a firing squad. Right then!
It's very hard to administer the DP now, can't get the drugs, etc....
Accept the plea deal, LWOP, no appeals, ever, and lets be done with it.
DR wanted to start a race war, and I'll be darned if he hasn't almost gotten his way. It's up to us to decide differently.

A 10-page order explaining why the evidence hearing in the federal Dylann Roof case will remain closed Thursday morning includes several sections of redacted information that outlines some of the evidence to be discussed.

U.S. District Court Judge Richard Gergel said in the order that it’s necessary to keep the hearing closed to the public to protect Roof’s rights to a fair trial and impartial jury.

Prosecutors argue the law already gives jurors complete discretion in determining whether aggravating circumstances outweigh any mitigating factors, and, thereby, whether the death penalty is warranted.

Jury pool for Dylann Roof cut to 750 after three days of hearings

"CHARLESTON, S.C. (WCIV) — Nearly 750 people will return to federal court in Charleston this November for final jury seating. That's after ten sessions across three days that gave prospective jurors an opportunity to claim exemptions from jury service.

The jury pool started at 3,000 people.

"We did this in two-and-a-half days -- that's impressive," said U.S. District Court Judge Richard Gergel after the second session ended on Wednesday. "Let's hope the rest of this process is as efficient."..,

His trial starts on Nov. 7 with final jury seating. Opening statements are expected to begin the week after Thanksgiving.

U.S. District Judge Richard Gergel’s comments came during a meeting last week in which an attorney for victims of the Emanuel AME Church shooting asked for testimony in the trial to be delayed until the new year. The proceeding is slated to start Nov. 7 and is expected to last through the holidays, when the surviving victims and their families will travel and spend time with loved ones.

Gergel wants to avoid adding stress during an already busy time of the year, but the fast-pace trial schedule cannot be changed, he said during the meeting Friday that was documented in a court transcript. The process has gone well, he said, applauding opposing attorneys for doing “outstanding” work under pressure and remarking at the response from Charleston-area residents who were summoned as possible jurors.

Jury selection in the federal trial of Dylann Roof, the 22-year-old suspected of murdering nine people last year at the oldest black church in Charleston, S.C., was postponed Monday morning by the presiding judge.

In a public statement explaining the delay, Judge Richard Gergel did not say when jury selection would resume.

The judge wrote:​

"I have received a motion in this case this morning requiring my immediate attention and the conducting of a hearing involving only the Defendant and defense counsel. The hearing with be closed to the Government and the public."​

"The government" refers to the prosecution in the case. Roof has pleaded not guilty to 33 federal hate crimes counts; he is accused of entering the historically black Emanuel African Methodist Episcopal Church in downtown Charleston and sitting among worshipers at a Wednesday Bible study before opening fire. The church's senior pastor was among those who died.”​

it is unusual for both federal and state to seek DP

Roof would plead guilty if DP was off the table
So why is the pleas not accepted

Why is DP being sought....one reason was to make others know this is a serious crime and it might stop others from doing the same thing

They feel Roof is sane and can stand trial

A closed-door competency hearing to discuss a new psychiatric evaluation of church shooter Dylann Roof stretched through a second day.

U.S. District Judge Richard Gergel presided over the hearing to determine if the self-avowed white supremacist is competent to face his looming death penalty trial. The hearing began Monday morning and lasted through the day. It resumed Tuesday morning and ended at 5:30 p.m.

Testimony has concluded, so no hearing is scheduled for Wednesday. Once a decision is reached, it will be entered as a judicial order in the case docket.

Gergel banned the public from the hearing despite pleas from many of the nine Emanuel AME Church shooting victims' families and the survivors who wanted to observe the proceedings.
