"▪ New details about a heated exchange at the crash scene: In the sworn deposition of DNR Lt. Robin Camlin, Renee Beach’s lawyer asks whether investigators at the scene reported Anthony Cook telling police “Paul Murdaugh killed my girlfriend” or that Anthony Cook yelled “I hope you rot in f------ jail,” at Murdaugh. She said she didn’t recall either of those details.

However Cpl. John Keener, who was at the scene of the crash, told lawyers that Anthony Cook “was trying to fight the Murdaugh kid. So that’s why we thought the Murdaugh kid was driving at the time.”

Another officer who was at the scene wrote in a report that Anthony Cook was screaming, his language laced with profanities.



”I hate them mother------- for not letting me drive the G-- damn boat. That mother------ needs to rot in f------ prison. He ain’t going to get in no f------ trouble. Bo, you f------ smiling like that like it’s f------ funny.· My f------ girlfriend’s gone, Bo. You think you’re f------ funny? I hope you rot in f------ hell.”

When read the quote in court, Keener said he didn’t remember exactly what Anthony Cook said but agreed he was “hot” with anger."
 
What the Murdaughs did at the hospital after the crash: The DNR officer who was interviewing Paul Murdaugh when his father, Alex Murdaugh, and grandfather, Randolph Murdaugh III, arrived was told to stop the interview. The elder Murdaughs told the officer Paul was not saying anything else. When the officer told them he was talking to Paul, one of them responded, “No. You’re talking to us now.”

Another officer said a nurse told him she saw Alex Murdaugh going into other boaters’ rooms at the hospital to speak with them and their families. At one point, according to the depositions, the nurse said she overheard Alex Murdaugh tell Connor Cook “they were going to figure everything out.” She also said he told a different investigator that his son Paul Murdaugh wouldn’t be giving a statement because he was intoxicated.

You can try opening the article in the Brave browser or in Pocket or Outline, or by hitting the Reader View button in your browser when opening. Basically the investigative process that immediately followed the accident featured the Murdaugh family in full damage control.

One officer noted in his report that Murdaugh said: “Why do you need to know who was driving? That isn’t going to help find Mallory. What if it was me driving the boat?”

Previous documents obtained by The Island Packet and Beaufort Gazette said there was confusion over who was driving the boat, but only one report clearly stated that Anthony Cook told police Paul Murdaugh was driving. Until the new court filings, it had been unclear why police were looking at two people as possible suspects.

▪ A lead investigator was removed from the case: DNR officer Michael Brock, who was referred to as the “point man” in the investigation at one time, was taken off the case because of his ties with the Murdaugh family. In his deposition, he said he had gone to the Murdaughs’ river home once, twice, or three times.

At one point, Beach’s attorney asks Brock: “You can see how people — given the fact that you were removed from the case — do you see the conflict, how that doesn’t look good?”

“Sure,” was Brock’s response.
 
Quite a bombshell filing…

( The LE officiers named). may “have information as to a ‘campaign’ to cloud the investigatory issues and disseminate false information in the community with the intention of misleading law enforcement and prosecution charging parties, and the public, into wrongly and falsely believing Connor Cook should be arrested and charged as the boat operator....

To me, the filing looks inherently weak (no offense intended).

At the end of the day, PM, as with anybody facing criminal charges for any matter, is completely free to present alternative theories at any stage in the investigation. They can also start to mount criminal defenses from moment one.

Granted, as another poster stated: "Most people dont have a team of high end lawyers on speed dial". Any alternative theory advanced by PM is going to get advanced quickly and legal defenses are going to be effective.

But.... the fact that PM has more resources than others and keeps those resources on speed dial "rock / rap star style", does not void his rights to make counter theories and mount effective legal defenses early.

In short, I dont think this suit is going to go anywhere unless it is supported by something more than:

"Hey! A Subject of an investigation presented alternative theories and started to legally defend himself from moment one. Oh, btw, he has cash to get his views out "Fast and Furiously" and to fund an effective defense...."

My guess is that prosecutors from the Hollywood area would respond: "No conspiracy at all. That is simply what wealthy bad boys do- time and time again."

While it’s true that anybody can start looking at a defense, it appears that these attorneys are doing a good job of putting together elements that show LE was helping them to do it. This is clearly not a normal way to go about things.

I believe you know and understand much more about law and legal proceedings than I do. That said, I dare to disagree.

Before these murders opened the floodgates of unfavorable attention, I can see this family playing hardball. But not now.

I think they will want to settle this suit…shut it down…cull the negative reporting that’s spilling out in the media.

Not just for them…but because there’s a ripple effect that’s beginning to touch other people’s reputations…maybe even impact their employment. Names are being named. Angry people are unpredictable….in assessing what else they might say.

I am thinking that those advancing the conspiracy claim will need to focus on point 3. Point 4, might be usable as well. Then again, different investigators can make equally valid, but different decisions.
 
New audio and video released in 2015 death of Stephen Smith

Last month, SLED said they opened an investigation into the cold case last month after they found information relating to Smith’s death while investigating the murders of Paul and Maggie Murdaugh. SLED has not released what they found.

But according to information obtained from Highway Patrol’s investigation, the Murdaugh name was brought up multiple times in interviews with Smith’s family and friends about his death.

In the recorded interviews with people who knew Smith, some people told investigators they heard a rumor that a group of people spotted Smith along the road and then did something that led to his death.

Despite the mentions of the Murdaugh name in multiple interviews, no member of the Murdaugh family has ever been officially implicated in Smith’s death.

Other than one note of an attempt to call a member of the Murdaugh family that went unanswered, the documents didn’t reveal if a member of the Murdaugh family was interviewed by investigators.

But at several points, investigators told the people they were interviewing they were not afraid of the Murdaughs and wanted more answers into how Smith died.

“My office is around Charleston,” said Trooper Proctor. “I don’t work around Hampton, and I know the Murdaughs are highfalutin around Hampton and people say they have a lot of power or whatever, but that name doesn’t mean anything to me... you don’t have to agree with Stephen’s lifestyle but that don’t mean he gets to be killed and no one gets to find out what happened.”
