REDDING, Calif. — A case has been dismissed for the second time against a man charged with attempted murder and assault, among others, because of a lack of judges in Shasta County, according to the Shasta County District Attorney's Office.

The case against Brett Epps was terminally dismissed on Tuesday, meaning it cannot be refiled.

The District Attorney's Office says Epps was initially charged with attempted murder, assault with a deadly weapon, assault by means of force likely, criminal threats, corporal injury to a spouse, child abuse and false imprisonment by violence.

The prosecution had been ready for the trial since March 8 and was on standby for 10 days before the dismissal, according to the district attorney's office. The case was dismissed for the first time on March 25 because it timed out due to the lack of judges and courtrooms available to hear the jury trial.

NEWS RELEASE: On June 25, 2024, the Shasta County Superior Court terminally dismissed the case of Brett Epps, 24F01886. This is the second time the Superior Court dismissed our criminal case against Epps, therefore it cannot be refiled and Epps will not be held accountable. Both times, a prosecutor in our office was prepared to conduct the trial and objected to the dismissal. The Superior Court was required to dismiss it each time as they lack enough courtrooms and available judges to hear this case for jury trial.

The history for each dismissal is as follows:
23F3158: Epps was charged with attempted murder, assault with a deadly weapon, assault by means of force likely, criminal threats, corporal injury to a spouse, child abuse and false imprisonment by violence. This was the first original case filed against Epps. On March 25, 2024, the Shasta County Superior Court dismissed Brett Epps’ case 23F3158 because the case timed out due to a lack of courtrooms and judges available to hear the jury trial. The People declared ready for trial on March 8, 2024, and were on standby over the next ten days waiting for a judge and courtroom to become available. A judge did not become available and on March 25, the Shasta County Superior Court dismissed the case due to the court’s inability to begin the trial within the timeframe required by law. When the Shasta County Superior Court dismissed Epps’ 23F3158 case, the case was immediately refiled by the prosecutor assigned to the case. It’s case number then became 24F1886.

24F1886: This case is the refiled case from the first Superior Court dismissal, discussed above, and contained the same charges. In this case, the People once again declared ready for trial on June 14, 2024, and were on standby over the next ten days waiting for a judge and courtroom to become available. A judge did not become available and on June 25, the Shasta County Superior Court dismissed the case due to the court’s inability to begin the trial within the timeframe required by law. This dismissal was once again over the objection of the Shasta County District Attorney’s Office. This dismissal was terminal, meaning the case cannot be refiled and Epps will not be held accountable.
The terminal dismissal of the Epps case was the second dismissal for this defendant for the same crimes by the Shasta County Superior for a lack of courtrooms and judges available to hear this case. A terminal dismissal means this case cannot be refiled.

The dismissal of cases by the Superior Court, over the objection of the Shasta County District Attorney’s Office, for lack of available judges has been an ongoing issue. In 2024 alone, the Shasta County Superior Court has dismissed 16 felony cases for lack of available judges to hear the jury trial.

This case was investigated by the Shasta County Sheriff's Office.

The DA’s Office is taking every available action to safeguard our community, such as arguing against the dismissals in court and refiling dismissed felony cases when possible.

I'm horrified that this happened in the US, let alone my own home state. This was a violent DV assault, I wonder how his victim feels about this? Violated by Epps first, the judicial system next. Nikki's violent assault case filed against her husband, is due to be dismissed on July 5th because she is "MISSING". Is that a coincidence? I think NOT.

This isn't a good look for Shasta County. They solved the Sherri Papini case, but those of violent crime against women, are falling by the wayside.
 
2017 Charges:
Brett Andrew Kelly Epps: 27, of Anderson was arrested Monday in the area of Gilmore Road and Mina Avenue and booked on the charge of battery of spouse, ex-spouse or date. Bail was $5,000.

This guy has been hurting women for years :mad:
