Sending positive vibes to Travis's family today for the settlement conference. Tanisha posted that they will be there after Juan told them it is important for them to attended. So I'm sending special thoughts to them today for this conference...hope they feel empowered and that their presence makes CMJA squirm in her seat.

If it gives them any sense of satisfaction, maybe CMJA can have a little temper tantrum within earshot of the family? We know of several meltdowns, so this would not be a first.

Glad to hear that you went and your headache is now gone. Did they do a CT scan and an MRI? It was hard to tell from the way that you posted...

Hope you have a chill evening with hubby and kids and no more headaches.

Please do follow up with the neurologist. If these headaches did not occur when you were pregnant but are coming back, this is something to look into a bit deeper.

When I given a Lupron Depot shot 1 month prior to an EA; I developed the worst headache in my life. (I hardly get headaches).

I went to ER, got treated for a migraine, because they said the Lupron Depot caused my estrogen levels to plummet which caused the migraine.

Hang in there! :seeya:

We have snow in Parma Ohio!! Oh Dear God, let it stop :banghead:

Both sides in the Jodi Arias case sit down with a judge in a closed conference today. The issue is whether the State will take death off the table. I suspect that the State won't agree unless the sentence is life without the possibility of release and Arias agrees to waive all appeals. But the State may not agree to that either. The conference is not open to the public.

Since her family set up an appeals donation fund just recently, I wouldn't think any deal would erase her appeal ability.

The only other thing scheduled on the docket is an oral argument for 11/1, if the state takes death off the table, would the 1st become sentencing? Kind of fitting, All Hallows Day for her trip to the gallows, finally.

Hey everyone, Good morning :-) I thought if FJA was given the DP all of her appeals
would be automatic and we the citizens of Arizona would be paying for them, but if she was given LWOP she would be paying for her appeals, which would explain her asking for donations. Since she is asking for donations for her appeals was there some type of deal made for her to get LWOP, is that what this hearing is for today, or is it just for the judge to make more delays?

Wish I was in Maricopa County today! I have a feeling there will be another sentencing trial.

Jodi will not settle for LWOP and 0 appeals.

BBM~ ITA. So, if Jodi has no more cash; she cannot appeal?

I can't find any meaning to it except what you said. That's exactly what is happening. She probably is counting on the longer this goes on the more people will forget about what she did. I don't think so.

I think what it means is this: that the ex-waitress high school drop out convicted murderer sits alone in a tiny cell. Her isolation
means she is restricted from manipulating everyone around her, playing mind games, inflicting pain on others, and from manufacturing drama.....all those things being as necessary to her as food and water.

Agitation by tweet is all she has left. Not as satisfying as seeing people suffer or bend to her will in person, no doubt, but better than nothing. That's one reason why I appreciate the folks who find her utterly ridiculous and laugh at her. I imagine ridicule is the one punishment she finds unbearable. Bring it on.

 Well put! Jodi is having a hard time hanging onto her DT, lack of "experts" since the Dr. Samuels/ALV fiasco.

Maybe, just maybe she should take the stand and testify as to what really happened. :banghead:

Also, how can one file for bankruptcy and ask for donations? Isn't this counter-productive?

Looks like there is a lot of confusion about the appeals process for the DP vs. life sentences.

This is from an article addressing appeals in California, but I believe it to hold true for Arizona as well:

Unlike death penalty cases, however, LWOP sentences receive no special consideration on appeal, which limits the possibility they will be reduced or reversed. A person sentenced to die in prison receives only one automatic appeal, not several, and is not provided any court-appointed attorneys after this appeal is complete, usually within two years of the initial sentence.

I would think as an indigent she'd still be able to appeal (the same way she has attnys now) but my meaning was really that if any deal has been approved by her, it must preserve her appeal ability, otherwise why would the family set up a trust for appeal donations?

I'm on pins and needles, with JM telling the family to be there it just seems like something is going to be set in stone.

I think I just found that same article. :)

Went looking for context about the appellate process in AZ. For those interested in full academic immersion, check out James Lie man's study about the DP. 175 pages of analysis, including many many charts and graphs showing state by state statistics , including percentage of DP convictions overturned by each state ( I think az' s number was 10%). The rate of reversible error found in DP cases upon appeal in every state was WAY higher... shocking really.

The other interesting tidbit i came across was that AZ is pressuring the Justice Dept. to allow the state to accelerate the post conviction appeals process..so those sentenced to death get executed sooner rather than later.

Interesting:

Michael Kiefer ‏@michaelbkiefer 34m Jodi Arias settlement conference today. County Atty Bill Montgomery says he no longer plans to attend and will leave it to Juan Martinez.

Oooo that is interesting. Has a date finally been set for the retrial of the DP phase? I'm sick and tired of waiting it's ridiculous. Bad Bad JuJu for them NOT to continue by now.

I don't think the DP is going to be taken off the table. I bet JM asked family to be there so they could say in person, to her face, that they are 100% in favor and united in seeking the DP. If so, I wonder if those soliciting funds for appeal can be charged with fraud?

He's leaving it up to JM, then it's gonna be the needle.

Today is a closed door conference to decide on how to proceed.

1. Either a deal a struck or-
2. A retrial of the sentencing phase.

If its up to JM and the family, have to believe no settlement, since the family has made it clear what they want. I trust JM to get it right, no matter what the decision is.
