RP on his conversation with cop at Wynberg SAPS and not going straight to Diep River SAPS: "I felt the information had been shared with them and I did not have a photo of Gill with me. He said the information would be sent through."

SG: Even though Wynberg cop said you must go to Diep River SAPS to sign the forms and get reference forms for missing person case, you never went.
RP: I never did. I had intended to do it on my way to my sister's but for some reason I forgot.

RP: I had felt I had registered a missing persons case by going to Wynberg SAPS and being assured it would enter the system.
SG: You say you forget but also said it was your intention to report your wife missing.

A Wynberg cop observed Packham was calm and collected at station. RP says the cop cannot say how he felt or thought. "I was sitting quietly waiting for somebody to give me some service."

RP testified on Monday that trauma counsellor at Diep River told him a body had been found on back seat of BMW.
SG says his wife's body was found in the boot.
RP: "Clearly that [info from counsellor] was incorrect".

RP says SAPS didn't know what to do with him at Diep River SAPS. "She [counsellor] had almost no info for us and I all I needed was info. I was frustrated, I was numb, I think I was in a state of shock, I couldn't believe what was happening."

State turns to Packham having dinner with his sister the day his wife went missing. He said signal at his sister's was poor. And that his phone's battery went flat that evening. SG asks why he didn't think to keep it charged.

RP: "It honestly didn’t cross my mind [to charge]. I hadn’t been keeping track of battery status. It might have been charging in my car during the day.... It was more habit that I used to plug it in in case it needed a top up."

SG keeps asking RP to pay attention. Judge asks him not to look at his sister and daughter behind SG. RP says he is not.

Judge: "Maybe they [your sister and daughter] should try not to look at you because I think that may have been part of the problem."
RP: "I hear you but I am not paying attention to my family."

State says there are two calls after Packham left his sister's house and his work phone had run out of battery. SG: There is a call from your sister at 22:17. Was that to tell you she is picking you up? RP: I think so.

SG: Then there is a call from investigating officer at 22:22. That is the Diep River SAPS number. RP: I don't know that number.
SG: Is it possible he actually did call you earlier than midnight?
RP: If that's the only call he made then possibly.

SG: After the call from the IO, you are then at home because of cell towers.
RP: I was at home or Diep River SAPS.
SG: At 23:01, until 23:03, some of your activity is picked up at Sheraton West tower.
RP: I don't know where that is.

SG: "What time did you actually arrive home that night?"
RP: "I don't know my lady". He also can't recall what time the IO phoned. He wants to look at phone records but Judge says the idea is to see what he remembers.
RP: "I think I was at home".

[Galloway and the Judge are giving him a hard time. He's arguing many points with Galloway but she won't let him off the hook. I love Galloway]

RP: I told IO I had a very difficult day and if I could speak to him the next day.
SG: At 00:32, you had a conversation with somebody which lasted 1100 seconds.
RP says he does not follow.

SG: Just after that call at 00:32, it appears your phone is off again.
RP: It does look like that.
SG: It's in call forwarding mode.
RP: I honestly don't know [if I turned it off or redirected to voicemail].

SG: At 07:43 the next day, your phone picks up signal at Clifton beach and the reason you gave was that you couldn't sleep [and drove around]. You wanted to meet IO at 8:30, and he wanted 08:00.

SG: Did you drive to Clifton that morning?
RP: Correct. I drove all the way around the coast from Hout Bay, to the promenade at Sea Point.

SG: You arrived back almost an hour after you were due to see the IO. You said you were so numb and emotional, struggling to report wife missing. The police involved in the case want to talk to you and you say you are too tired.

SG: You couldn't sleep, went for a coastal drive and then missed your appointment with police. RP says he is horrified to see the time. It was not his intention.

He can't sleep so he goes on a scenic drive! He has a meeting in the morning about his missing wife.
 
SG: Yet you told the IO you couldn't speak to him that night because you were exhausted, not because you were traumatised. And then missed your appointment. RP: Unwittingly.

RP: I am afraid the state of concern and shock I had felt the night before, was worse the next morning. I went past all the beautiful view spots Gill and I used to go, wondering how this could have possibly happened to us.

SG: And what about after they identified the body as your wife? Did you ask about the investigation then or if they had caught anyone.
RP says he asked for news when the IO was at his home.

RP says he can't recall phoning the IO in those first few days or visiting him.
SG asks why Rob didn't "camp out on the door step" of the police.
RP: We were waiting for the DNA results. I didn't want to hound the police.

SG: So the IO was at your house to look around, not to update you?
RP: They never came to my house to update me. I didn't go to police because my daughters and I were seeing them every day or two.

This guy is a gentlemen, and doesn't 'jump up and down' like the others.
Hope Susan Galloway ends really well with her X.

RP said he knew the photos with his number plate were of his vehicle, but he could not say the same for the photos of his tyres, which did not show a number plate. Perplexed, SG said he had admitted at the start of the trial that the photos were of his vehicle. He replied: "This picture of my tyres, I honestly don't know."

SG charged: "Are you trying to suggest that police sneaked [sic] in photos of another vehicle’s tyres?"

RP said he had seen police officers taking photos of the front of his car, but was not in attendance when the other photos were taken.

Judge Elize Steyn intervened. "Is that your garage?" she asked. Packham confirmed it was.

RP told the Court that he was "not inclined" to share the PIN number of his work iPhone with police as he was "not happy with all the information out there". SG said that investigating officer Sgt Sonnenberg had testified that RP had told him he had forgotten his PIN. "Where would Sonnenberg have gotten that information that you had forgotten the PIN?" RP replied, "I don't know. I don't remember".

SG turned the court's attention to CP's burner phone that he used to contact his mistress. He conceded sending his former lover a message at around 8.30am on the morning of his wife's disappearance, telling her he had overslept. But SG pointed out that according to his version, at that time he was driving to car dealerships to find a new car for his wife. "I was in the habit of sending her a message at the start of the day”. But that morning he hadn't, so had "clumsily" sent her that one.

SG pointed out that he had not said he had gone to car dealerships in his statement, but had said he went to work soon after his wife left and had "tried to create the impression" that he had been at work. RP said he couldn’t explain why his visit to car dealerships was missing in his statement, but conceded that he had read and signed it.

Two days after Gill’s disappearance, he allegedly sent his former mistress a message saying the madness would soon be over and then they could be together. RP said he didn’t remember sending that message, but did not dispute sending it.

He made a major major mistake on the tires IMO - trying to continue on with his absurd henpecking approach to the questions by claiming he couldn't be sure those were photos of his tires.

SG holed him below the water line and after he went round in nonsensical circles he was essentially forced to admit they were his tires (just like in the defence opening admissions)

So therefore he changed the tires and was caught horribly in the lie.
