circumstantial evidence and beyond reasonable doubt

In a circumstantial case no individual fact can prove the guilt of the accused. Where the Crown’s case depends either wholly or in part on circumstantial evidence, then the jury is asked to reason in a staged approach. The Crown first asks the jury to find certain basic facts established by the evidence. Those facts do not have to be proved beyond reasonable doubt. Taken by themselves they cannot prove the guilt of the accused. The jury is then asked to infer or conclude from a combination of those established facts that a further fact or facts existed. The ultimate fact the Crown asks the jury to find based upon the basic facts is that an accused person is guilty of the offence charged.

Justice Byrne warns jury not to look at Facebook, Twitter, LinkedIn, YouTube, to answer questions about the trial #badenclay

11:38am: Justice Byrne has advised the jury to decide the case "exclusively upon the evidence".

"If, outside this courtroom, you have herd or read, or otherwise become aware of information about the events with which this trial is concerned or about the accused, it is of critical importance that you put any such information completely out of your minds," he said.

"Have regard only to the testimony, the exhibits, and the admissions made here in this courtroom since the trial began.

"Ensure that no external influence plays part in your deliberations."

Fuller says Allison had flashbacks about it. Gerard insists he was not concerned about the two women running into each other. #badenclay

Fuller says Toni made the decision to leave the business herself after Allison found out about the affair. #badenclay

Fuller says Toni was angry at person who let the affair slip. No suggestion that she was angry at Gerard until he made the claim. #badenclay

Fuller asks the jury to believe Toni's version of events. Toni told Gerard it was unfair for both women to be at the conference. #badenclay

Fuller says Toni had no option. She's just started a new job. She had to go. #badenclay

Sorry bit of a lag with the forum today
