Tim Miller: Possible Lawsuit against Casey

I don't understand (bold). Searchers were looking for a dead body, IF the family knew Caylee was dead, how does that change anything?

KC knew exactly where Caylee was. There was no need for a search. ZFG did not take Caylee, she was not missing. Her mother knew exactly where she was therefore using valuable resources to search that could have been used for a family that had a child missing and who was actually abducted. This could be considered a hoax and we know it's a lie.

TES does not usually search for the bodies of children who were killed by a parent. LE usually does that. Once Tim got here I think KC's demeanor led him to believe Caylee was dead. Money already spent, they went on with the search.

Tim has nothing to lose. If she gets some money he'll probably get a piece of it. If they go to court he could get more than he's asking for.

Money wise, it appears the tables may have turned for KC. One can only hope. jmo

Whether Tim Miller wins his suit or not, does anyone think JB looked further than his opening statement stating that FCA lied about Caylee being with the invisa-nanny, and then stating Caylee died June 16 in the family pool? Does anyone think he realized admitting to that might open up some lawsuits against FCA? or did he not think 10 minutes ahead like his client often did. I just read the Request for Admissions and Interrogatories on the Motions thread, I would LOVE to see FCA have to answer those questions and admit to those facts. Or will she just plead the 5th because of her pending "appeal"? I understand she does not have to say when she told JB re: atty/client privilege, and knowing FCA, I don't expect anything she would admit to or answer to be the truth, but I thought it was interesting reading those legal documents. I think JB opened up a new can of worms by that opening statement, IMO, MOO, etc. As others say here, though, not sure how far this suit will go, but I hope it can go to trial at least. IMO, MOOO.

Yes, Tim was looking for a dead Caylee all along, he didn't expect to find Caylee alive in the woods or in a field. That's why Cindy was so upset with him, she wanted him to look for a live Caylee. Tim made the decision to search, believing Caylee was deceased and believing Casey knew where she was. He tried to get her to tell him specific places he should look on a map, remember?

"Money already spent" would not apply to searches conducted after the initial search.

If you read the TES lawsuits up in the Motions thread it might help to understand more of why he is going after her. ThinkTank put them up there and the links are good.

I don't think JB anticipated the suit by Tim or the diver. Of course he knew about the Z?G suit because that was ongoing. LP has not sued yet and, as I've said all along, I don't think he will.

I don't know about the diver. Not sure he has a case because it was LP that was trying to convince everyone that Caylee was there. We know the A's did not ask LP to search. lol

The TES interrogatories are very interesting. Even asks her to state the name and address of the biological father of Caylee.

ETA: Forgot to say how happy I am that Tim is suing and hope he is successful. He deserves it.

I was thinking about that too, and I think that JB thought she would be going to prison, so they would not have to worry about paying any money to anybody. I think his only goal going into trial was to get her LWOP or a lesser charge. I think that whole DT is gobsmacked that she is out and they are now left with a whole heap of problems, ranging from what to do with a sociopathic, lying, unemployable leech to all the money they are going to be on the hook for.

That's the kind of thing that makes me doubt the validity and sincerity of these suits. What does the name of the father have to do with the events Tim is suing for? Does Tim really feel he has a legitimate beef or is he on an ego trip like Morgan, wanting to be known as the hero who gets the truth out of Casey?

I don't think LP has a chance in hell of getting a dime if he ever sues. State will get some money back and Tim might be able to recoup some. Zanny could also get something but these people aren't going to be collecting tons of money. State stands to get the most back. I also think RK could win against LP. I think that case has some merit to it.

I think Z?G will lose, Tim could go either way, RK will win, LP will never file suit. But then again, it's impossible to predict any more what the courts will do, after Casey's murder trial and Howard K Stern and the drug pushing doctor were let off, I lost all faith in our legal system.

I'd say covering all bases. The way KC lies....bio dad is still unaccounted for and could be the next one under the bus..... Funny but I think every day ZG's case gets stronger and stronger. jmo

I lost a lot of respect for TM when he started this law suit.

I lost a lot of respect for TM when he started this law suit.

I doubt if he will ever sue anyone again but I think this one he has earned. CA's phone message to him was cruel and meant to hurt him deeply. I'm sure CA hit her mark. I do not think he expects to win but we never thought KC would walk. If he does win and gets this money it may help to save another child that has gone missing in the future. This suit is by TES and Tim will not personally benefit. I think TES is justified to go after her.

If she received LWOP she'd be paying for her crime. She's out but she may still end up paying for her crime. jmo

If he needs to sue someone, he might want to go after CA, after all she is the one who called him, not KC. The way this is coming down leaves a bad taste in my mouth, especially since he pulled out of the search early after I had donated a reasonable amout.

I don't know if you remember, but several people asked for their money back - not sure if they got it or not. I didn't, I wanted it to be used for finding lost children, BUT, to me this law suit diminishes TM, at least in my eyes.

Interrogatories IMO tend to be inflammatory...it's like the gloves come off...not the law's finest moment, IMHO.
