I’m in Charlotte today, covering the sentencing phase of the Steven Wiggins murder trial. Wiggins was found guilty on all counts Thursday. Starting today, a jury will decide if he deserves the death penalty, life without parole or life with the chance of parole. @nc5

The makeup of the gallery is pretty remarkable. The entire left side is reserved for the family of Sgt. Daniel Baker. On the right side of the gallery, the only person there in support of Wiggins is his mother. I’m told she’s been here every day of the trial. @ChrisDavisMMJ 8m

Judge Wolfe cites Payne vs. Tennessee — saying he can’t allow Sgt. Baker’s mother to lobby for the death penalty, but other statements about the pain of his death will be admissible.

We’re now moving on to two motions. The first: defense is arguing one of Tennessee’s justifications for the death penalty is torture causing death — and that doesn’t apply in this case because Wiggins mutilated the body after death. @ChrisDavisMMJ 12m
The state is arguing there were actions before Sgt. Baker’s death and also meet that threshold. They plan to use Dr. Lee, the coroner, to prove that @ChrisDavisMMJ 6m
Judge Wolfe denies the defense’s motion and rules that Wiggin’s additional shots after Baker’s death meets the state’s statue of “heinous, atrocious and cruel.”

The state is now moving to strike testimony from one of the defense’s witnesses. The defense plans to do the same for one of the state’s. Very inside baseball, but it’s important to resolve before the jury comes in.

DA Ray Crouch is about to begin the state’s opening statement. The defense has opted to do their opening statement after the state rests. @ChrisDavisMMJ 41m
Crouch is brief in his opening, promising 5 things: 1) Wiggins had a prior felony 2) The crime was heinous, atrocious and cruel. 3) Wiggins committed the crime to avoid arrest. 4) Wiggins was a law enforcement officer on duty. 5) Wiggins mutilated the body.

The state’s first witness in this phase of the trial is Metro’s Chief Medical Examiner Feng Li, who performed an autopsy on Sgt. Baker.
