As another lawyer says here, fun legal fact. Hypotheticals are allowed and commonly used with expert witnesses. ALV should never have been qualified as an expert, IMHO.

I would guess that psychotherapists use that word in therapy too, but yesterday you'd think she had never heard of that term. "You want me to assume a hypothetical about something with which I have no evidence?" (along with questioning, confused face)
