IMHO the hole is being dug a little deeper each day. Another awesome, damaging day against MR for the Crown. Wonder why Derstine was so against the pictures and their titles? TLM was the one on the look out and she had a lot of time to take in her surroundings while MR was sexually assaulting Tori in his car. MOO

The one tweet stated that the pics where evidence and they are not her evidence ...really when you think about it, the title did not suit.

Derstine just brought a more focused attention on it and I'm certain the jury was paying close attention:please:

The pictures did give credibility to McClintics testimony

It's also good that TLM never saw the photo's

Pffft I won't believe a single word out of his mouth. He could have been honest from the get go, if he was innocent, and went to LE to turn TLM in right after she murdered Tori. OR better yet called 911 from the scene. Hogwash. JMHO

No, it doesn't mean that (necessarily). Having your day in court is an idiom. This article was written the day before the trial began. It merely means that the trial was about to start and it was time for MTR's case to be heard. Putting a defendant on the stand is rarely done for such serious charges and I doubt it will happen here.

In July, however, Det. Staff-Sgt. Smyth told the trial, it was learned that a cellphone tower near Mount Forest, north of Guelph, placed Mr. Rafferty in the general area on the day Tori vanished.

So, that answers the question of what additional information Smyth got just before discovering Tori's remains. We were all wondering and speculating about that. Today's testimony and evidence also refute the theory that some of Tori's belongings were found by him near the entrance to the laneway. And those who speculated that there would be video or photographic evidence of the crime taken by one of the accused can probably lay that to rest, too. There have been one or two shocking revelations so far, but a lot of old theories have been debunked.

Is it safe to assume that Det. Smyth is done on the stand now or should we expect the defense to call him back up even though the defense had no cross exam questions for him?
 
Because he has been there before IMO

After seeing the photos that Wondergirl posted upthread, I have to agree with you: MR had to have been there before. How does one chance upon a spot that secluded where a body can be hidden?

In regards to MR looking up at the ceiling I was thinking that this fella is screwed no matter where he looks! If he looks bored, if he seems to frown, if he seems to smile, if he seems to look tired, or if he seems interested, there will always be someone to criticize his response. Just how should the accused in a prisoner box look anyhow? Is there a right way for him to look? What would be the most appropriate look / thing to look at during his trial? JMO

Well, when something is being shown on a screen, why wouldn't the accused look at it? Why would you look away? Wouldn't you be curious to see what they have against you? Wouldn't you want to look at the evidence, slide shows, pictures so you could speak to your lawyer about it afterwards?

It isn't about appropriateness; it is about being engaged with what is going on around you.

yes he is "screwed no matter where he looks" because what happened to Tori is unspeakable and his reaction to testimony is certainly interesting and worth noting imhoo

I am not sure if he is on the defense witness list (we will most likely find out when they give their opening statement but not sure:waitasec:)

Hopefully the jury have the intelligence to realize they are to base their verdict on the evidence, and not how MR looks or what he's looking at.
