The accused then tied & gagged the woman to a table & raped her again. He then whipped the victim on the back with a whip he had brought with him & finally forcibly performed oral sex with the victim. The accused filmed large parts of the events with a video camera he had brought with him). Braunschweig Regional District Court

Said to have brutally forced the girl to have oral sex. The accused also videotaped this act). Took place between Dec. 28, 2000 to April 8, 2006 on the Praia da Luz, Algarve coast, Portugal.

*Among other things, he was instructed to examine whether, in the case of the conviction of Christian B. for one or more acts, the prerequisites of paragraphs 66 of the Criminal Code were met.
Security custody: Requirements of § 66 StGB
The order of custody according to § 66 para. 1 StGB is permissible under the following conditions, all of which must be met: Someone is currently sentenced to a prison sentence of at least two years for a crime specified in § 66 (1) StGB. The perpetrator has already been sentenced to a prison sentence of at least one year twice in the past for such an act. He has already served at least two years in prison because of these old acts or was in the prison deprivation of liberty. Preventive custody always presupposes that the convicted person has a tendency to commit serious crimes & represents a danger to the general public at the time of his conviction.
*With the report of the expert, the procedure turns onto the home straight. Next Wednesday, Oct. 2, 2024 there will be an appointment for decisions about applications. From the Chamber's point of view, however, we all had witnesses, said the judge. If there are no surprises, the taking of evidence is nearing completion. A plea would be possible in the second week of October.

October 2, 2024. Wednesday, Day 36: Braunschweig. All evidence is collected for the chamber in the Christian B. trial. From the prosecutor's point of view, the accused has been in prison for many years. In the trial the public prosecutor demanded 15 years in prison for the accused in their closing arguments. Following the prison sentence, accommodation in preventive detention is necessary, said Chief Prosecutor Ute Lindemann before the Braunschweig Regional Court. Should such a judgment come about, the accused could not be released after serving the sentence. Lindemann had previously stated in a multi-hour plea why she found the accused guilty of two rapes & two cases of sexual abuse. At the start of the trial, the 47-year-old German was accused of three rapes & two cases of child sexual abuse, which he is said to have committed in Portugal between 2000 and 2017. The accused should be acquitted of a rape allegation, Lindemann said. In the morning, the criminal division closed the evidence. The presumption of innocence applies. The defense plea is expected on Monday, Oct. 7, 2024 & the verdict could be on Tuesday, Oct. 8, 2024.

*Proceedings before the 2nd Criminal Division in connection with five offenses against sexual self-determination expected verdict on October 8 or 21, 2024. In the proceedings of the 2nd Criminal Division, both the public prosecutor & the co-plaintiff pleaded on October 2, 2024. The defense's plea is now to follow on October 7, 2024. The 2nd Criminal Division has announced that the verdict will be pronounced on Tuesday, October 8, 2024, or Monday, October 21, 2024.

Godfrey says 3/2/19 is the last time she saw Noah. 11 yr. old daughter in CPS custody.
Godfrey plead guilty (12/19/19) & was released from custody (10/15/20) on own recognizance.

October 8, 2024. Tuesday, Day 38: Brückner was acquitted [found not guilty] by the District Court in Braunschweig, northern Germany, of three charges of aggravated rape & two of sexual abuse of children in Portugal between 2000 & 2017. The presiding judge, Uta Engemann, said the 47-year-old could “not be convicted of the acts he is accused of” because of insufficient evidence & ruled: “The defendant is acquitted.” The responsible senior public prosecutor, Hans-Christian Wolters, is horrified by the verdict & said to BILD while the court was giving its reasons: “We are appealing the decision to the Federal Court of Justice. He will then check the judgment for legal errors. We hope that a BGH decision will be made before the prison release in September 2025. We would then have the opportunity to consider applying for a new arrest warrant. And: “In addition, if necessary, we will also check whether we can apply for an arrest warrant in Maddie’s case. We have evidence that Christian Brückner killed Maddie McCann.”

*Jury Selection set to begin (@ am ET) – IN – Abigail Joyce Williams (13) & Liberty Rose Lynn German (14) (Missing Feb. 13, 2017, found killed Feb. 14, 2017, after walking on a local hiking trail & were discovered around noon about 50 feet from the north bank of Deer Creek which is about 0.5 miles from the Monon High Bridge Trail, Delphi) – *Richard “Ricky/Rick” Matthew Allen (44 @ time of crime/50/now 52) arrested & booked (10/26/22) into the Carroll County Jail & charged & arraigned (10/28/22) with 2 counts of murder while committing or attempting to commit kidnapping of both victims. Plead not guilty. Held without bond.
Amended charges (1/18/24/granted 3/18/24): 2 counts of felony murder (knowingly & intentionally), 2 counts of murder (while committing or attempting to commit kidnapping of both victims). Transferred to White County jail from Carroll County for security reasons. And was transferred (11/2/22) to IN. DOC at Westville Correctional Facility at a more secure facility. Was awaiting transfer to Westville Correctional Facility but Judge Gull denied move (6/15/23). She plans to take the arguments under advisement & will make a ruling on whether or not he will be moved out of Westville at a later date. Judge Gull denied move (7/5/23). On 12/6/23 Allen was transferred from Westville to Wabash Valley Correctional Facility (long term segregation). Allen was booked (5/6/24) into the Allen County Jail [for hearing on 5/7/24]. She said the jury would then be sworn in on the fourth day (10/17/24) with opening statements beginning by Day 5, 10/18/24. That means the jury could start hearing testimony on 10/19/24. After jury selection, the actual trial phase of the proceedings will take place at the Carroll County Courthouse in Delphi. Gull confirmed Allen’s trial will take place six days a week — Monday through Saturday — if there are no religious objections from any of the jurors. Jury will be sequestered.

9/12/24 Update: Preliminary hearings for all was continued on 9/19/24 @ 8:30am. 9/19/24 Update: The three members of a Perris foster family accused of abusing children in their care, including several of the Turpin children who previously endured years of torture & neglect at the hands of their parents, pleaded guilty to felony charges in Superior Court in Riverside on Thursday, Sept. 19. Marcelino Olguin pleaded guilty to four counts of lewd acts on a child 14 or 15 years old, with the defendant being at least 10 years older; three counts of lewd acts on a child younger than 14; one count of false imprisonment; and one count of injuring a child. Olguin will serve seven years in state prison after he is sentenced & will be required to register with the state as a sex offender, his attorney, Paul Grech, said on Thursday. Olguin’s wife, Rosa & their daughter, Lennys, also entered guilty pleas. Both admitted to three counts of willful child cruelty & one count each of false imprisonment & intimidating a witness. Rosa Olguin also pleaded guilty to grand theft. They both face sentences of four years of probation & a four-year suspended sentence. Lennys Olguin will also be sentenced to 150 days in the sheriff’s work-release program; Rosa Olguin faces 120 days in the work-release program. All three are scheduled to be sentenced on 10/18/24.

10/18/24 Update: Marcelino Olguin was sentenced to 7 years in prison. Olguin will have to register as a sex offender for the rest of his life. The also judge ordered that the Olguin to not make contact with any of the nine victims, including the Turpin siblings. Lennys & Rosa were sentenced to 4 years of formal probation.

Judge Fran Gull dismissed jurors at 11:35 a.m. She indicated that testimony from the next witness on Monday would be “quite lengthy,” meaning it’s likely jurors will hear from the first law enforcement to arrive at the scene and secure it at the start of the investigation. After the jurors were dismissed, the defense said they wanted to submit a deposition from Anna Williams, Abby's mom, as "an offer of proof on a 3rd party perpetrator." It was given on Aug 30, 2024--after that 3 day hearing. The defense said it was new evidence that they had not had at the time of that hearing. See post #297 & 298, page 15, thread 199.

Woodward was found guilty of 1st degree murder with special allegations that the killing was motivated by hate & that it was committed using a weapon. 8/16/24 Friday, Trial Day 9: A two-week-long jury trial ended this week with the Will County State's Attorney's Office & the Will County Sheriff's Office winning the successful prosecution of Danica Ford's killer: Deiontae McMillian of North Carolina. McMillian faces for a mandatory prison sentence of 20 to 60 years, to be served at 100 percent. "Yesterday, the Will County Sheriff’s Office was pleased to learn that McMillian was found guilty by a jury of his peers for the murder of Danica which occurred in November of 2018," Will County Sheriff's Office Deputy Chief Dan Jungles said. 10/11/24 Update: Defense attorney Jill Eimerman wants Judge to toss out information that she was pregnant at the time of her death or had been recently pregnant. Arguing the information is irrelevant or would be prejudicial in the first-degree murder trial of Louisma. But the prosecution argued the information was relevant & could show a motive for why Louisma killed Melody Hoffman, who died by strangulation. During the hearing, 6th Judicial District Judge Chad Kepros went over a motion in limine — facts or circumstances of the case — the defense wants to keep out of Louisma’s trial. Jill Eimermann argued the pregnancy is irrelevant and, “even if deemed to have some relevance, its probative value is outweighed by the danger of unfair prejudice.” She also argued the fact that Hoffman was “low-functioning” was irrelevant to the elements of the crimes. It would be more prejudicial to Louisma and invoke emotion from the jury. Linn County Attorney Nick Maybanks argued Hoffman’s pregnancy is a potential motive, along with the fact that Louisma was in a relationship with another woman at the same time he was involved with Hoffman. Judge Kepros said he would take the motion under advisement and provide a written ruling before trial. Jury selection for Louisma’s trial will start on 10/31/24, with testimony starting 11/4/24.

A Holton man was sentenced late Wednesday afternoon to terms anticipated to keep him in prison at least 36 years for the killings in a Topeka house fire of his girlfriend and their two daughters.

Kyle Tyler, 33, was given three sentences, to be served consecutively, for crimes linked to the January 2023 deaths at 916 S.W. Warren Ave. of his girlfriend, Gerry Fitzpatrick, 30, and their daughters, Peyton Tyler, 9, and Kourtney Tyler, 1.

Katie Garceran, public information officer for the office of Shawnee County District Attorney Mike Kagay, said Kyle Tyler was sentenced to serve:

• Life in prison, with no possibility of parole for at least 25 years, for first-degree murder in the commission of a felony linked to the death of Fitzpatrick.
• Six years, seven months for aggravated arson involving substantial risk of bodily harm.
• Four years, 11 months on a second conviction for aggravated arson involving substantial risk of bodily harm.

Tyler pleaded guilty to those charges in August in exchange for the dismissal of charges of two counts each of first-degree murder in the commission of a felony and aggravated child endangerment, court records show.

A man received sentences Wednesday expected to keep him in prison at least 36 years for the Topeka fire deaths of his girlfriend and two daughters.
