Belinda was murdered in 1999 and David was not arrested until 2004. So, until David’s arrest Evan lived with his surviving parent and Heather, his dads new wife. David and Heather allowed Evan no contact with Belinda’s family. I would assume when David was arrested it made sense to leave Evan with Heather since she had been his “mother” all that time. I don’t know if the Lucas’ ever attempted to get custody or visitation.

It is, in some ways, one of the saddest aspects of this case. IMO, Evan was raised as if Belinda never existed. The woman he calls mom is the woman his dad murdered his mom for. A woman, IMO, that lied for and protected his dad and knows way more than she’s ever told about his mother’s murder. I am hoping against hope Heather has seen the light and will tell us what she knows when she testifies this time.

Yes, it's incredibly sad how Belinda's family was cut out of Evan's life. I doubt the Temple family even mentioned Belinda to Evan when he was growing up except in brief conversations. I wonder if he's ever even been to her grave since childhood.
 
The woman he murdered to be with filing for a divorce is sort of poetic justice for him. I wonder if she wanted divorce him before, but was too afraid. He looks like he would be a jerk. I can imagine him to be at least emotionally abusive, if not physically abusive. No longer than babyfaced guy that he was when he killed Belinda.

It is sad about Evan. On this site, if you look up Josh Hilberling who was murdered by his pregnant wife, he family does not get to see Josh's son. They hope to know him when he is older, but to even go through all the court and the brainwashing and stress that it would put on a child already traumatized by his dad's murder and later his mother's suicide, is not worth it at this time.

Then there was the Baptist minister that murdered his wife and had custody of the daughters until he was convicted. Those girls did not know their grandparents either and were teenagers when they were forced to start having introductory visitations, yet, later they grew to love their grandparents and realized what their father really was.

Nevertheless, it is a horrible tragedy to inflict upon a child. They lose one parent, sometimes the guilty one as well, and then they have to struggle with losing the image that they had of that parent. It happens everyday. It is hard to understand what the killer parent is thinking about. I guess they are thinking that they will never get caught.
 
Completely agree he should. Especially now that he's a grown man and married himself. However, he was never allowed contact with Belinda's family after her murder, and I wouldn't put it past the Temple family having manipulated him into believing his Daddy is innocent and his mom's family is the enemy. Likely he has no memories of his mom, and I can't imagine much was done to keep her memory alive for him as he grew up. So sad. If there is any hope of him ever seeing the truth, it will come from Heather. He thinks she's his mom, and he loves her, that is clear. MOO.
My bet would be that they told him that those neighbor kids did it and that he was, and is, falsely accused.

Judge Kellie Johnson, presiding judge - David Tempe re-trial will make a decision on the court rule violation soon. Decision to declare a mis-trial or not.

Per the KPRC reporter who is "live" outside of the court room, for now, testimony is continuing until Judge Johnson rules one way or the other!

KPRC2 legal analyst Brian Wice said he doesn’t expect the judge to go for a mistrial, saying the jury likely didn’t hear the live stream.

Heather Temple is expected to testify sometime this week if the judge rules to keep the case moving forward.

I’m a huge 48 Hours fan, but this episode paints a very one-sided, pro-defense picture of the case. Kelly Siegler doesn’t do herself any favors either. I read last week that Ms Gotro has her law license suspended for three years recently, which is why she’s not participating in the retrial.
 
I am so happy Judge Kelli Johnson ruled: NO mistrial in the David Temple re-trial.

Based on what I heard when watching the Opening Statements, I did not hear David Temple or his attorneys "discussing" his case/trial!

Thankfully, the Lucas family does not have to wait even longer for the trial and verdict had a mis-trial would have been declared. Moving forward!

I’m re-reading Shattered right now. There is information in this book I hope the prosecutor can bring to light in the trial. David Temple lived an entitled life where regularly behaved badly and some times broke the law, yet rarely had to face the music. He and his parents remind me SO much of Scott and the Petersons. The golden boy got what he want when he wanted it, and when he was done with you, it was like you never existed. I have no doubt that Belinda was killed because he did not want her, did not want their daughter, and refused to share Evan with her. That and a divorce might tarnish the picture perfect facade he worked so hard to create. Please, please, let this jury see the truth and put this monster back where he belongs.
 
Someone help me here...from memory, the shotgun Riley Sanders “stole” from his step-dad and had his friend hide (the one the defense claims is the murder weapon) was safely hidden under his friend’s bed BEFORE the murder, and not retrieved and turned over to law enforcement until AFTER the murder. Meaning, even if he’d wanted to rob/kill Belinda that day, he did not have access to the weapon in question. Am I wrong about this? I’m not to this point in the book yet...TIA.

I'm glad you enjoyed it Ann, they did such a stellar job with it, so well thought out and well written.

Glad too there was no mistrial, although I'm not sure why the judge was so worried about jurors hearing anything, they were admonished not to read/watch/listen to anything trial related, and other trials across the country are being live streamed without judges being overly concerned. The jurors are given the warnings, expected to follow them and apparently they do.
