It may be probative, material and relevant to crimes they are investigating. AG very well may have been moonlighting as a package girl slinging dope which is why she was at his home???

Perhaps most would find it harder to believe she had a side hustle than her story of how and why she was there? Sarcasm some....

 
Was the elevator not working in the building that night?

Several residents there are posting stuff on facebook and twitter showing walk arounds, how the doors work and so forth.

I haven't read anything about the elevators not working although I do recall seeing a 5th search warrant dated the 14th seeking elevator records. I believe it requires a resident key to operate.

Absolutely. Now, some might argue that Stand Your Ground laws might be in play. And, this officer has muddied the waters as she was in uniform (discouraged by DPD), used her service weapon, and was (by her account) acting as an officer giving commands. She did not assert that she was a police officer in any account I have read (affidavit released). However, the initial investigation and her arrest were all conducted as this was an officer involved shooting, so she got extra protections. If it was not being investigated as an officer involved shooting(OIS), her car, her gun, and her home would have secured as well as Mr. Jean's home. They would have also gotten a warrant for residue immediately. And, they would not have let her make calls. She reaped a lot of benefits by being an officer initially.

DPD has some issue with their lack of clarity. That said, I wonder how closely the DPD policy on an OIS followed with the two level investigation before it was determined not to be an OIS. If procedure was not followed, DPD and the investigation team should be in an internal review process right now.
 
SYG statute requires the claimant not to be in the commission of a crime during the killing. Some statutes have clear language that the shooter cannot be in SYG situation due to any fault of their own.

I am wondering why it appears that EMT brought Botham on the stretcher down the stairs instead of using the elevator.
 
Actually I do remember reading somewhere about the above points 1 and 2... But not worded exactly like that, not to mention I think it was said 12-15 ft. Without a link, it is not possible to verify, but I can check.

Don't remember seeing point 3 reported anywhere at all.

One of the law enforcement officials said Guyger has always said she was in the doorway but Jean was not. The same official said Jean was 12 to 15 feet away from the door when first responders arrived.

“That is where he stood when he was shot and where he fell,” that law enforcement official said.

The law enforcement official said police spoke to one of those witnesses the night of the shooting and the witness did not offer that account to police. Law enforcement, however, is looking into those accounts.

When I read that article, I just thought some anonymous LE was leaking and feeding the media. Though the 12-15 ft was useful info for me.

Response from Texas Rangers sounds about what I expected. They don't want to pursue any charges at all. Apparently they feel LE shouldn't be held accountable for murdering innocent citizens.

The whole thing looks like a stalemate. Someone needs to step up and do the right thing by filing murder charges.
 
I actually didn't catch that detail although if that is what happened, it is a good question. Perhaps the elevator was known to be turtle slow or they had cleared all unoffical personnel and didn't have a key handy?

THAT BOMBSHELL NEEDS TO BE FOUND, ARCHIVED AND DISSEMNATED FAR AND WIDE!

There is a "Shooting incident fact sheet" floating around on FB, supposedly sent out to "Mayor and Members of the City Council" from "Asst City Manager Jon Fortune" the day after this happened. It states the initial understanding was that the officer was working security at the apartment complex and had a master key. Now where would that info come from?

I've been waiting for msm to pick it up so it can be discussed here.
Anyone have any contacts in the local media world?

That is strange to me. They would not have been able to continue CPR easily on the stairs. In many buildings near where I live, the security team/person has the key to hold the elevator on a floor for a medical emergency until the EMS team is ready to go. Did the EMS team walk up the four floors? Or, use the elevator?

I thought it was strange also since no one could perform life saving measures and also a much longer way.
