I don't post often but read a lot, I live near Dallas and this story is heart breaking. I do not cry often but can't stop! He was 2, he was disabled (had only one leg) and beaten and tortured by his mothers cousin and her boyfriend. This precious boy! I would have taken him, i would have loved him as my own! How can this continue to happen? I know there are places people can take newborns but what about older children. I swear i want to start a list of people that would take these sweet children, no questions asked, just keep them safe!

Another parent who puts their child's life in the hands of " family " and the child dies. If they didn't want the child to stay with them then why did they allow it? I don't get these cases at all. It just makes no sense. I mean did they just take the boy in to be their own personal punching bag? Grrrrr
 
RIP Brandon...This story is beyond heartbreaking. WHY WHY WHY?
 
I live just outside of Tyler, and I am just shocked!! That poor baby, I hope that he was unconscious early on and didn't suffer much :( as horrible as that is. I mean what in the heck could a two year old do to invoke that kind of rage is beyond me. I've been hugging my baby extra tight since I heard about this.
 
I don't want to derail the thread, but why couldn't this mother give this baby up to someone who would take care of him? He is so sweet looking.

The article said they had to transport them with bullet-proof vests on because of outrage over Brandon's death.

Geoff Morgan, a county paramedic, was one of the first responders on the scene and is helping to organize the vigil.

"It just touched me knowing that a child had to go through that," Morgan said. "My main goal after a day or so was to get a large group of people out here show there's care."

If I knew punching my screen wouldn't break the monitor I would. That woman is smirking, after what she had done? Smirking!!! I'd love to take the same belt they beat that baby with and just.... GRRRR.

Prosecutors have announced they are no longer seeking a death sentence for a Campbell woman, should she be convicted of capital murder involving the death of a 2-year-old boy...

Arturo Aguilar Vega pleaded guilty Oct. 6, 2014 to one count of capital murder and was automatically sentenced to life in prison without the possibility of parole.

A start of trial has not been announced in Ortiz's case.
 
A Campbell woman is scheduled to stand trial on a charge of capital murder this summer, more than five years after she allegedly killed a 2-year-old boy.

A new trial date was set Wednesday by 354th District Court Judge Richard A Beacom for Gabriela Ortiz, charged with capital murder in the July 2011 death of Brandon Herrera.

Jury panel qualification proceedings will take place Aug. 1, followed by individual juror voir dire on Aug. 4 and the scheduled start of testimony on Aug. 8. Additional pretrial hearings were scheduled on June 9 and June 23.

A Campbell woman is waiving her right to a jury trial on a charge of capital murder in connection with the death of a 2-year-old boy.

Gabriela Ortiz will be tried before a judge, more than five years after she allegedly killed Brandon Herrera.

A hearing is set in the 354th District Court this morning, during which Ortiz’s defense attorney is to file a motion to waive a trial by jury in the case.

Should Judge Richard A. Beacom accept the motion, trial would begin in the courtroom Aug. 8.

A Campbell woman has agreed to plead guilty to a charge filed in connection with the death of a 2-year-old boy five years ago.

Gabriela Ortiz had been indicted on a count of capital murder involving the 2011 death of Brandon Herrera.

But defense attorney Jack Paris and Hunt County District Attorney Noble D. Walker have reached an agreement which will allow Ortiz to plead guilty to a first-degree count of injury to a child and then with a sentencing trial before 354th District Court Judge Richard A. Beacom beginning Aug. 8.

In a motion filed with the court Monday, Walker and Paris indicated they had reached agreement to dismiss the three earlier indictments, the most recent count of capital murder, and a count of injury to a child by an act.
