Everything from Day 2 so far...
First up is motion to suppress evidence from second search of Arochi Camaro.
Defense challenges warrant on technicality, saying it lacks right language to incorporate accompanying affidavit
Judge Rusch said affidavit has probable cause; still researching law on what language required. Ruling on hold.
Next is challenge to search warrant on Arochi's house in Allen.
This warrant has same issue, challenging technicality on wording linking warrant to affidavit.
Motion to suppress Arochi's hotmail account records granted because affidavit ruled insufficient
Motion to suppress Arochi's Yahoo account records granted because affidavit has same flaw - ruled insufficient
Now on challenge to court order for Arochi's toll records. Prosecutor calls PPD Detective Cathy Stamm to stand.
Stamm testifies Arochi brought copy of his toll records during his 2nd police interview with her on 9-4-14.
Prosecutor says Arochi has no right to privacy for toll records since he volunteered same records to police
Defense says no privacy when driving on toll road but records of toll account do have expectation of privacy
Judge denies motion to suppress evidence from Arochi's toll records. They are deemed business records.
Judge explains Arochi waived ability to complain about records obtained when he gave similar records to police.
Judge denies defense motion to quash indictment, saying it is sufficient to let Arochi know what charge is.
Next motion is on election between acts. "It's a lawyer thing," judge tells puzzled audience. Too early to rule.
Next is defense motion to sequester jurors, alternates. Judge: "I will leave open the ability to change your mind"
Potential jurors to be told sequestration a possibility. Judge willing to grant at trial. No ruling right now
Judge says change of venue motion to be heard on Wednesday.
Next is defense motion to suppress and Brady motion on DNA evidence and related testimony.
Defense calls to the stand Rick Staub, manager for CSI unit for @PlanoPoliceDept
Staub testifies that Plano unit did chemical test on evidence from Arochi Camaro to check possibility of blood
Actual DNA testing and analysis not done by Plano PD, Staub testifies
Chemical testing also done at Arochi house in bathroom, on couch and in garage.
Staub testifies that his unit used chemical to detect presence of blood to decide what to send for DNA testing.
Defense says Plano lab not accredited for DNA analysis and should not be allowed to testify about what it did.
Prosecution says Plano lab did nothing improper and should be allowed to testify about chemical tests it did.
Prosecution: Chemical tests determine why send a few dozen pieces of evidence and not 5K pieces for DNA testing.
Judge says it's clear Plano unit qualified to do crime scene analysis and not certified to do DNA analysis
Judge denies motion to suppress DNA evidence & related testimony as it relates to @PlanoPoliceDept
Defense brings up more case law. Judge now questioning Staub about certification.
Nothing changes, judge rules. Motion still denied. "I believe my ruling is correct," Judge Mark Rusch says.
Court now talking about new procedures recommended by FBI for DNA calculations. State says new format was used.
Judge denies defense motion to suppress evidence obtained from Arochi's credit report that showed his accounts.
